Zoning, building permits and septic rules in Seaside Heights, New Jersey

The Borough of Seaside Heights, New Jersey sets its own zoning, and a new home needs a borough zoning application and a construction permit from the borough Construction Office12. Ocean County has no zoning power over the borough3. Septic approval comes from the board of health with jurisdiction, which we could not confirm is the borough or Ocean County4.

Does Seaside Heights have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of Seaside Heights adopts and enforces its own zoning ordinance, Chapter 246, with a zoning map and districts that include residential, single-family, low-density residential, retail business, resort recreational and public zones511. Ocean County does not zone: in New Jersey only municipalities can set land-use type and density3.

Rules differ by district. In the single-family zone, development needs at least 4,000 square feet of lot area and 40 feet of frontage6. In the residential zone, a single-family dwelling needs 2,000 square feet and 20 feet of frontage12. Buildings in the single-family zone are capped at 27 feet8; other zones use a 41-foot limit measured from the curb13.

Borough-wide, structures must sit at least 10 feet from the front property line, with narrower rear and side setbacks, and boardwalk-fronting lots are excepted7. Overlay zones carry their own standards7. We could not confirm lot-coverage limits, minimum dwelling size or accessory-dwelling rules; ask the Zoning Department14.

Do you need a building permit in Seaside Heights, and who issues it?

Yes. New construction and work on existing buildings in Seaside Heights need a construction permit under the New Jersey Uniform Construction Code2. The borough's Construction Office, known as the Building Department, enforces that code inside the borough1. Permits come from the borough, not Ocean County15.

The borough requires a zoning application with every permit: all permits are first submitted to the zoning official1. Plan review can take up to 20 business days1.

Ordinary maintenance does not need a permit, and minor work has a notice procedure2. Call the Construction Office at 732-793-9100 to confirm what your project needs1.

How do septic permits work in Seaside Heights?

A new building on a private septic system needs the septic plan approved or certified by the health department with jurisdiction before the construction permit can issue9. Before a certificate of occupancy, the system also needs a certificate of compliance16.

New Jersey lets municipal or county boards of health exercise this authority17. We could not confirm whether the borough board of health or the Ocean County Health Department serves Seaside Heights4. Start with the Ocean County Health Department, Environmental Health Services, and ask which board has jurisdiction for your parcel18.

Ocean County soils rate poorly for conventional drain fields: USDA rates none of the county's soils as not limited19. Expect a site evaluation and possibly an engineered system. Whether public sewer is required where available is unconfirmed; ask the Construction Office1.

Can you live in an RV or tiny home in Seaside Heights?

We could not confirm the borough's rules on living in an RV, camping or occupying a tiny home on private land. Seaside Heights zoning is set by the borough, so the answer sits with the borough, not the county5. Ask the Zoning Department before you buy or park anything for overnight use14.

Manufactured HUD homes are limited statewide to single-family dwelling use20. That statewide rule does not answer whether a particular Seaside Heights lot allows one.

Building a home in Seaside Heights: the steps, in order

  1. Confirm the lot meets its zone's minimum lot area and frontage with the Zoning Department146.
  2. Get septic approval from the health department with jurisdiction if you will not use public sewer9.
  3. File a zoning application with your construction permit application at the Construction Office1.
  4. Wait for plan review, then pay the fees; the permit is released after all fees are paid1.
  5. Stop work for the required inspections, such as footing trenches and rough plumbing and electrical21.
  6. If you built the home yourself, file the owner-builder affidavit before a certificate of occupancy issues10; permits and inspections still apply.

What stays with Ocean County, and what to check before you buy in Seaside Heights

Ocean County does not zone or issue building permits inside the borough315. The County Planning Board reviews subdivisions that affect county roads or drainage22. For land outside the borough, see the Ocean County page.

Check flood rules first. Building height here is measured from the base flood elevation8, and the Zoning Department also serves as flood plain manager14. A driveway onto a state highway needs a state access permit23. Ocean County's effective property tax rate is 1.8%24.

Watch-outs

  • We could not confirm whether the borough board of health or the Ocean County Health Department handles septic approval in Seaside Heights; ask the Ocean County Health Department before you rely on either4.
  • Borough rules on RV occupancy, tiny homes, lot coverage, minimum dwelling size and short-term rentals were not confirmed; call the Zoning Department at 732-793-910014.
  • Owner-builders still need construction permits and inspections; the affidavit is a condition of the certificate of occupancy, not an exemption10.
