Suffolk County, New York

Zoning, building permits and septic rules in the Village of Islandia, New York

The Village of Islandia, in Suffolk County, New York, requires a building permit for commercial and residential structures, and its own Building Department issues it1. The Village Board of Trustees adopted the zoning chapter, so zoning is a village matter, not a Suffolk County one2. Septic and wastewater approval comes from the Suffolk County Department of Health Services, Office of Wastewater Management3.

Do you need a building permit in the Village of Islandia, NY?

Yes. The Village of Islandia requires building permits for all commercial and residential building structures, including new structures, additions, alterations and accessory structures such as pools, patios, walls, gazebos, garages and decks9. Islandia adopted the New York State Uniform Fire Prevention and Building Code as its village code10. Most Islandia permits are valid for one year and must be renewed if a certificate of occupancy has not been issued1.

Inspections are required in every phase of construction, and the Building Department asks for at least 48 hours' notice to book one11. A certificate of occupancy or compliance is required for all open building permits12.

Who issues building permits in Islandia, and how do you reach them?

The Village of Islandia Building Department issues building permits, inspects work and issues certificates of occupancy; reach it at (631) 348-11339. Village Hall is at 1100 Old Nichols Road, Islandia, New York 117499. Suffolk County does not issue building permits for private homes inside the village. The county page covers land outside village limits: Suffolk County.

We could not find a published Islandia building permit fee schedule, so ask the Building Department for fees before you apply.

Does Islandia have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Islandia has its own zoning. The Village Board of Trustees adopted the zoning chapter2, and Suffolk County itself has no direct zoning power4. The village publishes residential districts L, M, MF and MF-18, plus an Agricultural District, with uses marked permitted, special-permit or not permitted13.

Dimensions depend on the district. In the Low-Density Residential District, which the Agricultural District shares, a single-family lot needs 20,000 square feet and a 100-foot plot width6. Required yards in that column are 40 feet in front, 18 feet on any one side (36 feet total) and 25 feet in back14. Height tops out at 2.5 stories and 35 feet7.

We could not confirm a tiny-home rule or a minimum dwelling size in Islandia's code; ask the Building Department before you plan one9.

How do septic permits work in Islandia?

Septic and wastewater approval inside Islandia comes from Suffolk County, not from the village3. If you are building a new home, a permit is required from the Suffolk County Department of Health Services' Office of Wastewater Management15. The Village's certificate-of-occupancy documents may include Suffolk County Board of Health final approval12.

Suffolk County allows individual sewerage systems only when parcel size, sewer-district status, soils and groundwater conditions are met16. For single-family projects outside sewer districts, the county health rule looks for parcels of at least 20,000 square feet, with exceptions17. Conventional drain fields rate poorly here: only about 1.2% of soils in Suffolk County rate as not limited for them18, so expect a site evaluation and possibly an advanced system. Sewer-district connections need their own approval19.

Can you live in an RV or tiny home on your land in Islandia?

Islandia's code allows a trailer, mobile home or recreational vehicle to stay on a residential parcel only in the case of disaster, for at most six months, with a permit from the Village Clerk and the appropriate fees5. The Village Board may approve an extension after a public hearing5.

That is the only RV-living rule we confirmed. We could not confirm a private-land camping rule or a tiny-home rule in the village, so call the Building Department before you park anything to live in9. Suffolk County's one-RV-per-site limit applies to county campgrounds, not private land20.

Building a home in Islandia: the steps, in order

  1. Confirm the zoning district and lot dimensions with the Village Building Department9.
  2. Check whether site-plan approval applies. One-family dwellings used exclusively as residences are exempt from the village's Chapter 140 site-plan approval21.
  3. Get Suffolk County wastewater approval for the water supply and sewage disposal before erecting a permanent building22.
  4. Apply for the village building permit; the application starts review by the proper departments1.
  5. Book inspections at each phase with 48 hours' notice11.
  6. Request the county septic inspection before use23.
  7. Obtain the certificate of occupancy or compliance12.

What stays with Suffolk County, and what to check before you buy in Islandia

Suffolk County handles septic and wastewater approval, private-well testing, and highway work permits on county roads. Any new or modified driveway access within a county right-of-way needs a Suffolk County Highway Work Permit24. Private-well testing costs $100 for existing approved wells and $350 for new construction25.

Flooding: Islandia has a flood-management chapter and bars certain work in flood- or erosion-prone areas before site-plan approval, but we could not confirm the permit trigger; ask the Building Department26. Subdividing land is regulated by the village27. Suffolk County's effective property tax rate is 1.9%28, and the typical home value is about $726,69229.

Watch-outs

  • We could not confirm a village owner-builder exemption, accessory apartment rule, short-term rental rule, or building permit fee schedule; ask the Village of Islandia Building Department at (631) 348-11339.
  • County statistics such as soils, tax rate and home value describe Suffolk County as a whole, not Islandia alone28.
  • A Suffolk County Highway Work Permit is separate from the village building permit and must be in place before the municipality can issue a building permit for property on a county road24.
