Does Metuchen, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of Metuchen adopts and administers its own zoning under Chapter 110, its land-development ordinance1. District boundaries are drawn on the Borough Zoning Map5. New Jersey counties have no zoning power of their own, so Middlesex County does not zone land inside Metuchen10.

Rules differ by district. In the R-1 Residential District, the minimum lot area is 10,000 square feet6. Setbacks are 25 feet in front, 10 feet on each side (20 feet combined) and 25 feet in the rear7. Buildings may cover 30 percent of the lot and impervious surfaces 50 percent11. Height is capped at 35 feet and three stories12. Where neighboring houses sit closer or farther than the schedule, a new one- or two-family home must match the average adjacent setback7.

We could not confirm Metuchen's rules for RVs, tiny homes, manufactured homes, accessory dwellings or a minimum floor area. Ask the borough's zoning officer before you rely on any of them.

Do you need a building permit in Metuchen, and who issues it?

Yes. New Jersey's Uniform Construction Code makes it unlawful to build, enlarge, alter or demolish a structure, or change its use, without first filing with the construction official and getting a permit3. Only ordinary maintenance is exempt13.

In Metuchen the permit comes from the borough's own Code Enforcement Agency, which the borough code establishes for that job14. The borough, not Middlesex County, issues building permits here15. Fees are collected before a permit or certificate is issued2. Inside a flood hazard area, a separate floodplain development permit from the Floodplain Administrator may also be required16.

Owner-builders still need the permit. The state's exemption for a person building a home for personal use concerns builder registration, not permits17.

How do septic permits work inside Metuchen?

We could not confirm a septic rule specific to Metuchen. The borough code requires lots in development applications to connect to the public sanitary sewer system, so most buyers inside the borough will be on sewer rather than septic8.

If a property does have a septic system or needs one, the Middlesex County Environmental Health Division says all septic work requires its approval18. New Jersey law bars a building permit until the board of health having jurisdiction certifies the sewerage facilities19. Call the division on 732-745-8480 to confirm how that applies to your address18.

Building a home in Metuchen: the steps, in order

  1. Confirm the lot's zoning district on the Borough Zoning Map and check the district's lot, setback and coverage limits5.
  2. Get any land-use approval the project needs; subdivisions follow separate minor and major procedures in Chapter 11020.
  3. Confirm sewer connection, or septic approval with the county, before applying for a building permit819.
  4. File the construction permit application with the borough's Code Enforcement Agency; the state form packet asks for one original plus three photocopies21.
  5. Expect a decision within 20 business days of a complete application22.
  6. Schedule the periodic inspections; the code stops work at footing, rough plumbing and electrical, and framing stages23.
  7. Obtain the certificate of occupancy before moving in24.

What stays with Middlesex County, and what to check before you buy in Metuchen

Septic approval and well permits sit with county or state health officials, not the borough425. Subdivision and site-plan applications that touch county roads or drainage also go to the county planning board, which does not replace borough approvals26. For land outside Metuchen, see the Middlesex County page.

A few things to check: whether the lot lies in a flood hazard area16; whether you plan to rent it short term, which the borough prohibits for rentals of 150 days or less9; and the tax bill. Middlesex County's effective property tax rate is 2.2 percent27.

Watch-outs

  • Metuchen's own rules for RVs, tiny homes, manufactured homes and accessory dwellings were not confirmed; ask the borough zoning officer before buying for those uses1.
  • Rentals of 150 days or less are prohibited in the borough, so a short-term rental plan needs a different answer9.
  • The setbacks and lot sizes above are for the R-1 district only; other districts differ7.
