Does the Town of Beekman have zoning, and what does it mean for lot size and setbacks?

Yes. The Town of Beekman, New York zones its own land under Chapter 155 of the Town Code, administered by the Town rather than by Dutchess County1. Dutchess County itself does not zone land, so the Town's code is the one that controls what you can build12.

Chapter 155 divides the town into districts including R-135, R-90, R-45, R-MH, PH, BH, HR, SC, TC, C-1, C-2, C-3, LC and PUD, plus overlay districts5. The residential numbers are minimum lot areas: R-135 requires 135,000 square feet, R-90 requires 90,000 and R-45 requires 45,00071314.

Schedule B sets the yards district by district. In R-135 the minimum front yard is 100 feet, the side yard 40 feet and the rear yard 60 feet15. In R-90 the minimums are 75, 30 and 40 feet16, and in R-45 they are 50, 20 and 35 feet17. Confirm which district a parcel is in on the Town's zoning map at Town Hall before relying on these numbers5.

How much of a Beekman lot can you cover, and how big must the house be?

Schedule B caps lot coverage by district. In R-135, buildings may cover 6% of the lot and all impervious surfaces including buildings 10%18. In R-90 the caps are 8% and 12%19, and in R-45 they are 10% and 15%20.

The same schedule sets a minimum of 1,000 square feet of interior living space for a dwelling in R-135, R-90 and R-458910. A small cabin or tiny home therefore does not fit as a primary dwelling in those districts on the Schedule B figure alone. Whether the Town allows a tiny home or accessory dwelling in any district is not something we could confirm, so ask the Building Department before buying2.

Do you need a building permit in the Town of Beekman, and who issues it?

Yes for a new home. The Town of Beekman Building Department states that permits are required for new residences such as single family dwellings and townhouses2. Dutchess County does not issue the building permit; the Town does, and the county health department only reviews the septic and well first21.

The department also issues permits for additions, decks, pools, barns, garages and sheds or structures over 120sqft2. New York's Uniform Code lets a town exempt small detached sheds, so a shed at or under the Town's threshold may not need a permit; the Town's own list is the one to follow4.

For a new single-family house, the Building Department asks for stamped engineered plans meeting the 2025 New York Residential Code, the septic location and a survey2. Applicants should meet the building inspector by appointment before paying any fee2. We could not confirm the Town's current fee schedule or an owner-builder exemption, so ask the department directly2.

How do septic permits work in the Town of Beekman?

Septic approval in Beekman comes from Dutchess County, not the Town. When you apply for a building permit, the Town has you complete the top of the DBCH SAN 34 form, and the building inspector sends it to the Dutchess County Department of Behavioral & Community Health21. The county health department checks for a valid approval, may require more soil tests, and schedules a pre-construction conference3.

If that inspection finds problems such as unanticipated soil conditions, the county will not recommend the building permit and further lot evaluations may be needed3. Getting a lot approved requires a New York State-licensed Professional Engineer22. After installation and before the system is covered, the installer must schedule an inspection6.

A private well also needs a county permit, applied for at least 15 days before the work11. We could not confirm whether the Town adds septic rules of its own, so ask the Building Department. Where a public sewer abuts the property, Chapter 126 requires a permit to connect to it23. USDA rates about 15% of Dutchess County soils as not limited for a conventional drain field, so many lots need a site evaluation or an engineered system24.

Can you live in an RV or tiny home in the Town of Beekman?

We could not confirm whether the Town of Beekman allows living in an RV, camper or tiny home on private land; we could not confirm the Town's use table. The Building Department does say that every property is allowed one unregistered vehicle, including boats and RVs, under Town Code § 155-40, and that a second unregistered vehicle can draw enforcement2. That is a rule about storing vehicles, not a permission to sleep in one.

New York's campground rules for state-run campgrounds do not answer the question for private land. Call the Building Department at the Town Hall main line before parking an RV on a lot to live in or starting a tiny home2. The R-MH district covers mobile home parks, and the Town's rules for a single manufactured home on a private lot were not confirmed5.

Building a home in the Town of Beekman: the steps, in order

  1. Find the parcel's zoning district on the Town's zoning map and check lot size, width and road frontage against Schedule B5.
  2. If you are splitting land, expect Town subdivision review under Chapter 13025 and county health review of water and sewage for realty subdivisions26.
  3. Hire a New York State-licensed Professional Engineer to get the lot approved for septic and a well22.
  4. Meet the building inspector by appointment, then apply for the building permit with stamped plans, the septic location and a survey2.
  5. The Town sends the SAN 34 form to the county, which holds a pre-construction conference before recommending the permit3.
  6. Build with inspections; New York requires them for permitted work27.
  7. Schedule the county septic inspection before the system is covered6.
  8. Obtain a certificate of occupancy before moving in28.

What stays with Dutchess County and the state, and what should you check before you buy?

The county's rules for unincorporated land are on the Dutchess County page; for Beekman, the county's part is septic, wells and subdivision water and sewer approvals311. Floodplain development permits are administered locally, and we could not confirm the Town's own flood rules, so ask the Building Department whether a parcel is in a flood hazard area29.

A driveway onto a state highway needs a New York State Department of Transportation permit; driveways onto local roads are handled differently, and we could not confirm the Town's own driveway rules30. County figures: Dutchess County's effective property tax rate is about 2%31 and its median property tax bill is about $7,226 a year32. About 82% of the county is wooded33.

Watch-outs

  • Beekman's zoning is the Town's own, so a county-level answer does not tell you what a parcel in the Town of Beekman allows12.
  • The Schedule B yard figures are read from a flattened table, so confirm them against the printed Schedule B at Town Hall before designing around a setback16.
  • RV living, tiny homes, accessory dwellings, permit fees and owner-builder rules in the Town of Beekman are unconfirmed; call the Building Department before you buy2.
  • A building permit will not be recommended by the county if the pre-construction septic inspection finds problems, so a lot with poor soils can stall a project3.
