Does Roslyn Estates, NY have zoning, and what does it mean for lot size and setbacks?
The Village of Roslyn Estates adopts and enforces its own zoning in Chapter 200 of the village code2. Nassau County does not zone for its villages; zoning is set village by village7.
In the R-18 Residence District, no building or structure may be built on a lot of less than 18,000 square feet or with less than 110 feet of frontage4. A new single-family dwelling in R-18 needs at least 1,700 square feet of livable area and a two-car garage5.
Setbacks in R-18 are a front yard of at least 40 feet, a rear yard of at least 45 feet, and side yards of at least 20 feet each, with the two side yards together at least 45 feet8. Buildings and structures together may cover no more than 25% of the lot9. Height is capped at 30 feet for a multistory building, 21 feet for a one-story building and 15 feet for an accessory structure10.
Can you live in an RV or a tiny home in Roslyn Estates?
We could not confirm any rule that allows an RV or a tiny home as a residence in Roslyn Estates. The R-18 district lists detached single-family dwellings and other listed uses, and a new single-family dwelling must have at least 1,700 square feet of livable area5. A tiny home would not meet that minimum. For an RV, ask the village's building inspector before you buy11.
Do you need a building permit in Roslyn Estates, and who issues it?
Yes. The village requires a building permit for any work that must conform to the applicable law, including construction, alteration and demolition111. Permit exemptions are narrow, such as playground equipment, awnings, finish work and like-for-like replacement1.
The village applies the New York State Uniform Fire Prevention and Building Code and Energy Code, together with its zoning chapter12. Inside the village, the village issues building permits, not Nassau County or the Town of Hempstead.
Applications are signed by the owner and include construction documents prepared by a registered architect or licensed engineer, and some applications are referred to the architectural review board13. We did not find an owner-builder exemption in the village code. Fees are set by resolution of the board of trustees14; we could not confirm the amounts, so ask the village for its current fee schedule.
How do septic permits work in Roslyn Estates?
In Nassau County, on-site sewage disposal systems are reviewed and permitted by the Nassau County Department of Health, Bureau of Environmental Engineering315. After approved construction is finished, a SPDES permit from the same department is required before sanitary waste is discharged into the ground16.
Where public sewers serve an area, facilities must connect to them15. The village code has a chapter on sewer districts that we could not confirm, so ask the village whether your lot is sewered before planning any septic system. Wells are also unconfirmed for the village.
