Yates County, New York

Zoning, building permits and septic rules in the Town of Italy, New York

The Town of Italy, New York (Yates County) requires a building permit for any work covered by the state Uniform Code, new homes included, and issues it through its own Code Enforcement Officer1. The town has its own zoning law, Chapter 3502; Yates County does not zone3. Septic systems must meet state Appendix 75-A standards, and the state Department of Health Geneva District Office is the lead septic agency45.

Do you need a building permit in the Town of Italy, NY?

Yes. The Town of Italy requires a building permit for any work that must conform to the state Uniform Code or Energy Code, including building, enlarging, altering or removing a structure1. The one-story detached shed exemption stops at 144 square feet, and exempt work must still meet the code1.

A new home also needs a certificate of occupancy before anyone moves in; the Code Enforcement Officer inspects first8. Work must stay exposed until the inspector signs off, and an inspection fee is due at each inspection10.

The Town Board sets building-permit fees by resolution, and we could not find a dollar schedule, so ask the Town Hall for the current fees11. We also could not confirm any owner-builder exemption in the town code, so plan on the permit even if you build the house yourself.

Who issues building permits in the Town of Italy, and how do you reach them?

The Town of Italy issues its own building permits through its Code Enforcement Officer, and applications go on a form the officer provides, signed by the owner or the owner's agent12. Work cannot begin until the permit is issued12.

Town Hall is at 6060 Italy Valley Rd., Naples, NY 14512, phone (585) 374-50359. The Town's Code Enforcement page is the place to look for forms and notices. Yates County has no building department that replaces the Town's office; the county planning office only reviews referrals, and the towns make the final decisions13.

Does the Town of Italy have zoning, and what does it mean for RVs, tiny homes and lot size?

Yes. The Town of Italy adopted its own zoning law, Chapter 350, and divides the town into districts214. Yates County cannot zone, because New York gives zoning power to cities, towns and villages and not to counties315.

In the Agricultural-Residential (AR) district, manufactured homes are a permitted use7. For lots created by subdivision in AR, the minimum is the greater of three acres or whatever the Yates County Health Department and state health rules require6. Impervious surfaces may cover no more than 20% of an AR lot16, and nonagricultural buildings are capped at 35 feet17.

We could not confirm the town's rules on long-term RV living, temporary camping, tiny homes, accessory dwellings or short-term rentals. Ask the Code Enforcement Officer before you buy land for any of those uses. Subdivisions follow the Yates County subdivision regulations18.

How do septic permits work inside the Town of Italy?

The Town of Italy requires every new structure to meet the state's on-site wastewater rules, including Appendix 75-A of the Public Health Law4. The town code does not state its own septic permit or say who issues it, so we could not confirm the procedure there.

The lead septic agency for Yates County is the New York State Department of Health, Geneva District Office5. Statewide, plans for an alternative system must be approved by the State or county health official before construction19. The Geneva office is at 624 Pre Emption Road, Geneva, phone (315) 789-303020.

Soil matters here. Only about 12% of Yates County soils rate as not limited for a conventional drain field, so many lots need a site evaluation or an engineered system21.

Can you live in an RV or tiny home on land in the Town of Italy?

We could not confirm it. The town's zoning provisions we reviewed identify campgrounds but give no rule for living in an RV on private land, and no tiny-home rule turned up either. No rule found does not mean no rule: the town's zoning law applies, so call the Code Enforcement Officer at (585) 374-5035 before parking an RV or placing a tiny home9.

A manufactured home is a different case. It is a permitted use in the AR district, and it still needs a building permit and certificate of occupancy78. State rules also require a certified installer on site during installation, and an owner-occupant may apply for that certification22.

Building a home in the Town of Italy: the steps, in order

  • Call the Town Code Enforcement Officer through Town Hall and confirm the zoning district and whether your use is allowed9.
  • If you are dividing land, check the Yates County subdivision regulations first18.
  • Ask the NYS Department of Health Geneva District Office about the septic design for the lot5.
  • Apply for the building permit on the Town's form with construction documents12.
  • If the driveway meets a county road, get approval from the Yates County Highway Department first23. On a state highway, a NYS Department of Transportation permit is required24.
  • Keep the work exposed until each inspection is done10.
  • Get the certificate of occupancy before moving in8.

What stays with Yates County, and what to check before you buy in Italy?

Yates County does not set zoning for the town3. Its Planning Board reviews referrals for countywide impact, and the county subdivision regulations control subdivisions in the town1318. For land outside the town, see the Yates County page.

Before buying, check flood mapping: private development in a mapped flood hazard area needs a local floodplain permit25. We could not confirm the town's operative floodplain text, well rules or any water or sewer connection rule.

Yates County's effective property tax rate is 1.9%26, and the median bill is $3,417 a year27. The nearest city of 100,000 or more is about 46 miles from the county center28.

Watch-outs

  • Never assume a rule is absent because we could not find it: RV living, tiny homes, accessory dwellings, wells and owner-builder exemptions in the Town of Italy are unconfirmed, so ask the Code Enforcement Officer at Town Hall9.
  • Zoning district rules differ; the lot size, coverage and height figures here are for the Agricultural-Residential district only6.
  • The town code does not state a septic permit procedure, so confirm with the NYS Department of Health Geneva District Office before you design or buy5.
