Zoning, building permits and septic rules in Nyssa, Oregon

Living in an RV inside the city is limited to 14 days in a 365-day period3. Does Nyssa, Oregon have zoning?

Yes. Land inside Nyssa city limits is governed by the City of Nyssa Development Code, not by Malheur County zoning1. The city's use table has residential districts R-1 through R-5, plus commercial, industrial and public facilities districts5.

Residential lot sizes depend on the district. In R-1 through R-4, a corner lot for a detached single-family home needs at least 5,000 square feet, and R-5 sets a minimum of 1 acre7. The standard front setback is 10 feet in R-1 through R-410. Single-family lots in those districts can be covered up to 50 percent11, and building height tops out at 35 feet in R-1, R-2 and R-5, and 45 feet in R-3 and R-412. Accessory dwellings go through a Type II review, one per legal lot, up to 600 square feet, on lots of at least 6,000 square feet6.

We could not confirm a Nyssa rule for tiny homes or a general minimum dwelling size, so ask City Hall before planning either.

Do you need a building permit in Nyssa, and who issues it?

Inside Nyssa, a structure over 6 feet high in a residential zone requires a building permit2. That threshold does not describe the whole residential permit program, and we could not confirm every permit a new house triggers inside city limits.

The city posts an "Approval to obtain a building permit" form on its records and forms page13. The Malheur County Building Department describes its service area as all of Malheur County except the City of Ontario14, so call both City Hall and the Building Department to learn which office issues the permit for your Nyssa address.

If the lot touches a mapped flood hazard area, Nyssa also requires a floodplain development permit before any construction, including manufactured dwellings and fill9.

How do septic permits work inside Nyssa?

We could not confirm who issues septic permits for land inside Nyssa city limits, or whether the city requires new homes to connect to sewer15. Oregon requires a permit for facilities that use septic systems for domestic wastewater8, and Malheur County Environmental Health is the office responsible for the county's onsite program416. Call it before buying a lot that may not have sewer.

If you will hook up to city sewer, Nyssa requires a sewer connection permit from the city with an application and a fee set by city council resolution; the amount was not stated in the code section we read17. The connection must be inspected and given final approval by the city, and the building sewer must pass a 30-minute hydrostatic test before it is connected15.

Can you live in an RV or tiny home in Nyssa?

Not for long. Outside an established RV park, Nyssa and its urban growth boundary allow an RV or travel trailer as a place to live for up to 14 days within a 365-day period, and only with the property owner's express permission and no payment to the owner3. Tents cannot be used as a dwelling outside an RV park, and the 14-day exception does not name them18.

The longer county allowances for vacant rural land apply to unincorporated Malheur County, not to land inside Nyssa. We could not confirm a tiny-home occupancy rule for Nyssa, so ask City Hall at 541-372-226413.

How do you build a home in Nyssa, step by step?

  1. Confirm the lot's zoning district and its lot-size, setback and height limits with City Hall513.
  2. Check whether the lot is in a flood hazard area, which adds a floodplain development permit9.
  3. Ask City Hall and the Malheur County Building Department which office issues your building permit14.
  4. Settle sewer or septic: a city sewer connection permit17, or ask Malheur County Environmental Health about a septic permit16.
  5. Apply for any variance, conditional use or partition the plan needs; the city posts those applications on its records and forms page13.

What stays with Malheur County, and what to check before you buy in Nyssa?

Septic permits and the county health program sit with Malheur County Environmental Health in Vale16. Wells follow Oregon rules: a landowner who drills a water-supply well must get a permit and post a $10,000 bond or letter of credit unless a licensed, bonded constructor does the work19. A groundwater application is needed to use well water, though domestic use up to 15,000 gallons per day is exempt from water-right permitting19.

Land outside the city limits follows the county's rules instead; see the Malheur County page. Malheur County's effective property tax rate is 0.8 percent, with a median bill of $1,799 a year2021.

Watch-outs

  • We could not confirm who issues septic permits inside Nyssa city limits; call Malheur County Environmental Health at (541) 473-5186 before relying on a sewer hookup16.
  • The city's 6-foot building permit threshold is only part of the permit picture, so ask City Hall and the Malheur County Building Department what your project needs2.
  • The 14-day RV limit covers Nyssa's urban growth boundary as well as the city limits3.
