Building permits, zoning and septic rules in Freehold Township, New Jersey

Freehold Township, New Jersey requires building permits for new construction: the Township's Construction Division enforces the state Uniform Construction Code1. The Township also writes its own zoning, with a Zoning Officer reviewing proposed construction2. Septic permits come from the Freehold Township Board of Health, not from Monmouth County3.

Do you need a building permit in Freehold Township, NJ?

Yes. New Jersey's statewide Uniform Construction Code requires a permit for construction, alteration and similar work11, and Freehold Township elected to enforce that code itself1. The Township's Construction Department adds that permits are also required for decks, fences and sheds12.

Monmouth County does not issue building permits, so there is no county counter to use for a house inside the Township4. Fees depend on the type and amount of work, are paid before the permit issues, and carry a state surcharge13.

Who issues building permits in Freehold Township, and how do you reach them?

The Township's Construction Division is the enforcing agency: a Construction Official plus building, plumbing, electrical and fire-protection subcode officials14. Call the Construction Department at 732-294-205312.

Zoning approval is a separate office. The Department of Zoning & Housing Enforcement can be reached at 732-294-2068 and the Township's own page says building permits themselves come from the Building Department15.

Monmouth County's role is narrower: its Development Review Committee approves subdivisions and site plans that affect county roads, drainage or county property16.

Does Freehold Township have zoning, and what does it mean for lot size?

Yes. Freehold Township adopted its zoning map in 1980 and keeps it on file with the Township Clerk5. New Jersey counties cannot zone, so the Township's ordinance is the only zoning that applies17.

Rules differ by district. In the R-R Rural Residential Zone, single-family development needs 200,000 square feet of developable lot area, and floodplain, steep-slope, wetland and high-water-table land is excluded from that count7. Maximum lot coverage for all buildings in R-R is 10 percent8. Subdivision and site-plan approval run through the Township's own procedures18.

How do septic permits work in Freehold Township?

The Freehold Township Board of Health issues septic permits inside the Township3. A permit must be issued before a system is located, constructed or altered, and the Board may issue it when the application carries a New Jersey-licensed professional engineer's certificate that the design complies with the code6.

The Township's health page lists a septic permit application and a well application among its forms19. Statewide, a septic system must be inspected before it is covered20. The county health office is not the permit authority here, so a Monmouth County Office of Public Health contact is not the right first call for an address inside the Township3.

Can you live in an RV or tiny home on your land in Freehold Township?

We could not confirm a Township rule on living in a recreational vehicle, on temporary camping, or on tiny-home occupancy. The Township's recreational-vehicle ordinance that we reviewed covers vehicle operation, not occupancy as a dwelling, so it does not answer the question.

Ask the Department of Zoning & Housing Enforcement at 732-294-2068 before you buy or park anything15. Zoning rules set by district decide what may be lived in on a given lot5.

Building a home in Freehold Township: the steps, in order

  1. Confirm the lot's zoning district and dimensional rules with the Zoning Department15.
  2. Check whether subdivision or site-plan approval applies18, and whether a floodplain permit is needed10.
  3. Get the septic permit from the Board of Health, with an engineer's certificate where used6.
  4. Apply for the construction permit from the Construction Department12.
  5. Pass the staged inspections required under the state code21.
  6. Obtain a certificate of occupancy; new buildings need one statewide22.

What stays with Monmouth County, and what to check before you buy?

Land outside the Township is covered on the Monmouth County page. For land inside Freehold Township, the county's role is limited to subdivision and site plans that touch county roads or drainage16.

Before you buy, check floodplain rules, which have their own permit provisions10. Monmouth County's effective property tax rate is 1.8 percent23, and county soils are rated poorly for conventional drain fields, so expect a site evaluation or an engineered system24. A driveway connecting to a state highway needs a state permit25.

Watch-outs

  • The Township's code does not state a general owner-builder exemption from permits; under state rules, an owner-built new home needs an affidavit filed with the construction official before a certificate of occupancy9.
  • We could not confirm Township rules on private well permits, accessory dwellings, driveway permits or short-term rentals; ask the Zoning Department at 732-294-206815.
  • Search results often show freeholdtownship.com, which is not the Township's site; the official site is twp.freehold.nj.us12.
