Building a home or addition in the Borough of Netcong, Morris County, New Jersey takes a building permit under the State Uniform Construction Code1. Does Netcong, New Jersey have zoning, and what does it mean for lot size and setbacks?
Yes. The Borough of Netcong adopts its own zoning regulations in its land-development chapter, with a district map and a bulk-and-area schedule2. The schedule lists districts R-1, R-1A, R-2, R-3, R-3A, R-4, B, B-C, I-1, I-2, I-3 and LOR11.
Rules differ by district, so find your parcel's district first. In the R-2 district, a single-family lot needs at least 5000 square feet8 and a home needs at least 800 square feet of floor area9. Setbacks in R-2 are 25 feet in front, 7 feet on one side, 17 feet for both sides combined, and 25 feet in the rear12. Impervious coverage is capped at 40 percent13, and buildings are limited to 2 1/2 stories or 35 feet14.
RVs, tiny homes, accessory dwellings and manufactured homes: we could not confirm a borough rule for living in an RV, tiny home or accessory dwelling, so ask the zoning officer before you plan around one11.
Do you need a building permit in Netcong, and who issues it?
New Jersey requires a construction permit before covered work begins, with exceptions for ordinary maintenance and a few temporary structures1. Netcong's own code establishes a Netcong Building Department as the local enforcing agency under the Uniform Construction Code15. In practice, the borough's website says it has a shared service with Byram Township's construction office, and sends applicants there for building permits and final inspections4.
An extra step comes first for many projects: a deck, room addition, pool, fence or shed also needs a zoning permit, and the zoning officer forwards approved applications to the building department3. The borough's published fees include a $65 minimum construction fee, a $0.038-per-cubic-foot fee for new construction, and a certificate of occupancy fee starting at $12016.
Owners who live in the home they are working on can sign as an exempt applicant for their own work, though licensing rules still apply when a contractor does it10.
How do septic permits work inside Netcong?
Netcong's sewer chapter makes privies, septic tanks and cesspools unlawful except as that chapter allows6. The exception: when no public sewer is available within 100 feet of the proposed building, a developer may install an individual subsurface disposal system, with dry lines for a later sewer connection6. For most lots inside the borough, plan on a sewer connection rather than a septic field.
Where a septic system is allowed, the borough's Board of Health has adopted a code for its design, location, installation and inspection17. State law adds that the board of health with jurisdiction must certify the sewerage facilities before a building permit can issue7, and the construction official must have that approval in hand18.
The borough's website says the Mount Olive health department provides health services for Netcong, so start with that office5. Morris County's Division of Public Health serves only a handful of other Morris County towns and is not the office for Netcong addresses19. We could not confirm the borough's septic permit application steps in its code, so ask the health department what it requires.
Building a home in Netcong: the steps, in order
- Confirm your zoning district and the lot, setback and coverage numbers with the borough's zoning officer3.
- If you will use a septic system, ask the health department whether public sewer is within 100 feet and what approval it needs65.
- File a zoning permit application with a property survey, then let the zoning officer forward it to the building department3.
- Apply for the building permit through the Byram Township shared service4.
- A project that creates a subdivision goes to the borough's planning board, which handles minor and major subdivision approvals20.
- Request your final inspection and certificate; a new building may not be occupied before the construction official issues the certificate of occupancy21.
What stays with Morris County, and what to check before you buy in Netcong?
Morris County does not zone land; zoning is municipal22. Land outside the borough is covered on the Morris County page, and the county's own rules do not apply inside Netcong.
For a driveway, a new connection to a State highway needs a state access permit23, while work in a Morris County right-of-way goes through the County Engineering Division24. A private well needs a NJ DEP well-drilling permit, issued through municipal or county health officials25.
Costs and soils are county-level figures: Morris County's effective property tax rate is 1.8%26 and a typical home is valued at $717,39027. USDA rates about 12.4% of the county's soils as not limited for a conventional septic drain field, so a site evaluation is likely if sewer is not available28.
Watch-outs
- Netcong's borough code sets up its own Netcong Building Department, but the borough's website sends applicants to Byram Township's shared service, so call that office before you file4.
- We could not confirm a borough rule on tiny homes, RV living, accessory dwellings or short-term rentals; ask the zoning officer before you buy or build11.
- A zoning permit comes before the building permit for decks, additions, pools, fences and sheds3.
- Septic systems are unlawful in Netcong when public sewer is available within 100 feet6.
- We could not confirm the borough's flood-hazard development permit conditions; ask the zoning officer or construction office if your lot is near water3.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
