The Borough of Ocean Gate, New Jersey issues its own building permits through the borough Building Department1 and sets its own zoning through the borough zoning department2. Ocean County has no zoning power over the borough3. Septic and well approvals are handled by a board of health, and we could not confirm which one covers Ocean Gate addresses; ask the Ocean County Health Department4.

Does Ocean Gate have zoning, and what does it mean for lot size and setbacks?
Yes. The Borough of Ocean Gate in Ocean County administers its own zoning regulations, and zoning approval is required to construct, enlarge or change the use of a structure, and also for sheds and fences2. Ocean County itself has no zoning authority, because New Jersey limits zoning to municipalities3.
The main residential district is the R district. In the R district, a lot needs 6,000 square feet, 60 feet of width and 60 feet of frontage5. Setbacks are 15 feet in front and 6 feet at the rear and on each side6. Building coverage tops out at 50% and impervious coverage at 65%7, and buildings may rise 35 feet8. The borough code also lists a business and service district10; ask the zoning office which district a specific lot falls in.
We could not confirm Ocean Gate's rules on RVs, tiny homes, accessory dwellings or minimum house size. Ask the borough zoning office before you rely on any of them.
Do you need a building permit in Ocean Gate, and who issues it?
Yes. The Ocean Gate Building Department issues permits to construct, enlarge, alter, renovate, remove or repair a structure1. Plan review and inspections follow the New Jersey Uniform Construction Code9, the same statewide code that applies in every New Jersey town11. Ocean County does not issue building permits for private homes in the borough12.
Some applications need earlier approvals first. Ocean Gate names zoning, flood plain management and engineering as the most common, and some applications are not reviewed until they are granted13. Ordinary maintenance does not need a permit14.
Contact the Ocean Gate Building Department at 732-269-3166 or ogcode@oceangatenjgov.com15. We could not confirm the borough's permit fee schedule, so ask the department for current fees.
How do septic permits work in Ocean Gate?
New Jersey law bars a building permit for a new realty improvement until the board of health having jurisdiction certifies the water supply and sewerage plans4. A septic system must also be inspected by the board of health before it is covered16.
We could not confirm whether Ocean Gate lots are on sewer or septic, or which health office certifies them. Ocean County's septic authority appears to be the Ocean County Health Department17, so start with its Environmental Health Services office18.
Soil is a reason to ask early. USDA rates none of Ocean County's soils as free of limits for a conventional drain field19, so a lot that needs septic will likely need a site evaluation and possibly an engineered system. A private well also needs a state drilling permit and a municipal or county health permit20.
Can you live in an RV or tiny home in Ocean Gate?
We could not confirm. The borough's zoning code regulates use by district10, but we found no confirmed Ocean Gate rule on RV occupancy, camping or tiny homes. Do not assume it is allowed because no rule turned up.
A factory-built home is a different question: HUD manufactured homes are limited to use group R-5, single-family dwellings, under state rules21. Whether Ocean Gate allows one on a given lot is a zoning question for the borough zoning office15.
Building a home in Ocean Gate: the steps, in order
- Confirm the lot's zoning district, lot size and setbacks with the borough zoning office10.
- Ask the Ocean County Health Department about septic or well certification for the address4.
- Get zoning approval and any flood plain or engineering approval the borough requires13.
- Apply for a construction permit with the Ocean Gate Building Department1.
- Request inspections in writing, online through the SDL Portal, or by emailing the borough inspection form to ogcode@oceangatenjgov.com22.
- Pass the final inspection to receive a certificate of occupancy23. If you build the home yourself, you must file an owner-builder affidavit first24.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
