Zoning, building permits and septic rules in Hanover Township, New Jersey

Hanover Township, in Morris County, New Jersey, adopts its own zoning through the Township Committee1. New Jersey law requires a construction permit before most building work2, and the Township's Building & Zoning Department is the office to ask3. Does Hanover Township, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. Hanover Township divides its land into zone districts through a land-use chapter that the Township Committee adopts and amends1. The Township's zoning map is dated September 2025, and the Board of Adjustment settles district-boundary uncertainty6. Morris County does not zone; New Jersey's zoning power sits with municipalities, so the Township's rules are the ones that apply5.

Rules change by district, so find the parcel's district on the zoning map first. In the R-40 Single Family Residence District, each lot must have at least 40,500 square feet8. R-40 lots also need a minimum width of 150 feet and a minimum depth of 200 feet8. R-40 yards must be at least 75 feet in front, 20 feet on the side and 50 feet in the rear11. Principal buildings in R-40 may not exceed 35 feet or 2 1/2 stories12.

Do you need a building permit in Hanover Township, and who issues it?

Yes, for most construction. New Jersey's Uniform Construction Code makes it unlawful to build, enlarge, alter or change the use of a structure without first applying to the construction official and obtaining the permit2. Ordinary maintenance is excepted2.

In Hanover Township the Construction Code Official/Zoning Officer leads the Building & Zoning Department, which posts permit applications, checklists and forms3. Morris County does not issue building permits13. The Township's own pages did not state the full permit process or fee schedule, so call the department at 973-428-2462 before you file3.

A certificate of occupancy is required before any building is used or occupied, and the permanent certificate is issued or denied within 7 days after application7.

Can an owner-builder pull their own permit in Hanover Township?

New Jersey's permit form lets an owner who is doing the work on an owner-occupied property sign as an exempt applicant10. That is a statewide form rule: the owner must still follow the Uniform Construction Code, and a contractor doing the work must be licensed10. A person building a new home for their own use is also outside the state's builder-registration rules, but that is not a permit exemption14. We could not confirm a separate Township owner-builder rule; ask the Building & Zoning Department3.

How do septic permits work inside Hanover Township?

Nobody in Hanover Township may build, alter, repair or excavate a sewage disposal system without first getting a permit from the Township Board of Health4. The application needs a certificate from a New Jersey-licensed professional engineer with percolation-test, design-compliance and estimated-flow statements, plus soil samples4. State law also bars a building permit until the board of health certifies the sewerage facilities, and requires an inspection before the system is covered1516.

Where a public sewer runs along the property, each building must connect, and for new buildings the deadline is the 60th day after construction is complete or occupancy begins, whichever is earlier17. Call the Township Health Department at 973-515-6667 for a lot-specific answer18. Across Morris County, about 12% of soils rate as not limited for a conventional drain field, so plan on a site evaluation19.

Can you live in an RV or tiny home on your land in Hanover Township?

We could not confirm this. The Township's land-use chapter has a section on temporary uses of trailers or other vehicles for housing, but we could not read its operative text, and we found no Township rule on tiny homes or camping. Do not assume that either is allowed. Ask the Building & Zoning Department at 973-428-2462 before you park or place anything to live in3.

New Jersey's tiny-home law only lets a municipality choose to rent its own vacant land for tiny homes, and a tiny home is a dwelling of 400 square feet or less excluding lofts20. That law does not by itself allow a tiny home on private land.

Building a home in Hanover Township: the steps, in order

  1. Find the parcel's zone district on the Township zoning map and read that district's lot, yard and height rules6.
  2. Ask the Building & Zoning Department whether zoning approval is needed first; state rules require zoning approval before plan review for an owner-occupied one- or two-family project213.
  3. Get the septic design approved by the Township Board of Health, or confirm a sewer connection417.
  4. File the construction permit application with the Township construction official2.
  5. Pass the required inspections as work proceeds22.
  6. Obtain the certificate of occupancy before anyone moves in7.

What stays with Morris County and the state, and what to check before you buy in Hanover Township?

A driveway onto a county road needs a right-of-way permit from the Morris County Engineering & Transportation Division, after Planning Board approval2324. A driveway onto a State highway needs a state access permit25. County Planning Board review applies to subdivisions, and minor subdivisions that do not front on county roads are exempt from formal county review26.

Watch-outs

  • Short-term rentals of a dwelling for 30 days or less are unlawful in Hanover Township, so a cabin-style rental plan needs a longer lease term9.
  • The Township's pages we reviewed did not give a complete permit fee schedule or process, so ask the Building & Zoning Department for current fees3.
  • We could not confirm Township rules on private wells, driveways, lot coverage or flood-hazard development; ask the Building & Zoning Department and the Township Health Department318.
  • Morris County's own health-department list names a county office for Hanover's septic work, while the Township's website shows its own Health Department; confirm with the Township Health Department which office issues your septic permit18.
