Does the Town of Rockland, NY have zoning?
Yes. The Town of Rockland adopted its own zoning law, which regulates the use of land, buildings and structures by district across all land inside the town1. Sullivan County does not zone for its towns: New York gives zoning power to cities, towns and villages, not counties9. The town's districts are RC rural conservation, R1 low-density residential, R2 moderate to high-density residential, GB general business and NB neighborhood business, with downtown, aquifer protection and watershed protection overlays5. Any use not listed in the schedule of district regulations is prohibited, so check your district's use table before planning a second dwelling, a business or an RV on the lot5. Building height limits and other dimensional rules are set per district in the schedule of district regulations10. We could not confirm the town's rules on RV occupancy, accessory dwellings or minimum home size; ask the Code Enforcement Officer4. Farm harvesting, grazing, tilling and crop rotation are exempt from zoning permits11.
Do you need a building permit in the Town of Rockland, and who issues it?
Yes. Construction, alteration or change of use in the Town of Rockland needs approval from the code enforcement officer before work starts2. The town's Code Enforcement Officer also serves as building inspector, zoning officer and flood administrator4. The town's page lists a one- or two-family dwelling as a project that needs a building permit4. Exempt from the zoning permit are patios, fences, landscape improvements and unoccupied portable storage structures under 100 sq ft, but decks need permits2. Statewide, a local authority may exempt a one-story detached shed or playhouse up to 144 square feet, and exempt work must still meet the code12. A certificate of occupancy is required before you use or occupy a building6. Special uses and site plan review also need Planning Board approval, and variances go to the Zoning Board of Appeals13.
How do septic permits work in the Town of Rockland?
The town's zoning and building offices do not appear to be the septic authority. In New York, plans for wastewater systems are approved by a NYS Department of Health district office, a county health department or in some cases a city health department3. We could not confirm which of these handles a Rockland parcel, so call the Sullivan County Public Health Department front desk and ask who reviews onsite wastewater plans for your address14. A system serving a home must meet the state's Appendix 75-A standards, and an alternative system needs plan approval from the State or county health official before construction15. Parcels in the New York City watershed portion of Sullivan County also need NYC DEP review16. Soil matters too: only about 0.6% of Sullivan County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system17.
Building a home in the Town of Rockland: the steps, in order
- Confirm your parcel's zoning district and that your use is listed, using the town zoning law and the Code Enforcement Officer54.
- Check floodplain status; local floodplain development permits apply in mapped flood hazard areas, and the town's Code Enforcement Officer is its flood administrator184.
- Get health department approval for wastewater through the county health office14.
- Apply for the building permit from the code enforcement officer; special uses and site plan review also need Planning Board approval213.
- Have required inspections done as work proceeds, keeping work exposed until accepted19.
- Obtain the certificate of occupancy before moving in6.
What stays with Sullivan County and the state, and what to check before you buy
Septic approval, plan review for subdivisions and state highway driveways sit outside the town's building office. Dividing land into lots can trigger state realty subdivision law once a fifth residential lot is offered within three years20. A driveway onto a state highway needs a NYSDOT permit8. Driveways onto county roads go through the Sullivan County Division of Public Works21. For land outside the town, see the Sullivan County page. Sullivan County's effective property tax rate is 2.2%22.
Watch-outs
- The zoning law we reviewed is the town's 2016 website version, and a later review document exists, so ask the Code Enforcement Officer for the current text before relying on a district rule1.
- We could not confirm Rockland's building code chapter, permit fees, owner-builder rules or driveway rules; the town's Code Enforcement Officer is the office to ask4.
- A building permit in Rockland does not replace health department wastewater approval or a NYSDOT driveway permit on a state highway38.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
