Suffolk County, New York

Zoning, building permits and septic rules in the Village of Sag Harbor, New York

The Village of Sag Harbor, New York requires a building permit from its Building Inspector before most construction, alteration or demolition1. The village, not Suffolk County, sets zoning inside village limits23. Septic and well approvals for Sag Harbor addresses come from the Suffolk County Department of Health Services4. Living in an RV or camping trailer on a residential lot is not allowed5.

Does Sag Harbor have zoning, and what does it mean for RVs, lot size and height?

Yes. The Village of Sag Harbor divides its land into zoning districts and overlay districts, and buildings and land must conform to the rules of the district they sit in2. Suffolk County has no direct zoning power, so the village code is the one that governs a lot inside village limits3. Rules differ by district. In the R-20 One-Family Residence District, a one-family detached home needs a lot of at least 20,000 square feet7, and buildings are capped at 35 feet and two stories8. A roof flatter than 6/12 pushes the residential height limit down to 25 feet8.

For RVs, the village allows one stored recreation vehicle or camping trailer of up to 25 feet per dwelling unit in residence districts, and it may not be used for living or sleeping while stored there5. The same sentence of the code covers mobile homes10. We could not confirm any village provision on tiny homes as dwellings; ask the Building Department before you plan one11.

Do you need a building permit in Sag Harbor, and who issues it?

Yes. Inside the Village of Sag Harbor, no one may start to erect, enlarge, alter, remove, improve, demolish or change the occupancy of a building without first getting a building permit from the Building Inspector, apart from ordinary non-structural repairs1. The village enforces the New York State Uniform Fire Prevention and Building Code12. Applications go to the Building Inspector on the village's forms, with an owner authorization affidavit if the applicant is not the owner13. Work in the Flood Hazard Overlay District must show extra elevation and floodproofing information on the plans14.

The Village Building Department is at 55 Main Street and answers at 631-725-022411. The village sets its fee schedule by resolution, and the fee in force on the filing date applies9. Ask the department for the current schedule.

How do septic permits work in Sag Harbor?

Building permits come from the village, but septic permits do not. Suffolk County requires a permit from the Department of Health Services' Office of Wastewater Management for a new home or business15, and the county's wastewater program covers every address in Suffolk County, village or not4. Approval to construct comes first, and an inspection must be requested after construction and before use16. Fees depend on the scope of the project and are invoiced after the application is accepted17.

We could not confirm whether Sag Harbor's own code adds a septic permit or inspection step on top of the county's, or whether sewer service is available at a particular lot. Call the Office of Wastewater Management at (631) 852-5800 and the village Building Department before you buy1811. Soils matter too: Suffolk County rates only about 1.2% of its soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system19.

Can you live in an RV or tiny home on your land in Sag Harbor?

Not on a residential lot. The Village of Sag Harbor bars living or sleeping in a stored recreation vehicle or camping trailer in its residence districts20. One RV or camping trailer of up to 25 feet may be stored per dwelling unit, subject to placement rules, but never lived in5. Mobile homes stored on a lot are covered by the same bar10.

County campground rules do not change this; they apply only to Suffolk County campground sites, not to private land21. Living in an RV while you build a house is therefore not something the village code provides for. We could not confirm any rule on tiny homes, so ask the village Building Department first11.

Building a home in Sag Harbor: the steps, in order

  1. Ask the Village Building Department which zoning district the lot is in and what its lot, height and setback rules are; the village publishes a zoning map112.
  2. Call the Suffolk County Office of Wastewater Management about sewage disposal and water supply approval, which comes before building2218.
  3. Apply to the Building Inspector for a building permit on the village's forms13.
  4. Schedule the required inspections as work proceeds, and keep failed work exposed until it passes23.
  5. Request the county septic inspection before use16.
  6. Get a certificate of occupancy before moving in; a newly built building may not be occupied without one6.

What stays with Suffolk County, and what to check before you buy in Sag Harbor?

Suffolk County handles septic and wells; the village handles building permits and zoning. A driveway or frontage that touches a county road also needs a county Highway Work Permit, and the village cannot issue the building permit until the county gives its approval24. Village residence districts also require every driveway to have a dry well or other approved drainage structure25. For land outside the village, see the Suffolk County page.

Costs run high: Suffolk County's effective property tax rate is about 1.9% and the median bill is about $10,001 a year2627. County typical home value is about $726,69228.

Watch-outs

  • We could not confirm whether the Village of Sag Harbor has an owner-builder exemption from its permit rules; ask the Building Department before acting as your own general contractor11.
  • We could not confirm village rules on private wells, subdivision of land, agricultural construction or short-term rentals; ask the Building Department and, for wells, the Suffolk County Department of Health Services1118.
  • A county Highway Work Permit is separate from the village building permit if the lot touches a county road24.
  • Parts of Sag Harbor may lie in the Flood Hazard Overlay District, which adds elevation requirements to the permit application14.
