Do you need a building permit in Fair Haven, NJ?

Yes. Fair Haven's code says no building or structure may be erected, added to, or structurally altered until the Construction Official issues a permit1. The Borough has set up its own Uniform Construction Code enforcing agency, the building department10. Statewide, a permit is also required for structural, plumbing, mechanical and electrical work on existing buildings, while ordinary maintenance such as routine repair is excepted11.

A building cannot be occupied or used until the Construction Official issues a certificate of occupancy5. Monmouth County does not issue the construction permit under the state code; the Borough does11.

Who issues building permits in Fair Haven, and how do you reach them?

The Borough of Fair Haven's own building department, headed by the Construction Official, issues building permits10. Contact Borough Hall at 748 River Road, (732) 747-024112, and ask for the Construction Official.

An applicant should expect a decision within 20 business days of a complete application, and the municipality sets its own permit fees by ordinance11. Where the work is in a flood hazard area, the Floodplain Administrator may also require a floodplain development permit in addition to the building permit13.

Does Fair Haven have zoning, and what does it mean for setbacks and lot size?

Fair Haven zones its own land. Chapter 30 of the borough code, Land Use and Development Regulations, regulates land use and development locally2, and a permitted-use schedule covers the residential districts R-40, R-30, R-20, R-15, R-10A, R-10B, R-7.5 and R-54.

For riverfront lots, the minimum river setback is the greater of 50 feet or the average setback of structures on the abutting riverfront property, never more than 75 feet14. Minimum lot size, lot coverage and building height vary by district under state law15; we could not confirm the numbers for each Fair Haven district, so ask the Borough's zoning official before you buy.

We found no Fair Haven rule on tiny homes or accessory dwelling units; ask the Borough before planning either.

How do septic permits work inside Fair Haven?

Septic permits in New Jersey come from the board of health that has jurisdiction, and no building permit may issue until that board certifies the septic and water plans6. Septic systems must also be inspected before they are covered16.

We could not confirm which health department handles on-site septic systems inside Fair Haven. Monmouth County's Office of Public Health handles septic approvals and inspections for its member municipalities only17, and other Monmouth municipalities are served by different health departments18. Ask Borough Hall, or the county office19, which one covers your address.

Much of Fair Haven fronts a sewer: buildings on a street with a sewer must connect, following Two Rivers Water Reclamation Authority rules7.

Can you live in an RV or tiny home in Fair Haven, NJ?

We could not confirm a Fair Haven rule on temporary camping or tiny-home occupancy, so do not assume either is allowed. Any dwelling built or placed in the Borough is a building that needs a permit and a certificate of occupancy before it is occupied15.

A manufactured (HUD) home is limited under state rules to use group R-5, single-family dwellings, and installation follows federal standards20. Short stays are a separate matter: rentals of residential dwellings for under 95 consecutive days are prohibited in Fair Haven's residential districts9.

Building a home in Fair Haven: the steps, in order

  1. Confirm the zoning district and its dimensional standards with the Borough's zoning official4.
  2. Check septic or sewer: ask the health department with jurisdiction about septic6, or plan the sewer connection7.
  3. Apply to the Construction Official for the building permit; the application must comply with the Uniform Construction Code1.
  4. If the lot is in a flood hazard area, apply to the Floodplain Administrator as well13.
  5. Schedule inspections at the required stages, with at least 24 hours' notice21.
  6. An owner who builds a new home files an affidavit with the construction official before a certificate of occupancy can issue8.
  7. Obtain the certificate of occupancy before moving in5.

What stays with Monmouth County, and what to check before you buy in Fair Haven

Monmouth County does not set Fair Haven's zoning; municipal zoning controls land use3. The county's Development Review Committee reviews subdivisions and site plans that affect county roads, drainage or county property, and building permits for covered projects cannot issue before its approval22; site plans for one- or two-family homes are exempt23. Land outside Fair Haven is covered on the Monmouth County page.

County figures give context: the typical home value is about $787,42924 and the effective property tax rate is 1.8%25.

Watch-outs

  • We could not confirm which health department handles septic systems and private wells inside Fair Haven; ask Borough Hall or the Monmouth County Office of Public Health before you rely on either18.
  • A building permit is separate from builder registration: owner-builders are exempt from builder registration for their own home, but a construction permit is still required26.
  • Rentals of under 95 consecutive days are prohibited in Fair Haven's residential districts, with fines of at least $500 for each day of a noncompliant rental9.
  • Riverfront lots face a 50-foot minimum river setback, up to 75 feet, and flood hazard areas need a separate floodplain permit1413.
