Does Middleport, NY have zoning, and what does it mean for RVs, lot size and setbacks?

Yes. The Village of Middleport has its own zoning chapter, adopted by the Board of Trustees2, and district boundaries are drawn on the village zoning map8. Zoning here is the village's job, not Niagara County's9.

In the R-1 One- and Two-Family Residential District, a lot must be at least 75 feet wide and 7,500 square feet5. Front yards are 35 feet from the street line, rear yards are 30 feet, one side yard is at least 6 feet, and both side yards together are at least 16 feet6. Buildings, including accessory buildings, may cover no more than 30% of the lot10, and height is capped at 35 feet11.

For RVs, Middleport allows one vehicle to be occupied for up to 72 hours by visitors of the occupant, in a residential district at a premises with a constructed residence4. Mobile homes and trailers are also barred from occupancy on private property outside that exception12. We could not confirm village rules for tiny homes, so ask the Code Enforcement Officer before planning one.

Do you need a building permit in Middleport, and who issues it?

Yes. Inside the Village of Middleport, a building permit is required for any work that must meet the state Uniform Code or Energy Code, including construction, enlargement, alteration, removal, relocation and demolition, plus solid-fuel heating appliances1. The village enforces the Uniform Code itself13, and the permit must be in hand before work starts1.

Applications are written, on a form the Code Enforcement Officer accepts, and signed by the owner or an authorized agent14. Plans need an engineer's or architect's seal15. Once work is under way it must stay exposed until the Code Enforcement Officer inspects it16, and a certificate of occupancy is required before a new or altered building is used7.

Reach the village's [Code Enforcement Officer](office:village-building) at 716-735-330315. We could not confirm the current fee schedule; the zoning chapter lists a $1 fee with the approved plot plan, and Chapter 97 separately requires the applicable building permit fee17.

How do septic permits work inside Middleport?

Septic permits for every address in the village come from Niagara County, not the village. The county Board of Health enforces the Sanitary Code of the Niagara County Health District inside Middleport18. Nobody may construct, install, connect, alter or extend a sewage disposal system there without written approval from the Public Health Director3.

For a new system on a vacant lot, a licensed New York professional engineer must prepare the plans19. County design plan review costs $29020. Niagara County's soil rating makes an engineered design likely: only 1.6% of the county's soils rate "not limited" for a conventional drain field21. Selling a home with an existing system triggers a dye test22.

Call the [Environmental Health Division](office:septic) at (716) 439-744423.

Can you live in an RV or tiny home in Middleport?

Not as a residence. Village code lets one RV be occupied for sleeping and living for no more than 72 hours, only by visitors of the person living in a house on that lot, in a residential district4. Canal boats get a separate two-day allowance4. Sleeping in an RV, tent or trailer on a street, alley, parking lot or other public place is prohibited24.

We could not confirm any village provision about tiny homes, so a tiny home would most likely be judged as a dwelling under the building permit and zoning rules above. Ask the Code Enforcement Officer before you buy.

Building a home in Middleport: the steps, in order

  1. Confirm your lot's zoning district and dimensions against the village zoning chapter8.
  2. Get septic approval from the Niagara County Health District before any sewage work3.
  3. File a written building permit application with the Code Enforcement Officer, signed by the owner or agent14.
  4. Start work only after the permit is issued1.
  5. Leave work exposed for inspection16.
  6. Get a certificate of occupancy before moving in7.

What stays with Niagara County, and what to check before you buy in Middleport?

Septic approval stays with Niagara County18. For land outside the village, see the Niagara County page, because village rules do not apply there.

Before buying, ask the village about floodplain rules; the village's Flood Damage Prevention chapter exists, but we could not confirm its permit terms. A driveway onto a state highway needs a state permit25. County property taxes run at an effective rate of 2.3%, with a median bill of $4,052 a year2627.

Watch-outs

  • Middleport has no confirmed owner-builder exemption, so plan on a permit even for work you do yourself; ask the Code Enforcement Officer1.
  • We could not confirm village rules on tiny homes, short-term rentals, private wells or subdivision; ask the village before you rely on any of them8.
  • The village is recruiting a part-time Code Enforcement Officer, so call ahead to confirm office hours15.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
