Zoning, building permits and septic rules in Mantoloking, New Jersey

The Borough of Mantoloking, New Jersey adopts and enforces its own zoning in Chapter 30 of the borough code1, and every construction project needs a permit from the borough's construction office under the statewide Uniform Construction Code2. Living in an RV, camper, trailer or mobile home is prohibited inside the borough3. Sewer connection is required once the borough system is operational4; we could not confirm any septic rule, so ask the Ocean County Health Department.

Does Mantoloking have zoning, and what does it mean for RVs, tiny homes and setbacks?

Yes. The Borough of Mantoloking divides itself into zoning districts and administers them through its zoning officer and planning board under Chapter 30 of the borough code1. The districts are R1, R2A, R2B, R3A, R3B, R3C, R4A, R4B, R5A, R5B, R6A and R6B for single-family homes, plus open space, business and public use districts6. Ocean County does not zone; New Jersey limits zoning authority to municipalities10.

In the residential districts, a single-family detached home must have at least 1,500 square feet of floor area7. Accessory dwelling units are not permitted: separate dwelling units cannot go above garages, and uses not listed for residential zones are prohibited8. Living in a boat, mobile home, camper, trailer or other vehicle is prohibited anywhere in the borough3.

We could not confirm minimum lot sizes or the general setbacks; those sit in the bulk standards attached to the code. Ask the Zoning Department11.

Do you need a building permit in Mantoloking, and who issues it?

Yes. New Jersey's Uniform Construction Code makes it unlawful to construct, enlarge, repair, renovate, alter or demolish a structure without first filing with the construction official and obtaining a permit2. Inside the Borough of Mantoloking, that official works in the borough's Construction Department5.

After the final inspection, the official issues a certificate of occupancy12. The borough's fee schedule sets the certificate of occupancy fee at $150, a temporary certificate at $30 and a temporary certificate renewal at $2513. We did not confirm the basic construction permit fee, so ask the Construction Department.

A plumbing permit from the borough construction official is also required to connect to the borough sewer14.

How do septic permits work in Mantoloking?

Mantoloking is built around a borough sanitary sewer rather than septic. Every plumbing fixture in the borough must connect to the system within nine months after the borough publishes notice that it is operational and approved for connection4.

We could not confirm whether any parcel may use a septic system or a private well, or who would permit one. Ocean County's Environmental Health Services office is the county health contact to ask15. Ask it, and the Construction Department, before you assume anything other than a sewer hookup.

Can you live in an RV or tiny home in Mantoloking?

No. Mantoloking prohibits using or occupying any boat, mobile home, camper, trailer, storage trailer or other vehicle for habitation, on public or private property, at any time, even inside a garage3. The same rule covers temporary camping in a camper or trailer16.

A mobile home cannot be lived in either17. Residential zones also bar accessory dwellings8, so a small second unit on a lot is not an option. The residential route is a single-family home of at least 1,500 square feet7.

Building a home in Mantoloking: the steps, in order

  1. Confirm the zone and bulk standards with the Zoning Department11.
  2. If you are combining oceanfront lots south of Lyman Street, note the special limits: 16 percent lot coverage and building heights of 55 feet over the crown of the road for two lots1819.
  3. Subdividing land goes to the planning and zoning board20.
  4. File for a construction permit with the Construction Department before work starts25.
  5. Expect inspections at set stages, including footing trenches before footings and rough plumbing and electrical before framing21.
  6. Obtain the certificate of occupancy after final inspection12. An owner who did design, construction, plumbing or electrical work on a new home must file an affidavit first9.

What stays with Ocean County, and what to check before you buy in Mantoloking

Ocean County does not set zoning here10. Subdivisions in the county also go to the Ocean County Planning Board for review22, and the county health department is the contact for septic and well questions15. For land outside Mantoloking, see the Ocean County page.

Before buying, ask the borough about flood hazard rules, driveway access and short-term rentals; we could not confirm any of them. Ocean County's typical home value is $554,88723 and its median property tax bill is $6,499 a year24; both are county-level figures, not Mantoloking's.

Watch-outs

  • Mantoloking's residential zones limit homes to single-family detached dwellings, with no accessory dwelling units8.
  • We could not confirm minimum lot sizes, general setbacks or flood-zone elevation rules for Mantoloking; ask the Zoning Department and Construction Department before you buy11.
  • Sewer connection is required once the borough system is operational, so budget for a plumbing permit and hookup rather than a septic system4.
