Does Joseph, Oregon have zoning, and what does it mean for lot size, home size and height?
Yes. The City of Joseph's zoning chapter lists R-1 Select Residential, R-2 General Residential, Commercial and Industrial zones1. Wallowa County's own land-development ordinance covers only the unincorporated area, so county zone rules do not apply to a lot inside Joseph11.
In the R-1 zone, the minimum lot area is 5,850 square feet and the minimum lot width at the front building line is 50 feet5. A single-family dwelling in R-1 needs at least 1,000 square feet of living space4, and buildings may not exceed 25 feet, measured from the base of the foundation7. In the R-2 zone the minimum lot area is also 5,850 square feet, rising by 1,000 square feet for each dwelling unit over two6, and the height limit is 25 feet8.
A manufactured home outside a manufactured-home subdivision in R-1 must be multi-sectional with at least 1,000 square feet of floor area, and it must sit on a perimeter-enclosed foundation no more than 12 inches above grade12.
Do you need a building permit in Joseph, and who issues it?
Yes. The Wallowa County Building Codes Department issues structural, electrical, plumbing and mechanical permits for the City of Joseph and the surrounding county, and applications go in at the Wallowa County Courthouse in Enterprise, by email or through Oregon's ePermitting system13. Joseph does not run a separate building department that we could confirm2. The county notes that additional fees adopted by a municipality may apply, so ask the City of Joseph what it adds2.
Fees are published by the county: the structural minimum permit fee is $60, plan review is 65% of the structural permit fee when it applies, and a 12% state surcharge and 3% technology fee are added14.
Zoning review comes first where the city's Planning Official requires it: it happens before building permits, occupancy permits or business licenses are issued, and it does not cover building, fire or life-safety compliance15. Before anyone moves into a new house, the building official issues a certificate of occupancy16.
How do septic permits work in Joseph, Oregon?
Septic permits for Wallowa County come from Harney County Environmental Health, which took over the work on June 1, 2025 and handles applications, records, consultations, fees, inspections and permit issuance17. Harney County lists several routes, including a site evaluation, a septic construction permit, an authorization to connect and a repair18.
A Land Use Compatibility Statement is required for every septic construction permit and authorization to connect. For new construction or repairs inside city limits or an Urban Growth Boundary, the Land Use Compatibility Statement and a Sewer Availability Form must also be signed, a requirement effective January 1, 202618. In Joseph, the Land Use Compatibility Statement is a land-use sign-off, so expect to involve the city.
Whether a particular lot in Joseph can connect to city sewer, or must use a septic system, is something we could not confirm; ask the City of Joseph. Oregon requires a building inside a sewer district to connect to the sewer, even with a composting toilet19. Across Wallowa County, only about 1.8% of soils rate as not limited for a conventional drain field, so a lot that needs septic may need a site evaluation or an engineered system20.
Can you live in an RV or tiny home in Joseph?
Joseph's R-1 Select Residential zone allows temporary RVs only9. The owner must get a zoning permit for 90 days before installing the RV, with a maximum of 180 days per year9. An RV that is not self-contained must be connected to the city's sewer and water system before the permit is issued, at the owner's expense, and only one RV is allowed per city lot or in addition to an existing single-family dwelling9. Storing an RV that nobody occupies is not a use under the code9.
The RV rule above is written for the R-1 zone9. We could not confirm the rule for RVs in other zones, for camping or for tiny homes in Joseph, so ask the City of Joseph before buying a lot for any of them. Short-term rentals of dwellings in R-1 and R-2 need a vacation-home-rental permit or conditional use permit unless a listed exception applies21.
Building a home in Joseph: the steps, in order
- Confirm the lot's zone with the City of Joseph, and check lot size, width, height and minimum home size against the zone's standards1.
- Ask the city whether the lot has city sewer or needs septic, and whether the lot sits in a mapped flood area22.
- If septic is needed, apply to Harney County Environmental Health with the Land Use Compatibility Statement signed by the city18.
- Complete the city's zoning review if the Planning Official requires it15.
- Apply for building permits with the Wallowa County Building Codes Department13.
- Get the inspections, then a certificate of occupancy before moving in16.
Owner-builders get a narrow break: Oregon exempts owner-built dwellings from structural-code rules on ceiling heights, room sizes and temperature levels, but a building permit is still issued10.
What stays with Wallowa County, and what to check before you buy in Joseph
Wallowa County's land-development ordinance covers only the unincorporated area, so county zoning rules for rural parcels, such as its five-acre minimum in the Rural Residential zone, do not apply inside Joseph1123. For land outside the city, use the Wallowa County page.
Within Joseph, building permits and septic permits stay with the county and Harney County offices described above1317. Construction in a mapped special flood hazard area needs a development permit from the city before work begins22.
Water: Oregon requires a landowner who builds a water-supply well to get a permit and a $10,000 bond unless a licensed and bonded well constructor does the work24. Whether a Joseph lot is on city water or may have a private well is unconfirmed; ask the city.
Taxes are a county figure: Wallowa County's effective property tax rate is about 0.6% and the median bill is about $2,173 a year2526.
Watch-outs
- Inside Joseph city limits, the Wallowa County Planning Department is not the administering authority for zoning; the city is27.
- We could not confirm which building code ordinance the City of Joseph itself adopts, how inspections are handled inside the city, or whether the city allows accessory dwellings or tiny homes; call the City of Joseph at (541) 432-3832 before buying28.
- Septic permitting for Wallowa County moved to Harney County Environmental Health on June 1, 2025, so older references to a local septic office may be out of date3.
- The Land Use Compatibility Statement and Sewer Availability Form must both be signed for new construction or repairs inside city limits, effective January 1, 202618.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
