Building permits, zoning and septic rules in Eastlake, Ohio

Eastlake, Ohio requires a building permit before a building or structure is erected, altered, enlarged or moved inside city limits1. The city has its own zoning code2 and its own Building Department3. Septic permits are a separate approval, and Eastlake's code does not name who issues them4; the Lake County General Health District runs Lake County's septic program5.

Do you need a building permit in Eastlake, Ohio?

Yes. Inside Eastlake city limits, no excavation may start and no building or structure may be erected, altered, enlarged or moved until a permit is issued, and the application must comply with the Zoning Code1. The Eastlake Building Department says permits are required for all new work, including electrical and plumbing alterations and remodeling3. Eastlake has adopted the Residential Code of Ohio for one-, two- and three-family dwellings6. Depending on the project, the permit process can also involve development-plan approval, Architectural Board review, conditional-use approval or a variance9. We could not confirm an owner-builder exemption inside Eastlake; ask the Building Department before assuming you can pull permits yourself3.

Who issues building permits in Eastlake, and how do you reach them?

Eastlake's own Building and Property Maintenance Department handles building permits inside the city, at 35150 Lakeshore Boulevard, and its number is 440-951-22003. The department asks you to call 24 hours in advance to request an inspection10. A new or altered building cannot be occupied until the Chief Building Official issues a certificate of occupancy, and a new-building certificate is applied for along with the building permit11. Eastlake publishes permit and inspection fees in Chapter 1301 of its code, and we did not extract the dollar amounts, so ask the department for the current figures12. Land outside the city is a different case: see the Lake County page for unincorporated Lake County.

Does Eastlake have zoning, and what does it mean for homes and lot rules?

Yes. Eastlake divides the city into zoning districts under its Planning and Zoning Code2, including S-5, R-60, R-75, business and industrial districts13. Rules differ by district. In the Suburban "5" (S-5) district, a home needs at least 1,250 square feet of livable first floor area7, with a front yard of at least 50 feet, side yards of at least 25 feet and a rear yard of at least 50 feet14. In the One-Family "60" (R-60) district, the first floor must be at least 950 square feet with a basement or 1,100 square feet on a slab15. Both districts cap height at 2.5 stories and 35 feet1617. Short-term rentals are prohibited in every residential district8. Accessory dwellings, RVs and tiny homes: we could not confirm a rule, so ask the Building Department.

How do septic permits work inside Eastlake?

Eastlake's code says no building permit or moving permit is issued until the owner has obtained a septic tank permit from the proper authority4. The exception is a dwelling on a street with an installed sewer, where the City Engineer advises that the sewer will connect to the sewage disposal plant; in that case no certificate of occupancy issues until the connection is made18. The code does not name the proper authority, and we could not confirm which office applies inside the city. Lake County's septic program is run by the Lake County General Health District, which reviews and regulates new, replacement and altered systems19. Call the health district before you buy a lot without a sewer. Private wells in Lake County fall under the same district, which warns that groundwater is limited and that much of the county sits on shale bedrock20.

Can you live in an RV or tiny home in Eastlake?

We could not confirm an Eastlake rule on living in an RV, on temporary camping or on tiny homes. The city's residential zoning use and building chapters showed no operative provision on these topics, which is not the same as permission. Because Eastlake zones the whole city, ask the Building and Property Maintenance Department at 440-951-2200 before you park or place anything you plan to sleep in3. A minimum first floor area applies to homes in the S-5 district, so a very small dwelling may not qualify there7.

Building a home in Eastlake: the steps, in order

  1. Call the Building Department to confirm your lot's zoning district and any development-plan or variance steps3.
  2. Settle sewer or septic: confirm with the City Engineer whether a sewer will connect, and otherwise get a septic tank permit before the building permit4.
  3. If the lot is in or touches a special flood hazard area, get a floodplain development permit from the Floodplain Administrator before any development begins21.
  4. Apply for the building permit1.
  5. Schedule each inspection 24 hours ahead10.
  6. Obtain the certificate of occupancy before anyone moves in11.

What stays with Lake County, and what to check before you buy?

Septic and wells run through the Lake County General Health District19. Lake County's own building department notes that local municipal rules still apply on top of county requirements, so city and county steps are separate22. Lake County's typical property tax rate is 1.7%23, and its median property tax bill is $3,405 a year24. Floodplain rules inside the city come from Eastlake itself: development in a special flood hazard area needs a floodplain development permit, and maintenance work valued below $2,500 is exempt from filing21.

Watch-outs

  • Eastlake's code requires a septic tank permit from the "proper authority" without naming it, so confirm the office with the Lake County General Health District before you buy a lot without sewer4.
  • Short-term rentals are prohibited in all Eastlake residential districts, with an additional fine of $100 per day of violation8.
  • A floodplain development permit is required before any development in a special flood hazard area, and the permit expires if work does not start within 180 days21.
  • Dimension and size rules differ by district, so confirm your lot's district before relying on the S-5 or R-60 figures13.

Unanswered questions are usually a sign that Eastlake publishes no rule on the point, not that none exists. Lake County’s page lists the county offices to call.
