Do you need a building permit in Guilderland, NY?

Yes. The Town of Guilderland, New York prohibits starting to erect, enlarge, alter, remove, demolish or change the occupancy of a building or structure without a separate building permit from the Building Department for each building, and only ordinary repairs that are not structural are excepted2. The Building Department says permits are required for most construction, renovation and structural changes in town, and that every shed needs a permit regardless of size1. New York's statewide Uniform Code also requires local building permits for work that must meet the code10.

A certificate of occupancy is a second step: a building erected after January 27, 1962 may not be used or occupied until the Chief Building Inspector and Zoning Coordinator issues one, and altered or newly permitted buildings may not be occupied for more than 30 days after completion without one5.

Who issues building permits in Guilderland, and how do you reach them?

The Town of Guilderland Building / Zoning Department issues building permits. Applications go to the Chief Building Inspector and Zoning Coordinator on forms the department provides, with plans, a description of the work, its valuation, and an owner authorization affidavit when someone other than the owner applies11. The fee is set by a schedule the Town Board adopts and can change12.

The department reached at 518-356-1980 ext. 2003 says applications are not complete without payment and insurance1. Applications can be mailed to its PO box or emailed; call for the address currently accepting applications1. Reviews run in the order received, and the department's own page describes a multi-week wait that grows in summer1.

Does Guilderland have zoning, and what does it mean for RVs, tiny homes and lot size?

Yes. Guilderland adopts and amends its own zoning code and keeps an Official Zoning Map at the Town Clerk's office36. Albany County does not zone land for the town; New York State law gives zoning power to cities, towns and villages, not counties13.

The town's districts include Open Space (OS), Agricultural (A), Rural Agricultural-3 (RA3), Rural Agricultural-5 (RA5), the single-family R40, R30, R20, R15 and R10 districts, Country Hamlet, Manufactured Housing, and several business and industrial districts6. Check your parcel's district on the map before you buy, because lot, setback and use rules depend on it.

An owner of a parcel of at least five acres in RA3 or seven acres in RA5, as mapped on June 1, 2005, may apply to the Planning Board for a subdivision exemption14.

How do septic permits work in Guilderland?

Albany County Department of Health, Environmental Health, reviews residential septic designs and inspections for Albany County4. A New York State licensed professional engineer or registered architect must do the site evaluation and system design, and a building permit cannot be obtained until both a water supply and a wastewater system are approved15.

The county fee for an individual residential onsite system is $420, and a new or replacement residential well is $23078. The county inspects installed components before backfilling and again at final inspection16.

USDA rates only 4% of soils in Albany County as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system17. We could not confirm whether the town's sewer system reaches a given lot; ask the Building Department.

Can you live in an RV or tiny home in Guilderland?

We could not confirm a Guilderland rule on living in an RV, camping on private land, or occupying a tiny home. Ask the Town of Guilderland Building / Zoning Department before you buy or park anything1. Do not rely on state campground rules: New York's 14-night camping limits apply to state-run DEC campgrounds, not to private land18.

Any dwelling still needs a building permit and a certificate of occupancy before anyone lives in it25. For manufactured homes, state rules require a certified installer on site during installation, and an owner who will occupy the home may apply for installer certification19.

Building a home in Guilderland: the steps, in order

  1. Find the parcel's zoning district on the Official Zoning Map and confirm with the Building / Zoning Department what the district allows61.
  2. Hire a New York licensed engineer or architect for the site evaluation and septic design, and submit the county application with the fee to Albany County Department of Health15.
  3. Get septic and water feasibility approved, since the county will not release a building permit before that20.
  4. File the building permit application with plans and the fee at the town Building Department11.
  5. If the driveway meets a state highway, apply to NYSDOT for a driveway permit21.
  6. Keep work exposed for inspections, then obtain the certificate of occupancy225.

What stays with Albany County, and what to check before you buy in Guilderland

Septic systems and private wells go through the Albany County Department of Health even though building permits and zoning are the town's43. For rules on land outside Guilderland, see the Albany County page.

Before buying, confirm four things. First, the parcel's zoning district. Second, whether a state highway fronts the lot, which requires a NYSDOT driveway permit21. Third, whether the parcel lies in a FEMA-mapped flood area, where private development needs a local floodplain permit23. Fourth, taxes: Albany County's effective property tax rate is 1.9% and the median bill is $5,253 a year924.

Watch-outs

  • We could not confirm Guilderland's rules on RV occupancy, camping on private land, tiny homes, accessory dwellings or short-term rentals; ask the Building / Zoning Department at 518-356-1980 ext. 20031.
  • A building permit application is incomplete without payment and insurance, so the review clock does not start until both are submitted1.
  • Septic permits come from the Albany County Department of Health, not the town, and the county will not release a building permit until septic and water are approved15.
