Monmouth County, New Jersey

Building permits, zoning and septic rules in Monmouth Beach, New Jersey

The Borough of Monmouth Beach, New Jersey adopts its own zoning1 and enforces the State Uniform Construction Code through its own Construction Department2, so building permits and zoning approval are handled at borough hall, not by Monmouth County. A new septic system needs Board of Health approval as part of the construction permit application3. Lots in flood hazard areas also need a floodplain development permit4.

Does Monmouth Beach, NJ have zoning, and what does it mean for lot size, setbacks and RVs?

Yes. The Borough of Monmouth Beach adopts and administers its own zoning and divides the borough into zoning districts1. New Jersey counties have no zoning power of their own, so Monmouth County does not zone land inside the borough8.

Zoning rules differ by district: minimum lot size, setbacks, lot coverage and building height are set district by district under state law910. The borough's district schedule is where those numbers live, and we could not confirm them here, so get the schedule for your parcel's district from the borough zoning office before you make an offer.

We also could not confirm borough rules for tiny homes, accessory dwellings or temporary camping. The borough's flood-damage rules do regulate recreational vehicles in flood hazard areas, so ask the Construction Department before planning any RV use.

Do you need a building permit in Monmouth Beach, and who issues it?

Yes. New Jersey requires a construction permit for new construction and for structural, plumbing, mechanical or electrical work on existing buildings; only ordinary maintenance such as routine repair is excepted11. Inside Monmouth Beach, the borough's own State Uniform Construction Code enforcing agency issues that permit2.

The county does not issue the permit; code enforcement is handled by municipally employed, state-licensed officials11. The Monmouth Beach Construction Department at borough hall takes applications, and inspections are required, ending in a final inspection before a Certificate of Occupancy is issued12.

Fees are set by each municipality's own fee ordinance11. The borough's checklist sets a flood development fee of $150 per applicable application4.

How do septic permits work inside Monmouth Beach?

The borough's new-construction checklist lists Board of Health approval for a septic system3. New Jersey law bars any building permit until the board of health with jurisdiction certifies the sewerage facilities13, and the system must be inspected before it is covered14.

The borough's Health Department page lists the Jersey Shore Regional Health Commission as its health contact15. We could not confirm who performs septic inspections in the borough or whether the borough sets stricter standards. Monmouth County's Office of Public Health handles septic approvals only for its member municipalities, so ask the Jersey Shore Regional Health Commission or the Construction Department which board applies to your lot before you design a system16.

New Jersey also requires a DEP drilling permit for any well17; we could not confirm a borough-specific well rule.

Can you build your own home in Monmouth Beach?

New Jersey exempts a person who builds a new home for personal use from builder registration, but the exemption does not remove the construction permit, inspections or code compliance7. A certificate of occupancy cannot issue until the owner files an affidavit with the construction official18.

Every dwelling unit in the borough must contain at least 850 square feet of gross floor area, measured on habitable rooms6. Check that figure against any small-home or tiny-home plan before you buy.

How do you build a home in Monmouth Beach, step by step?

  1. Confirm the zoning district and its lot, setback and height limits with the borough zoning office1.
  2. Check the flood zone: a Floodplain Development Permit applies where the lot is in a flood hazard area, and V and Coastal A Zones can require more documents4.
  3. Get Board of Health approval for any septic system3.
  4. Apply for the construction permit with the borough Construction Department; no permit issues until required State, county and local approvals are in place19.
  5. Call for the required inspections as work proceeds12.
  6. Obtain the Certificate of Occupancy before anyone moves in20.

What stays with Monmouth County, and what should you check before buying in Monmouth Beach?

Monmouth County reviews subdivisions and certain site plans that affect county roads or drainage, and municipal final approval and related building permits cannot issue before that county approval21. Site plans for one- or two-family residential units are exempt from county Development Review Committee review22.

For land outside the borough, see the Monmouth County page. Fees, flood zone and soils matter most here: Monmouth County's effective property tax rate is 1.8%23, and the typical home value is about $787,42924. Also ask the borough about driveways, short-term rentals and well rules, which we could not confirm.

Watch-outs

  • The borough's zoning schedule for lot size, setbacks, coverage and height was not available to us, so get it from the borough zoning office before you buy1.
  • A permit for work in a flood hazard area can need elevation, geotechnical and coastal-area documents on top of the building permit4.
  • Septic approvals in Monmouth County do not all go through the county; confirm which board of health covers your address with the Jersey Shore Regional Health Commission16.
