The Town of Niles, New York requires a building permit from its Code Enforcement Officer for work that must meet the state Uniform Code1. New buildings need a lot of at least 2 acres, except on Owasco Lake and Skaneateles Lake frontage2. Septic approval comes from the Cayuga County Health Department, not the town3. We could not confirm whether Niles has a full zoning ordinance beyond its setback and lot-area law.

Do you need a building permit in the Town of Niles, NY?
Yes, for most construction. The Town of Niles requires a building permit for any work that must conform to the Uniform Code or Energy Code, including building, enlarging, altering, moving or demolishing a structure1. The town's code lists exemptions for specified small structures, certain equipment, finish work and limited repairs, and the state's model exemption covers one-story detached sheds and playhouses of 144 square feet or less1. Exempt work still has to meet the Uniform Code.
The application is written, on a form from the Code Enforcement Officer, and signed by the owner or the owner's agent8. Work cannot start until the permit issues8. The application fee is paid to the Town Clerk, and the Town Board sets the fee; we could not find a current dollar schedule, so ask the Code Enforcement Officer for the amount9.
Who issues building permits in Niles, and how do you reach them?
The Town of Niles issues its own building permits through the Code Enforcement Officer, not through Cayuga County1. Cayuga County's own pages describe local governments, not the county, as the offices that administer the Uniform Code, and New York law gives counties no general zoning power10. The county planning office does not issue building permits11.
The Niles Code Enforcement office lists a direct line, an email address and posted office hours on the town's staff directory12. Hours are short, so call or email before you drive to Moravia. Inspections follow the permit: work must stay exposed until the officer inspects and accepts it, and the permit holder notifies the officer when each stage is ready13. A certificate of occupancy is required for permitted work and for a change of use14.
Does Niles have zoning, and what about lot size and setbacks?
We could not confirm whether the Town of Niles has a full zoning ordinance with districts, and we found no published district schedule. What the town does have is a Setbacks and Lot Area Law that applies to every new building. Ask the Code Enforcement Officer whether any district rules apply to your parcel.
No permit is issued for a new building unless the lot has at least 2 acres, except lots fronting Owasco Lake or Skaneateles Lake, which need 15,000 square feet2. Buildings must sit at least 75 feet from the centerline of any public or private right-of-way4. Side and rear setbacks are 25 feet, or 15 feet on lots with lake frontage4. Certain older nonconforming lots may still qualify for one single-family home if stated conditions are met2.
We did not find town rules on building height, lot coverage or accessory dwellings, so confirm them before you design.
How do septic permits work in the Town of Niles?
The Cayuga County Health Department, not the town, handles septic permits for every address in Niles3. Before a town permit under the setback and lot-area law issues, the applicant must certify compliance with the County Health Department's sewage-disposal regulations3. Construction of a new or modified system needs the Health Department's plan review and acceptance first5. Contact the Environmental Health Division15.
Buying an existing house adds a step: the Sanitary Code requires the septic system to be inspected and the tank pumped before a property transfer16. Soils matter too. In Cayuga County, about 19.9% of soils are rated not limited for a conventional drain field, so most lots need a site evaluation and some need an engineered system17.
Can you live in an RV, camper or tiny home in Niles?
Not permanently. The Town of Niles bars using any portable occupancy, including motor homes, travel trailers and campers, as a permanent residence6. The code defines permanent residence as living there more than 90 days in a 365-day period6. Tents and pop-up trailers fall in the same portable-occupancy category18. The practical reading is that an RV can work as short-term lodging while you build, but not as a home past that limit; confirm any longer stay with the Code Enforcement Officer.
Mobile homes are allowed with a permit: a mobile home cannot be placed on a lot without a permit, the town's setback and lot-area standards apply, and each home must be at least 900 square feet as manufactured7. We found no rule written for tiny homes, so ask the Code Enforcement Officer how one would be classified.
Building a home in Niles: the steps, in order
- Confirm the lot meets the minimum of 2 acres, or 15,000 square feet on Owasco or Skaneateles Lake frontage, and note the 75-foot road setback24.
- Call the Cayuga County Health Department about a site evaluation and plan review for the septic system5.
- Ask where your road is town, county or state maintained. A new driveway or extension needs a county Highway Department driveway permit, and none is approved until the local municipality approves the development19. A residence on a state highway needs a New York State Department of Transportation permit20.
- Apply in writing to the Code Enforcement Officer, with the fee paid to the Town Clerk89.
- Keep work exposed and call for each inspection13.
- Get the certificate of occupancy before moving in14.
What to check before you buy land in Niles
Splitting a parcel is regulated: the Niles Planning Board can approve final plats, so talk to it before dividing land for sale21. Subdivisions of 5 or more lots of 5 acres or smaller also need county approval before the map is filed with the County Clerk22.
Flood risk matters on lake and creek parcels. New York requires local floodplain development permits for private building in mapped flood hazard areas23. Niles's code lists a floodplain permit section, but we could not read its operative text, so ask the Code Enforcement Officer.
County-level numbers: Cayuga County's effective property tax rate is 2.3%24, and the median property tax bill is $3,747 a year25. The nearest city of 100,000 or more people is about 23 miles from the county center26.
Watch-outs
- Zoning is unconfirmed: we found a setback and lot-area law but no published zoning districts for Niles, so ask the Code Enforcement Officer before assuming nothing else applies4.
- The Town Board sets building permit fees and we found no current schedule, so get the amount from the Code Enforcement Officer or Town Clerk before budgeting9.
- Septic rules for Niles come from Cayuga County, and a sale triggers a required inspection and tank pumping16.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
