Zoning, building permits and septic rules in the Borough of Frenchtown, New Jersey

The Borough of Frenchtown, New Jersey requires building permits for construction1, and the borough lists its Construction Department at 18 York Street, Lambertville2. Frenchtown adopts and administers its own zoning, because New Jersey counties do not zone34. Does Frenchtown, NJ have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. The Borough of Frenchtown adopts and administers its own zoning ordinance, and Hunterdon County does not set zoning for the borough34. The borough is divided into districts, among them R-1 low-density residential, R-3 multifamily, R-4a central commercial, R-5 low-impact industrial and R-7 conservation/open space6.

In the R-1 district, a new principal home needs a lot of at least 1 acre without sewer, or 33,000 square feet where sewer is available10. Front setbacks in R-1 are 75 feet without sewer and 60 feet with sewer, and buildings plus paved surfaces together may cover no more than 15 percent of the lot1112. A principal building in R-1 may be 35 feet tall13.

Living in a travel trailer, camper or motor home on a Frenchtown lot is prohibited; the code makes exceptions for emergency housing after a fire, storm or flood and for construction trailers7. A manufactured home is allowed as a single-family dwelling if it is at least 22 feet wide, on a permanent foundation, and on land the owner holds in fee8. We could not confirm a tiny-home rule or an accessory dwelling rule; ask the zoning contact below.

Do you need a building permit in Frenchtown, and who issues it?

Yes. Construction of buildings and accessory structures inside the Borough of Frenchtown needs a construction permit, and a permit for an accessory building cannot issue before the permit for the main building on the same lot, except for construction trailers, storage sheds and farm accessory buildings1. Frenchtown adopts the state Uniform Construction Code by reference, and New Jersey law makes it unlawful to build, alter or change the use of a structure without first filing an application and obtaining the required permit1415.

The borough's directory lists its Construction Department at 18 York Street, Lambertville, NJ 08530, for questions about what needs a construction permit and for permit status2. Zoning applications, fences, property lines and accessory structures go to the same contact16. The Hunterdon County rules for unincorporated land do not apply inside the borough; the county's own pages say municipal construction and zoning permits are handled at the municipal level17. The borough's published fee amounts were not available to us, so ask the Construction Department for the current schedule18.

How do septic permits work inside Frenchtown?

Septic permits are not issued by the borough's construction office. Hunterdon County Environmental Health performs septic design review, site and installation inspections and certification of completed systems5. The county provides the application for a permit to construct, alter or repair an individual subsurface sewage disposal system, and the health department must certify or approve the septic plan before a building construction permit is issued19. New Jersey law also bars a building permit until the board of health certifies the water supply and sewerage plans20.

Much of the borough may not need a septic system at all. Owners of buildings on a street along a borough sewer line must connect within 90 days after sewer service becomes available, and any connection needs a written permit from the borough2122. We could not confirm which Frenchtown streets have sewer or whether the county handles every on-site system inside the borough, so call Hunterdon County Environmental Health before you rely on either answer23. County-wide, USDA rates only about 10 percent of soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system24.

Can you live in an RV or tiny home on your land in Frenchtown?

No, not in an RV. Frenchtown prohibits using travel trailers, campers, motor homes and similar vehicles as temporary or permanent living quarters while parked on a lot7. Vehicles may be parked or stored on a residential lot only in a side or rear yard7.

The code allows two exceptions: emergency trailer housing for a household displaced by fire, storm or flooding while its home is rebuilt, and construction or sales-office trailers7. We did not find a tiny-home rule in the borough code, so a tiny home on wheels should be treated like an RV until the zoning contact says otherwise. A manufactured home on a permanent foundation is a different case and is allowed under the conditions above8.

Building a home in Frenchtown: the steps, in order

  1. Confirm the zoning district and the lot standards with the zoning contact before you buy166.
  2. Find out whether the lot is on borough sewer or needs a septic system; septic plans go to Hunterdon County Environmental Health1923.
  3. Get septic plan approval, which comes before the building permit20.
  4. Apply for the construction permit through the Construction Department; zoning approval comes before the construction permit225.
  5. Schedule the periodic inspections New Jersey requires, such as footings, rough plumbing and electrical, and framing26.
  6. Have septic work inspected before it is covered27.
  7. Obtain the certificate of occupancy after final inspections; an owner who built the home must file an affidavit with the construction official first289.

What stays with Hunterdon County, and what to check before you buy in Frenchtown?

Septic review and inspections stay with Hunterdon County Environmental Health, and the county reviews subdivisions before local approval529. For land outside the borough, see the Hunterdon County page.

A driveway onto a state highway needs an access permit from the state, not the borough30. Wells need a state drilling permit plus a well construction permit from municipal or county health officials31. Hunterdon County's effective property tax rate is 2 percent, with a median bill of $10,001 a year3233.

Watch-outs

  • Frenchtown's borough code both adopts the state Uniform Construction Code locally and refers to jurisdiction passing to the state Department of Community Affairs, so confirm with the Construction Department who reviews your permit application14.
  • We could not confirm the borough's flood-area rules, driveway standards or minimum home size for R-1, so ask the zoning contact before you commit to a lot16.
  • Owner-builders are exempt only from new-home builder registration, not from permits or inspections34.
