Jamestown, Rhode Island requires building permits for building projects inside town limits, and the Town Building Department issues them and enforces the town zoning ordinance12. Septic permits do not come from the town: the state Department of Environmental Management (DEM) runs that program3. Rhode Island has no unincorporated land, so the town's rules reach every parcel in Jamestown, Newport County4.

Do you need a building permit in Jamestown, RI?
Yes. Jamestown requires a building permit for building projects inside town limits, and the Town Building Department takes applicants through zoning, permitting and plan review17. The permit rule comes from the state: Rhode Island law makes it unlawful to construct, enlarge, alter or demolish a building without first filing a written application with the building official10. Ordinary repairs that do not involve a code violation are exempt, and so are a few minor items for one- and two-family homes, such as a one-story detached accessory structure of 64 square feet or less10.
Jamestown inspects every permitted project, and the Town calls these inspections mandatory5. Under state law the building official has 48 hours, weekends and holidays excluded, to make an inspection after you request it11. A new building also needs a certificate of use and occupancy before anyone moves in12.
Who issues building permits and zoning approval in Jamestown?
The Town of Jamestown does, through its Building & Code Enforcement Office. That office implements the Rhode Island Building Codes and the Minimum Housing Code and enforces the Town Zoning Ordinances27. Newport County has no zoning or building-permit role of its own: Rhode Island has no county governmental structure, and the zoning enabling statute gives zoning power to city and town councils13. Septic permits and wells are the exception to town control, covered below.
The building code itself is statewide. Rhode Island's code incorporates the 2021 International Building Code with state amendments, and detached one- and two-family homes follow the Rhode Island One- and Two-Family Dwelling Code14. Call the Jamestown Building Department before you design anything; the page lists its phone number above7.
Does Jamestown have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?
Jamestown has zoning, enforced by the Town Building Department2. Minimum lot size, setbacks, lot coverage and building height are set district by district in the town ordinance, not by the state, so the answer depends on your parcel's district1516. We could not confirm Jamestown's dimensional schedule, so ask the Building Department which district your lot sits in and what it allows.
RVs and tiny homes: we could not confirm whether Jamestown allows living in an RV or a tiny home on private land, so ask the Building Department before you buy. The state's RV rule covers recreational vehicle parks and campgrounds, not a house lot17.
Accessory dwellings are one state-level opening. Rhode Island lets an owner add one accessory dwelling unit by right on a residential lot of at least 20,000 square feet, and a compliant unit cannot be rented to tourists or through a hosting platform18. Jamestown's own accessory-dwelling provisions are unconfirmed.
How do septic permits work in Jamestown, RI?
Septic permits for Jamestown come from the state, not the town. DEM's Onsite Wastewater Treatment System (OWTS) Program administers Rhode Island's septic permitting program, including for land inside Jamestown319. A new system must be designed by a Class II or Class III DEM-licensed designer, and a new site needs a soil evaluation by a licensed Class IV Soil Evaluator20.
The septic approval gates the building permit: a Rhode Island municipality may not issue a building permit for work that needs OWTS approval until the Director's written approvals are presented and valid21. Where a public sewer is reasonably accessible and you can get permission to connect, DEM cannot approve a septic application22.
Soils matter too. USDA rates 0% of Newport County soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system23.
Can you live in an RV or tiny home in Jamestown?
We could not confirm Jamestown's rules on living in an RV, camping on private land, or occupying a tiny home. Ask the Building & Code Enforcement Office what applies to your parcel7.
What the state does say is narrow. Rhode Island's RV statute addresses recreational vehicle parks and campgrounds, with municipal zoning and location controls still applying, and it does not cover every parcel24. One state rule covers temporary housing after a disaster: if a residence is made uninhabitable by fire or flood, the owner may park a mobile or manufactured home on the land for up to 12 months or until the home is fit to occupy25.
Building a home in Jamestown: the steps, in order
- Confirm zoning. Ask the Town Building Department which district your lot is in and what it requires for lot size, setbacks and height27.
- Subdividing first? Subdivision and land development are regulated by the Town, and the Town Planner is the Administrative Officer8. Published administrative fees include $100 for an administrative subdivision and $300 plus $50 per acre for a minor subdivision preliminary review26.
- Start septic. Hire a licensed soil evaluator and designer, and get DEM's written approval through the OWTS Program2019.
- Check wells. A new private well may be installed only where public water does not already serve the area, and the contractor files a Well Completion Report with RIDOH within 10 days of installation27.
- Apply for the building permit with the Town Building Department1.
- Pass inspections and then obtain the certificate of use and occupancy512.
- Driveway. A driveway onto a state highway needs a permit from the Rhode Island Department of Transportation before access is made28.
What to check before you buy land in Jamestown
Start with wetlands and flooding. Projects in a state-defined area that may alter freshwater wetlands, floodplains or areas subject to flooding need approval from the DEM Director29. We could not confirm a Jamestown-specific floodplain permit, so ask the Building Department.
Then price the carrying costs, which are county-level figures. Newport County's typical home value is about $800,32130, its effective property tax rate is 1%9, and its median property tax bill is $5,345 a year31. A typical home insurance premium there is about $2,823 a year32.
For the rest of the county, see the Newport County page; each town there runs its own zoning33.
Watch-outs
- Jamestown's minimum lot size, setbacks, lot coverage and height limits depend on the zoning district, and we could not confirm them, so ask the Building Department before you buy15.
- A state owner-builder rule exempts an owner-occupant from contractor registration only; the owner still must obtain a permit and pass inspection6.
- Short-term rentals in Jamestown need a Town host application, and the Town's page listed 2027 registration as open through September 30, 2026; ask the Town about the current window34.
- Rhode Island short-term rentals listed on hosting platforms must also be registered with the Department of Business Regulation35.
- We could not confirm whether the Town requires its own certificate of occupancy steps beyond the state rule, or a Jamestown-specific driveway permit; ask the Building Department12.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
