Zoning, building permits and septic rules in the Town of Ancram, New York

The Town of Ancram, in Columbia County, New York, runs its own zoning law and its own building department, which issues building permits and certificates of occupancy1. Septic permits for individual systems come from the Columbia County Department of Health, not the town2. Does Ancram, NY have zoning, and what does it mean for RVs and tiny homes?

Yes. The Town of Ancram adopted a revised zoning law on December 21, 2023, repealing its prior law1. The law names districts including AG (agriculture), the hamlet residential districts AH-R2, ADH-R2 and BCH-R2, a light industrial I-1 district, and a flood-concern overlay5. The town's building department page also mentions an August 2022 amendment, so confirm with the department which version controls your parcel1.

A tiny house in Ancram is a dwelling under 1,000 square feet on a foundation that meets the New York State Fire Prevention and Building Code, and it may be a free-standing accessory dwelling7. A tiny house on wheels is treated as a recreational vehicle, so the RV rules apply instead7. We could not confirm minimum lot sizes or principal-building setbacks by district; ask the building department before you buy.

Do you need a building permit in Ancram, and who issues it?

Yes. New York requires a building permit for work that must conform to the Uniform Code or Energy Code, and each local government enforces that requirement within its own boundaries4. In Ancram, the Town of Ancram building department issues building permits and certificates of occupancy and enforces the town's zoning10. Columbia County itself does not issue them; it directs residents to the municipality's code enforcement office11.

New York lets each local authority exempt small items, such as detached sheds up to 144 square feet, but we could not confirm whether Ancram uses that exemption12. Call the building department before starting any structure. The town also publishes a building department fee schedule, which was updated in 202313.

Who is the Ancram building department and how do you reach it?

The Town of Ancram building department handles building permits, certificates of occupancy and zoning enforcement10. The office phone, email and mailing address are listed with the building department's contact details on this page10. Office hours are posted on the town's building department page; confirm them before you visit.

For land outside Ancram town limits, Columbia County does not administer local ordinances either; the county's page says municipalities are responsible for building codes, zoning and land use enforcement11. The rest of Columbia County is covered on the Columbia County page.

How do septic permits work in Ancram?

Septic permits in Columbia County come from the Columbia County Department of Health, Environmental Health Division, at 325 Columbia St. Ste. 100, Hudson, NY 12534, phone 518-828-335814. We could not confirm a separate town septic permit in Ancram, so treat the county health department as your first call2.

The county requires engineered design plans prepared by a New York licensed professional engineer, following Appendix 75-A standards6. Applications are accepted only from April 1 through October 1, and the fees are $500 for a single lot plus a $700 engineer plan-review fee6. A county health representative schedules a site visit with the engineer, and the engineer certifies the finished system15. Plan the timing so your application lands inside that window.

Can you live in an RV or tiny home on your land in Ancram?

Partly, with limits. An RV used for temporary residential purposes for 15 days or less may be parked and used on a lot without a town permit, provided the setback and visibility conditions are met3. For 16 to 60 days, the Town of Ancram requires an RV use permit3. On a vacant lot, an RV may serve as temporary living quarters for no more than 60 days per year, and it may not sit in a required setback3.

The town may grant one additional 60-day extension, but only for housing needed after an emergency or disaster3. Living in an RV for the whole time you build is therefore not something Ancram's zoning law supports. Camps and campgrounds need a minimum lot of 25 acres and planning board approval16. A tiny house on a foundation is the town's route to a permanent small dwelling7.

Building a home in Ancram: the steps, in order

  1. Call the Town of Ancram building department to confirm your zoning district and which dimensional rules apply10.
  2. Book a septic site visit by applying to the Columbia County Department of Health between April 1 and October 1, with plans from a licensed engineer6.
  3. Apply to the town building department for a building permit4.
  4. Keep work exposed until inspected; the state requires inspections of specified construction elements17.
  5. Get a certificate of occupancy before you move in18.
  6. If your driveway meets a state highway, you will also need a permit from the NYS Department of Transportation19.

What to check before you buy land in Ancram

Check your parcel against the town's flood-concern overlay, which applies to areas mapped on the official town FIRM maps20. Soils matter too: only about 0.4% of Columbia County soils rate as not limited for a conventional septic drain field, so expect a site evaluation and often an engineered system21.

If you plan to split a lot, Ancram regulates subdivisions under its land subdivision regulations, Local Law #3 of 201722. If you plan to rent the home, short-term rentals need a special use permit approved by the planning board9. Columbia County's effective property tax rate is 1.5%23.

Watch-outs

  • We could not confirm Ancram's minimum lot sizes, principal-building setbacks, building height limits or owner-builder rules; ask the Town of Ancram building department before you buy10.
  • Ancram's zoning law was revised in December 2023, but the building department page also cites an August 2022 amendment, so confirm which version controls your parcel1.
  • Columbia County septic applications are accepted only from April 1 through October 1 and require an engineer's plans6.
  • These rules apply inside the Town of Ancram; for other Columbia County municipalities, see the Columbia County page11.
