Does the Town of DeWitt, NY have zoning, and what does it mean for RVs, lot size and setbacks?

Yes. The Town Board adopted Chapter 192 of the Town Code, the zoning law, in 20072. Onondaga County itself does not zone: New York gives zoning power to cities, towns and villages, not counties8.

Living in a recreational vehicle is prohibited in every DeWitt district3. We could not confirm a rule on tiny homes or accessory dwellings, so ask the Planning and Zoning Department before you plan either9.

Dimensions depend on the district. In the Residential R-1 district the front yard is 50 feet, with an averaging exception that never goes below 35 feet; side yards total at least 32 feet with neither under 12 feet; and the rear yard is at least 40 feet10. A one-story single-family dwelling needs at least 960 square feet of living floor area6.

Do you need a building permit in the Town of DeWitt, and who issues it?

Yes. DeWitt requires a development permit for any work that must conform to the Uniform Code or the Energy Code, and work may not start until the permit is issued1. The town's own Planning and Zoning Department handles applications: its page says a permit is needed to upgrade, modify or install fixed or movable improvements, apart from minor repairs9.

The town enforces the New York State Uniform Fire Prevention and Building Code11. State rules let a town exempt small items such as a one-story detached storage shed of 144 square feet or less; whether DeWitt uses that exemption is set in its own code, so confirm with the office before skipping a permit12.

Fees are set by the Town Board7. Applications must be written on the town's form and describe the work, with construction documents13.

How do septic permits work inside the Town of DeWitt?

We could not confirm a DeWitt-specific septic rule or which office signs off on septic systems inside the town. Onondaga County states that its Health Department's Bureau of Public Health Engineering reviews individual sewage disposal systems, public sewers and realty subdivisions414.

The county's septic permit-to-construct application is listed only for the Skaneateles Lake and Otisco Lake watersheds15. New lots under 5 acres that cannot reach public sewer need county plan approval before subdivision approval15. Where a municipal sewer is available, a lateral connection needs a Capacity Assurance review first16.

Before buying, call the Bureau at the number above and ask whether the parcel is sewered. Building permits and septic review are separate offices in DeWitt.

Building a home in the Town of DeWitt: the steps, in order

  1. Call the Planning and Zoning Department to confirm the zoning district, setbacks and any site plan or subdivision step9.
  2. If you are dividing land, expect town review first and then county Health Department review of the filed map17.
  3. Settle sewer or septic with the county Health Department4. For town water, apply in writing to the Town Clerk; the Water Superintendent must approve before any connection to the street main18.
  4. Apply for the development permit with the form, survey and plans the office lists13.
  5. Keep work exposed until the Code Enforcement Officer or an authorized inspector accepts it19.
  6. Get a certificate of occupancy before using the building5.

What stays with Onondaga County, and what to check before you buy in DeWitt

The county's septic, sewer-connection and subdivision map reviews apply even though the town issues building permits and zoning417. For land outside the town, see the Onondaga County page.

Driveways: the town's permit page tells applicants to contact the Highway Department9, and a driveway onto a state highway needs an NYSDOT permit20.

We could not confirm DeWitt's floodplain permit rules, short-term rental rules, or any owner-builder exemption; ask the Planning and Zoning Department. Onondaga County's effective property tax rate is 2.6%21, and the nearest city of 100,000 or more is about 3 miles from the county center22.

Watch-outs
