Zoning, building permits and septic rules in the Village of Port Jefferson, New York

The Village of Port Jefferson, New York requires a building permit for nearly all construction, and the village Building & Planning Department issues it1. Zoning is the village's own, under Chapter 250 of the Village Code, not Suffolk County's2. Septic and wastewater approvals come from the Suffolk County Department of Health Services, Office of Wastewater Management3.

Does Port Jefferson, NY have zoning, and what does it mean for lot size and setbacks?

Yes. The Village of Port Jefferson adopts and administers its own zoning under Chapter 250 of the Village Code, and the rules apply to land inside the incorporated village2. Suffolk County does not take that role: the county itself states that it lacks direct powers of zoning and general land-use control, so town and village zoning stays controlling4.

The village is divided into residential, office, commercial, waterfront, industrial, mixed-waterfront and arts districts, shown on the Village zoning map10. Minimum lot size, setbacks, lot coverage and building height are all set district by district in the code's bulk tables for residential structures78. We could not confirm the exact figures for any one district, so look up your parcel's district on the zoning map and ask the Building & Planning Department for that district's table before you plan a house or addition9.

Do you need a building permit in Port Jefferson, and who issues it?

Yes. Port Jefferson's code says no building in any district may be erected, constructed, enlarged, altered, improved, relocated, removed or demolished without a building permit issued on application to the Building Inspector1. The village enforces the New York State Uniform Fire Prevention and Building Code, so state construction standards apply to the work5.

The listed exemptions are narrow: fences under six feet, sheds no larger than 144 square feet, low decks, play houses and swing sets1. A parcel with an open ticket under the Village Code cannot get a permit until it is cleared, and projects that need site-plan or conditional-use approval must go through the Planning Board first1.

Once a permit is issued, the code requires written requests for a foundation inspection, a rough-enclosure and rough-mechanical inspection, and a final inspection before the building is occupied11.

Who is the Port Jefferson building department, and how do you reach them?

The Village of Port Jefferson Building & Planning Department is at 88 North Country Road, Port Jefferson, NY 11777, and its phone number is (631) 473-47449. This is the office for building permit applications, plans and inspections inside the village, not the Suffolk County government.

The village's permit application form lists a building permit fee of 0.5% of construction cost with a $200.00 minimum, and a $500.00 late filing fee for starting work without a permit9. That form is the version we could read, so confirm the current fee with the department. Most applications need three copies of a plot plan prepared by a licensed engineer or land surveyor, and a one-family detached dwelling needs two complete sets of architectural plans12.

A permit expires if work does not begin within nine months, or if work is not finished within 12 months on projects costing less than $1,000,00012.

How do septic permits work inside Port Jefferson?

Septic permits inside the village do not come from the village. Suffolk County's Department of Health Services, Office of Wastewater Management, requires a permit for a new home or business, and that applies inside Port Jefferson as it does anywhere in the county3. County sanitary code requires prior approval of water supply and sewage disposal before a permanent building is erected13. Call the office at (631) 852-580014.

The village adds its own layer. Where a municipal sewer is available, the village code requires waste to be connected to it; where none is, the Building Department must approve the disposal method6. An addition or renovation permit application must include proof that the existing system works, such as a recent county health permit or proof of connection to the Port Jefferson Sewer District15.

For a lot that is not in a sewer district, the county's Article 6 lot-size rules depend on the groundwater management zone: 20,000 square feet outside zones III, V and VI16, and at least 40,000 square feet inside them17. Ask the Office of Wastewater Management which zone a specific parcel is in.

Can you live in an RV or tiny home in Port Jefferson?

We could not confirm a published village rule for living in an RV, camping temporarily, building a tiny home or adding an accessory dwelling. Get the answer in writing from the village before you rely on any of them.

Suffolk County's RV rule is not an answer here: its limits on occupancy apply to county campground sites, not to private land18. Because the village runs its own zoning, the Building & Planning Department at (631) 473-4744 is the office to ask before you buy a lot for either use9.

Building a home in Port Jefferson: the steps, in order

  1. Find your parcel's zoning district on the Village zoning map and get the district's bulk table from the Building & Planning Department109.
  2. Confirm sewer or septic. In the sewer district, plan to connect6; otherwise start the Suffolk County wastewater approval with the Office of Wastewater Management13.
  3. If the project needs site-plan or conditional-use approval, go to the Planning Board before applying for the building permit1.
  4. Submit the building permit application with a plot plan and architectural plans12.
  5. Request the foundation, rough-enclosure and rough-mechanical inspections in writing as work reaches each stage11.
  6. Request the final inspection, then get a certificate of occupancy before moving in19.

What stays with Suffolk County, and what to check before you buy in Port Jefferson?

The village handles building permits and zoning; Suffolk County keeps septic and wastewater approval3, private-well testing, and any work in a county road right-of-way. A driveway or access change on a county road needs a County Highway Work Permit, and the village cannot issue its building permit until the county gives its approval20. For land outside the village, see the Suffolk County page.

County-level numbers matter too. Suffolk County's effective property tax rate is 1.9%21. Only about 1.2% of the county's soils rate as not limited for a conventional septic drain field, so expect a site evaluation and possibly an engineered system on any lot without sewer22.

We could not confirm the village's rules on floodplain development, private wells or short-term rentals; ask the Building & Planning Department about each9.

Watch-outs

  • An open ticket under the Village Code blocks a building permit for the property until it is resolved1.
  • Starting work without a building permit carries a $500.00 late filing fee on the village's application form, so confirm the current fee schedule before you start9.
  • The state owner-builder form BP-1 states it cannot be filed when a homeowner is building their own primary or secondary residence as new construction, and we could not confirm any village owner-builder exemption, so ask the Building & Planning Department23.
  • We could not confirm the exact lot-size, setback, coverage or height figures for any Port Jefferson zoning district; get the residential bulk table from the Building & Planning Department7.
