Newport County, Rhode Island

Zoning, building permits and septic rules in Tiverton, Rhode Island

The Town of Tiverton, Rhode Island requires building permits for construction, and the Town's Code Enforcement Department issues them12. Tiverton sets its own zoning through the Tiverton Zoning Ordinance3. Septic permits do not come from the town: the state Department of Environmental Management (RIDEM) permits onsite wastewater systems4. Newport County has no county government to ask5.

Does Tiverton, RI have zoning, and what does it allow?

Yes. The Town of Tiverton adopts and enforces its own Tiverton Zoning Ordinance, part of the Town Code3. The ordinance divides the town into zoning districts, so setbacks, lot area and height depend on the district your parcel sits in12. Main Road north of Route 24 and Bliss Four Corners carry extra form-based-code rules for commercial use3.

Two use rules matter to a land buyer. Manufactured homes, mobile homes, multifamily homes and duplexes are prohibited uses within Tiverton's rural residential developments, although that rule is specific to those developments and does not settle other districts9. Each lot in a rural residential development also needs a minimum driveway access of 12 feet to a public or private street13.

We could not confirm Tiverton's rules for living in an RV, tiny-home occupancy, temporary camping or a minimum house size. Ask the Zoning Enforcement Officer at Code Enforcement14 before you plan any of those.

Do you need a building permit in Tiverton, and who issues it?

Yes. Tiverton's Code Enforcement Department issues building permits and runs plan reviews and onsite inspections of building projects14. Rhode Island law makes it unlawful to construct, enlarge, alter, remove or demolish a building without first filing a written application with the building official and getting the required permit2.

Applications go online through the Town's OpenGov E-Permitting Portal14. Listed permit types cover demolition, building construction, electrical, mechanical, plumbing and solar work6. Reach the department at 401-625-671514.

A new building cannot be used or occupied until a certificate of use and occupancy is issued15. We could not confirm the current Tiverton fee schedule, so ask Code Enforcement before budgeting.

Can you build your own house in Tiverton?

Rhode Island lets a single-family owner-occupant skip contractor registration only when the owner does the work without the assistance of others, and the owner must still obtain the permit10. The local building official inspects that work under the code11. Confirm how Tiverton applies this with the Building Official at Code Enforcement14.

How do septic permits work in Tiverton, RI?

Tiverton does not issue septic permits; RIDEM does, for every town in Newport County4. No one may install, construct, alter or repair an onsite wastewater system without first obtaining the DEM Director's approval7. A new building that will use an onsite system needs an OWTS application for new building construction16, and the licensed designer witnesses and inspects the installation17.

Expect a site evaluation. USDA rates almost none of the soil in Newport County as free of limits for a conventional drain field18, so many lots will need an engineered system. If a public sewer is reasonably accessible, RIDEM can require connection19. Contact the OWTS Program at (401) 222-396120.

Can you add an accessory dwelling in Tiverton?

Tiverton permits one accessory dwelling unit (ADU) per lot where the lot has a legally established single-family or multi-family primary dwelling8. The ADU is by right on lots of at least 10,000 square feet; smaller lots need a special-use permit8. Studio and one-bedroom ADUs are capped at 900 square feet or 60% of the primary dwelling, whichever is less, and two-bedroom ADUs at 1,200 square feet or 60%8. Tiverton bars renting an ADU for tourist or transient use or through a hosting platform21.

Building a home in Tiverton: the steps, in order

  1. Find your zoning district and dimensional rules in the Tiverton Zoning Ordinance, and ask the Zoning Enforcement Officer about your intended use1214.
  2. If you are dividing land, expect subdivision or land-development review under Tiverton's regulations22.
  3. If the lot has no sewer, hire a DEM-licensed designer and apply to RIDEM for the septic permit2320.
  4. Check flood zones with Code Enforcement, which also handles floodplain administration24.
  5. Apply for building permits through the OpenGov portal6.
  6. Schedule the required inspections and obtain a certificate of use and occupancy before moving in2515.

What to check before you buy land in Tiverton

Tiverton is a coastal community, so ask Code Enforcement about flood zones before you buy14. A driveway onto a state highway needs a state permit26. New private wells are allowed only where no public water system serves the area, and some local officials require well permits2728. Newport County figures: typical home value is about $800,32129, the effective property tax rate is 1%30, and farmland averages $35,737 per acre31. For anything outside Tiverton, see the Newport County page.

Watch-outs

  • Tiverton has no county office above it: Rhode Island counties have no governmental structure, so building and zoning questions go to the town32.
  • We could not confirm which building-code edition Tiverton enforces, its fee schedule, or its rules on RVs, tiny homes and camping; call Code Enforcement at 401-625-671514.
  • Septic and wells are not decided by the town's zoning: RIDEM permits septic systems4.
