Does the Town of Wilna have zoning, and what does it mean for lot size and setbacks?
Yes. The Town of Wilna has its own zoning law, Chapter 250, adopted by the Town Board1. Its use schedule lists Agricultural/Rural Residence (AR), Residential R-1 and R-2, Business B-1 and B-2, Industrial, a Manufactured Home Overlay and a Motor Vehicle Racing Business district5. Which one covers a parcel depends on the zoning map.
In the AR district, permitted uses need 40,000 square feet6, with 50-foot front and rear yards, 20-foot side yards10 and a 30-foot height limit11. In R-1, permitted uses need 25,000 square feet7, with the same yard depths12 and the same 30-foot height limit13. Lots on roads the zoning map designates as main arterials need an 80-foot front yard10. A flag lot can only be created through Planning Board site-plan review14.
Do you need a building permit in the Town of Wilna, and who issues it?
Yes. New York's Uniform Code requires building permits for work that must conform to it, with limited exemptions such as small detached sheds4. In the Town of Wilna, the permit comes from the town's Code Enforcement Officer, on a written application signed by the owner or an authorized agent2. Work cannot start until the permit is issued2.
Jefferson County runs code enforcement only for towns that opted out of enforcing the Uniform Code themselves15; Wilna handles building permits through its own officer2. Fees are set by Town Board resolution16. The Town of Wilna Codes Enforcement office lists hours of Monday and Friday, by appointment only17. Work must stay exposed until the officer inspects and accepts it18.
How do septic permits work in the Town of Wilna?
Wilna's town code requires every on-site sewage disposal system to meet New York State Public Health Law Appendix 75-A3. We could not confirm who issues the septic permit for a Wilna parcel or whether the town requires one itself. New York says approval may come from a city or county health department or the district office of the State Department of Health19, and alternative systems need plan approval from the State or county health official before construction20.
Start with Jefferson County Public Health Service – Environmental Health, which works with the State Department of Health district office in Watertown21. Jefferson County's soils matter too: USDA rates 0% of its soils as not limited for a conventional drain field22, so expect a site evaluation and possibly an engineered system. That figure is for the whole county, not Wilna alone.
Can you put a manufactured home, RV or tiny home on land in the Town of Wilna?
Manufactured homes are allowed in Wilna with conditions. An individual manufactured home is a permitted use in AR, none is allowed in the Manufactured Home Overlay District, and a home built 20 or more years ago is not allowed8.
We could not confirm Wilna's rules for living in an RV, temporary private camping, tiny homes or accessory dwellings. The town's use schedule did not settle them, so do not assume they are allowed. Ask the Code Enforcement Officer before buying17. New York's campground limits apply to state campgrounds, not to your own land23.
Building a home in the Town of Wilna: the steps, in order
- Find the parcel's zoning district on the town zoning map and check lot size and yards against the schedule5.
- Ask Jefferson County Environmental Health who approves septic for the parcel, and plan for Appendix 75-A standards321.
- If the driveway meets a town road, get approval from the Town Highway Superintendent9. A driveway onto a state highway needs a NYS Department of Transportation permit24.
- Apply to the town Code Enforcement Officer for the building permit2.
- Keep work exposed until inspected18.
- Get a certificate of occupancy or compliance before moving in25.
What stays with Jefferson County, and what to check before you buy in Wilna
Jefferson County does not zone land; zoning approvals come from the town, village or City of Watertown26. Land outside Wilna is covered on the Jefferson County page. Floodplain development in a mapped flood area needs a permit from the municipality with jurisdiction27; we could not find a Wilna floodplain ordinance, so ask the Code Enforcement Officer17.
Jefferson County's effective property tax rate is 1.6%28, and its typical home insurance premium is about $1,098 a year29.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
