Does Albany, Oregon have zoning, and what does it mean for lot size and setbacks?
Yes. The City of Albany adopts and administers its own Development Code for land inside city limits1. The residential districts are RR, R-10, R-6.5, R-5, RM, RMA, HDR and HM, and overlay districts for the airport approach, floodplain, hillside, wetlands, riparian areas, historic sites and more apply on top of the base zone91.
Dimensional rules depend on the district. The RR (Residential Reserve) district has a five-acre minimum lot size and can be applied on an interim basis until urban services arrive6. In R-6.5, the main single-family district, the average standard lot size for single-dwelling units and duplexes is 6,500 square feet10. Low-density districts cap building height at 30 ft11, and the front setback is 15 ft in RR, 12 ft in R-10 and 10 ft in R-6.512. Albany's city rules do not apply to unincorporated land outside the city; see Linn County for that.
Do you need a building permit in Albany, and who issues it?
Oregon requires a building permit to construct, enlarge, alter, repair or move a residential building4. Inside Albany, the City of Albany's Community Development Department takes the applications: building, plumbing, electrical and mechanical permit applications are available at the city's ePermitting site2. Work that is exempt from a building permit can still need mechanical, electrical or plumbing permits4.
A detached accessory structure under 200 square feet that is nonhabitable, one-story and under 15 feet is exempt from the state permit requirement, and a deck more than 30 inches above grade needs one4. The city's detailed permit exemptions, fees and inspection steps for Albany were not confirmed for this guide; call the Building office at 541-917-75502. Linn County Planning & Building handles building permits only for unincorporated land, not inside Albany13.
Can you build an accessory dwelling or tiny home in Albany?
Albany allows one accessory dwelling unit on a lot with a legally established single-dwelling unit, in residential districts where single-dwelling units are permitted outright, and a building permit is required5. A detached ADU is capped at 900 square feet and 24 ft to the ridge, with side and rear setbacks of 5 ft for one story or 8 ft for two5. State law also requires cities over 2,500 people to allow at least one ADU per detached single-unit dwelling inside the urban growth boundary14.
Whether a stand-alone tiny home or a manufactured home on an individual lot is allowed in each Albany district was not confirmed; ask the Planning office at 541-917-755015.
How do septic permits work in Albany, Oregon?
Septic site approvals, plan reviews, permits and inspections in Linn County are handled by Linn County Environmental Health3. That office covers new systems and changes in use of existing systems16. Albany's Residential Reserve district is the one most likely to rely on septic, since it is applied on an interim basis until urban services become available6.
We could not confirm Albany-specific septic rules, including when a lot inside the city must connect to sewer. If a composting toilet is planned, Oregon DEQ notes that a building within a sewer district still needs a sewer connection17. Start with Linn County Environmental Health18 and the city's Building office2.
Can you live in an RV inside Albany city limits?
We could not confirm Albany's rule for living in an RV on a private residential lot. Oregon law bars local governments from prohibiting RV occupancy only in narrow cases: an RV in a manufactured dwelling, mobile home or RV park with water, power and sewage connections, or on a lot with a dwelling made uninhabitable by a natural disaster8. State and local governments may add other special conditions8. For a lot you own, confirm with Albany Planning at 541-917-7550 before parking an RV to live in15.
Building a home in Albany: the steps, in order
- Confirm the zoning district and its lot size, setbacks and height with the city's Planning office1215.
- Check overlays such as floodplain, hillside or wetlands, which apply on top of the base zone1.
- Settle sewer or septic: ask Linn County Environmental Health about septic, and the city about sewer connection18.
- If the land will have a well, Oregon requires a landowner permit, a $10,000 bond or letter of credit and a $550 fee before work begins19.
- Apply for building, plumbing, electrical and mechanical permits through Albany's ePermitting site2.
- Schedule the required inspections; work may not proceed past an inspection point without approval20.
- Obtain a certificate of occupancy before moving into a new dwelling21.
What stays with Linn County, and what to check before you buy in Albany
Land outside Albany city limits falls under Linn County. Linn County zoning applies to unincorporated land, and property inside an urban growth area but outside city limits keeps county zoning until it is annexed22. Septic stays with Linn County Environmental Health18.
Owner-builders can use Oregon's exemption from structural-code rules on ceiling heights and room sizes, but a building permit is still issued, and an owner who does not use the exemption again for five years can reuse it7. Linn County's typical home value is $414,30123 and its effective property tax rate is 0.9%24; those are county-level figures, not Albany's.
Watch-outs
- Albany's own rules apply only inside city limits; land just outside is under Linn County zoning until annexed22.
- Septic permits come from Linn County Environmental Health, not the City of Albany's building office, and we could not confirm how septic works for lots inside the city3.
- Albany's building permit exemptions, fee schedule, RV rules and tiny-home rules were not confirmed here; call Community Development at 541-917-75502.
- Residential districts have different setbacks and lot coverage, so check the exact district before drawing a site plan12.
