The Town of Portsmouth, Rhode Island requires a building permit for new construction, enlargements and most alterations, issued by the town's Building Inspection Department12. Portsmouth adopts and enforces its own zoning ordinance3. Septic system permits come from the state Department of Environmental Management, while the town inspects and maintains existing systems45.

Do you need a building permit in Portsmouth, RI?
Yes. The Town of Portsmouth requires a written application and a permit before anyone constructs, enlarges, alters, removes or demolishes a building, or changes its occupancy1. The rule comes from the Rhode Island State Building Code, and ordinary repairs that do not violate the code are exempt14. For one- and two-family homes, small items such as a one-story detached accessory structure of 64 square feet or less and fences up to 6 feet are also exempt2.
Working without a permit carries a late filing fee, according to the town1. Once a new building is finished, it cannot be occupied until the building official issues a certificate of use and occupancy15.
Who issues building permits in Portsmouth, and how do you reach them?
The Portsmouth Building Inspection Department at Town Hall issues building permits and inspects the work1. Call 401-683-3611 or apply through the town's online permitting page1. Rhode Island has no county government that issues building permits, so nothing is handled at Newport County level16.
Inspections follow state rules: for designated inspection points the builder may need to give 24 hours' notice, and the building official must inspect within 48 hours of notification, not counting weekends and holidays17. We could not confirm Portsmouth's own building permit fee schedule; the state requires each municipality's schedule to be posted on the Building Code Commission website18.
Does Portsmouth have zoning, and what does it mean for lot size and setbacks?
Yes. Portsmouth adopts its own zoning ordinance, Chapter 405 of the town code3. The town is divided into residential districts R-10, R-20, R-30, R-40 and R-60, a C-1 commercial district, industrial, waterfront, open space, water resource protection and redevelopment districts6. Zoning questions go to the Planning Department's Zoning Enforcement Officer19.
Dimensions depend on the district. In R-20, the minimum lot size is 20,000 square feet, with 30-foot front and rear setbacks, a 15-foot side setback and 20% maximum lot coverage92021. In R-60, the minimum lot is 60,000 square feet, setbacks are 50 feet on every side and coverage is capped at 10%102223. Both districts cap height at 35 feet2425. Footnotes in the ordinance table can modify R-20 figures, so confirm with the Zoning Enforcement Officer before relying on them9.
How do septic permits work in Portsmouth, RI?
Septic permits for Portsmouth come from the state, not the town. Rhode Island's Department of Environmental Management must give written approval of plans before anyone installs, alters or repairs a septic system7. New systems need a DEM-licensed Class II or III designer and a soil evaluation by a licensed Class IV evaluator26. The town will not issue a building permit for work that needs septic approval until DEM's written approval is presented27. Contact the28 with questions.
Portsmouth adds its own layer for existing systems. Under the town's Wastewater Management District chapter, every owner of an onsite system, including cesspools and holding tanks, is subject to inspection and maintenance rules29. Routine inspections occur once every five years or more often if the Wastewater Manager requires, cesspools every two years and holding tanks annually8. A failed system triggers a notice requiring an application to DEM30. Nearly all local soils rate poorly for conventional drain fields, so expect a site evaluation and possibly an engineered system31.
Can you live in an RV, mobile home or tiny home in Portsmouth?
Portsmouth's zoning use table prohibits a trailer or mobile home outside a trailer or mobile-home park in the listed districts, and allows a park only by special use in the I-H district11. Rhode Island law separately lets towns treat code-compliant manufactured homes as single-family homes on lots zoned for single-family use, subject to the district's dimensional rules32.
We could not confirm Portsmouth's rules for living in an RV on private land, temporary camping or tiny homes, so ask the Zoning Enforcement Officer before buying19. State rules on RV parks and campgrounds do not answer whether you can live in an RV on your own lot33.
Building a home in Portsmouth: the steps, in order
- Confirm the lot's zoning district, lot size and setbacks with the Zoning Enforcement Officer, and get a zoning certificate if needed19.
- If the lot has no public sewer, hire a licensed soil evaluator and designer and get DEM's written septic approval2627.
- If you are subdividing, plan for planning board review under the town's subdivision chapter34.
- Apply for the building permit with the Building Inspection Department1.
- Owner/occupants of a single-family dwelling may be exempt from contractor registration, but must still obtain a permit and pass inspection12.
- Schedule inspections, then obtain the certificate of use and occupancy; private wells require drinking-water test documentation35.
- A driveway onto a state highway needs a RIDOT Physical Alteration Permit36.
What to check before you buy land in Portsmouth
Check the zoning district first, since lot size, setbacks and coverage differ sharply between R-20 and R-60910. Check whether public sewer is reasonably accessible: DEM cannot approve a septic system where it is, and can require a failing system to connect37. Check wetlands and flood areas, where DEM approval can be required for projects that may alter them38.
New private wells are allowed only where public water does not already serve the area, and the driller files a completion report within 10 days39. For orientation, Newport County's effective property tax rate is 1%13 and its median property tax bill is $5,345 a year40. For land outside Portsmouth, see the Newport County page.
Watch-outs
- We could not confirm Portsmouth's own building permit fees, building-code adoption or certificate-of-occupancy procedures; ask the Building Inspection Department at 401-683-36111.
- We could not confirm Portsmouth's rules on accessory dwelling units, but state law allows one by right on a residential lot of at least 20,000 square feet, so ask the Zoning Enforcement Officer how the town applies it41.
- The town zoning ordinance we reviewed was last amended in June 2015, so ask the Planning Department whether later changes affect your parcel3.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
