Does Hightstown, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of Hightstown divides itself into zoning districts shown on a borough zoning map2. Mercer County has no zoning power over municipalities, so the borough's ordinance is the one that applies3.

Standards change by district. In the R-1 Residential District, a lot needs at least 15,000 square feet, 100 feet of width and 150 feet of depth5. In R-2, the minimums are 12,000 square feet, 100 feet of width and 120 feet of depth6.

In R-1, a house must sit at least 35 feet back from the street and 45 feet from the rear lot line, with side yards of at least 15 feet each and 35 feet combined9. In R-2, the front setback is 30 feet and the rear is 40 feet10. Buildings may cover no more than 20% of the lot in either district, and all structures and improvements together no more than 35%1112. The height limit for a house is 2.5 stories and 35 feet, and accessory structures are limited to 16 feet13.

Do you need a building permit in Hightstown, and who issues it?

Yes. No one may construct, alter, enlarge, repair, relocate or demolish a building or structure in Hightstown without a permit from the Construction Official1. The borough's Construction Official heads the borough's State Uniform Construction Code enforcing agency14.

Routine repairs are the exception. The borough's construction page says ordinary repairs on a one- or two-family dwelling do not need a permit15. The borough lists fences and sheds as zoning permits, and asks you to check with the Zoning Officer before installing a hard-surface driveway16.

Construction permit forms are on the borough's forms and permits page, and inspection requests go in writing to the construction office17. Statewide, the local enforcing agency must approve or deny a complete application within 20 business days18. Permit fees are set by each municipality's own fee ordinance, so ask the construction office for Hightstown's schedule19.

How do septic permits work in Hightstown?

New Jersey law bars a municipality from issuing a building permit for a new realty improvement until the board of health having jurisdiction certifies the water supply and sewerage facilities7. A septic system must also be inspected by the board of health's representative before it is covered20.

In Hightstown, the Freehold Township Health Department serves as the local health department under a shared services agreement4. We could not confirm from an official page whether that office, the borough's board of health or another agency reviews septic plans for a specific lot. Call the Freehold Township Health Department and the borough's Construction Office before you rely on a septic design, and ask whether public sewer is available at the address, because a sewer connection can change the answer entirely.

Can you live in an RV or tiny home on your land in Hightstown?

We could not confirm a rule. The borough's code contains a temporary-trailer provision, but the text we reviewed does not settle RV occupancy, tiny-home occupancy or temporary camping inside the borough. Treat each as not allowed until the borough's Zoning Office tells you otherwise in writing.

Statewide, a manufactured (HUD) home is limited to use group R-5, single-family dwellings21. Which district would accept one is a zoning question for the borough Zoning Office. A dwelling cannot receive a certificate of occupancy until water, sewer, electric and gas are installed and in service22.

Building a home in Hightstown: the steps, in order

  1. Confirm your lot's zoning district and its minimum lot area, setbacks and coverage limits with the borough Zoning Office5.
  2. Get septic and well approval from the health department with jurisdiction before applying for the building permit7.
  3. File the construction permit application with the Construction Official; zoning approval and other required State, county and local approvals must be in place before a permit issues23.
  4. Build, and stop for the required inspections, including the footing trench, rough plumbing and electrical, and framing24.
  5. Request the certificate of occupancy; a new building may not be used or occupied until the construction official issues it25.

Can you build your own home in Hightstown as an owner-builder?

New Jersey excuses a person building a new home for personal use from builder registration, but that is not an exemption from construction permits or code compliance26. An owner-built home needs an affidavit filed with the construction official before a certificate of occupancy can issue, and the owner must acknowledge that the work is not covered by the New Home Warranty program8.

We could not confirm any borough-level exemption from construction permits for owners. Ask the Construction Office.

What stays with Mercer County, and what to check before you buy in Hightstown

Mercer County does not issue building permits or zoning approval inside Hightstown3. For land outside the borough, see the Mercer County page.

Before you buy, ask the Zoning Office which district the lot sits in and whether it is in a flood-prone area, since we could not confirm the borough's floodplain development rules. A driveway onto a State highway needs a State access permit27. Mercer County's effective property tax rate is 2.5%28, so budget for it.

Watch-outs

  • Lot size, setbacks and coverage differ between the R-1 and R-2 districts, so confirm the district before relying on any number56.
  • A building permit is not issued until the health department with jurisdiction has certified the septic or water facilities, so start there7.
  • We could not confirm rules for RVs, tiny homes, accessory dwellings, subdivision or driveways in Hightstown; ask the borough Zoning Office before you plan around any of them16.
