Do you need a building permit in Aransas County, Texas?

Covered work in unincorporated Aransas County requires a county Development Permit or Repair Permit1. The floodplain order requires an approved county permit before development, a broad category that includes building, construction, enlargement, alteration, repair, filling, grading, paving, excavation and drilling1. Aransas County applies floodplain and watershed requirements to construction, placement, alteration, repair, use and maintenance of buildings4. County commissioners court minutes from February 2024 say the county has no building codes for the unincorporated area, while the cities have their own requirements3. A Development Permit covers construction or placement of a building or structure; a Repair Permit covers substantial improvements, including alterations or repairs costing at least 50% of the appraisal-district appraised value, which must meet new-building requirements2. Ordinary minor repairs need Floodplain Administrator approval even when no permit is required2. New residential construction must provide at least 18 inches of freeboard above the Base Flood Elevation, or above the highest adjacent natural ground when maps or studies are unavailable17. Floodplain-regulated projects are subject to county inspection authority, but that does not establish a general residential building-inspection program outside the regulated development8.

Who issues building permits in Aransas County, and how do you reach them?

For an unincorporated parcel, start with the Aransas County Road & Bridge Department and the Floodplain Administrator18. Applications and required project documents go to the Floodplain Administrator; the county may approve the application, approve it with conditions or deny it19. The county must act on a complete application by the 30th day after receipt, while an incomplete filing must receive written notice of missing documents by the 30th day after submission19. An application is treated as abandoned after 6 months without an issued permit, although extensions of up to 90 days may be granted for cause19. Commissioners Court fees must be paid before issuance, and the current floodplain fee schedule is available from the Floodplain Administrator or county website20. Septic approval is separate and must be obtained from Environmental Health before the building permit can issue1721. Fulton requires town permits for manufactured-home construction or installation22. Corpus Christi and Aransas Pass, cities that reach into Aransas County, issue their own building permits2324. Aransas County Environmental Health handles county septic permitting; Fulton also requires town council approval67.

Does Aransas County have zoning?

Aransas County does not have general county zoning; municipalities have zoning authority that the county generally does not share5. In unincorporated Aransas County, county zoning therefore does not set a minimum dwelling size, residential setback, lot coverage or building height25. Fulton sets town zoning; Corpus Christi, which reaches into Aransas County, sets city zoning2627. Aransas County Environmental Health handles county septic permitting, with town council approval also required in Fulton67. Subdivision rules still set minimum lot sizes for covered land divisions: at least 1 acre without public water or sewer, 0.5 acre with public water but no public sewer, and 0.25 acre with both, subject to the stated planned-unit-development exception28. The regulations cover divisions into two or more parcels and exempt some qualifying divisions, so ask Road & Bridge whether a recorded plat or letter of plat exemption is needed1418.

How do septic permits work in Aransas County?

Aransas County requires a permit before constructing, modifying or making non-emergency repairs to an on-site sewage facility through the Aransas County Environmental Health Department111221. The published fee schedule lists $400 for a new residential installation permit, $80 for an OSSF verification and $500 for a multi-unit, rental-community or commercial OSSF permit29. Texas's narrow 10-acre exemption applies only when every listed condition is met, including a site evaluation, one single-family dwelling on at least 10 acres, no nuisance or groundwater pollution, disposal on the same tract and every system component at least 100 feet from the property line30. Only about 12.6% of Aransas County soils avoid severe limitations for a conventional drain field, so make the site evaluation an early purchase contingency31. County materials do not establish one inspection schedule for every system; ask Environmental Health which installation and maintenance inspections the proposed design requires3221.

Can you live in an RV or tiny home on your land in Aransas County?

Unincorporated Aransas County has no general county zoning rule prohibiting RV, tiny-home, manufactured-home or temporary-camping occupancy25. That does not make occupancy permit-free. Every RV outside an existing RV park requires a permit before utility connection or occupancy13. The storage exception applies only at a homeowner's primary residence when the RV remains unoccupied, disconnected from water and wastewater, currently licensed and inspected, and capable of highway use13. A tiny home that falls within covered development needs a Development Permit, and its wastewater system needs county approval unless every condition of a state exemption is met13330. For a new rental community, available public water or sewer must be used; otherwise the proposed OSSF needs Environmental Health approval and licensed design and installation34. Give Road & Bridge the parcel address and proposed setup before delivery, then confirm wastewater approval with Environmental Health1821.

Building a home in Aransas County: the steps, in order

  1. Confirm parcel jurisdiction before using the unincorporated-county rules; municipal zoning authority differs from county authority10.
  2. Check the recorded plat and ask Road & Bridge whether subdivision approval or a plat-exemption letter is required1418.
  3. Arrange the septic site evaluation, submit to Environmental Health and obtain the septic permit before the building permit can issue111721.
  4. File the signed Development Permit application and project-specific documents with the Floodplain Administrator35.
  5. Obtain the current floodplain fee schedule, pay the adopted fee and post the approved permit on site2035.
  6. Confirm utility eligibility; for development covered by county subdivision regulations, plat approval certification is required before water, gas, sewer, electricity or other utility connections36.
  7. For state-highway access, submit TxDOT Form 1058 and wait for the executed permit before construction on the right-of-way37. New rental-community driveways crossing a county right-of-way require county approval instead38.
  8. Ask the Floodplain Administrator which inspections and conformity documentation apply before occupancy89.

What should you check before buying land in Aransas County?

Covered construction in unincorporated Aransas County needs a Development Permit, while regulated subdivisions can require county approval before water, gas, sewer, electricity or other utility connections136. In an adopted regulatory floodway, ordinary encroachment must demonstrate no increase in base-flood levels39. In mapped Zones A or AE without a designated floodway, cumulative development generally may not raise the base-flood water surface more than 1 foot without the specified federal process40. Lots in covered subdivisions may use individual wells and septic subject to the regulations, but a future sewer connection covenant applies when public sewer reaches the lot boundary41. We could not confirm the private-well permit rule or a general residential county-driveway permit rule; ask Environmental Health about wells and Road & Bridge about county-road access2118. For a state-highway driveway, obtain the executed TxDOT access permit before construction37.

Watch-outs

  • Repairs or alterations costing at least 50% of the appraisal-district appraised value must meet new-building requirements in unincorporated Aransas County2.
  • Only about 12.6% of Aransas County soils avoid severe limitations for a conventional septic drain field, so test wastewater feasibility before fixing the building site31.
  • No general county zoning does not cancel floodplain permits, septic approval, subdivision standards or utility conditions517111442.
  • An RV outside an existing RV park needs a permit before utility connection or occupancy in unincorporated Aransas County13.
  • New short-term rentals in Rockport must register before operating; in Aransas Pass, a city that reaches into Aransas County, registration is required before operation or advertising4344.

Aransas County rules

  • Building permitLimited

Development, including building, construction, enlargement, alteration, repair, or improvement, regulated by the Aransas County floodplain order in unincorporated areas.

    • The order requires an approved County permit from the Floodplain Administrator before covered work.
    • The order defines development broadly, including building or structure construction, filling, grading, paving, excavation, or drilling.
    • Subdivision regulations additionally require a recorded plat or letter of plat exemption before a building permit in covered unincorporated subdivisions.
    • The order is identified as effective 2019-12-01.
“No person(s), firm, or corporation shall erect, construct, enlarge, alter, repair, or improve any building, structure, or manufactured home without first obtaining an approved County permit from the Floodplain Administrator.”

    • Limited — Development and repair of buildings, structures, and manufactured homes in unincorporated Aransas County under the county floodplain regulations.
“These regulations shall apply to all unincorporated areas within the jurisdiction of Aransas County, Texas.”
  • Building code adoptedPartial

Construction, placement, erection, alteration, repair, use, location, or maintenance of buildings and structures in unincorporated Aransas County subject to the County's floodplain and watershed-protection requirements.

    • A Development Permit is required before construction, placement, or erection of any building or structure.
    • A Repair Permit is required before substantial improvements; ordinary and minor repairs may be made with Floodplain Administrator approval without a permit if they do not violate the regulation.
    • Permit applications must be completed and signed and include documentation required for the work and flood-zone designation.
    • In Special Flood Hazard Areas, a registered professional engineer or architect must develop and review structural designs, specifications, and plans and certify compliance with elevation and anchoring requirements.
    • A permit does not relieve the applicant of the responsibility to obtain other required federal, state, or local permits.
    • The official 2020 workshop minutes describe adoption of general International Residential and International Fire Codes as a matter under consideration; they do not confirm that those general codes were adopted.

permit review deadline: 30 days (after receipt of a completed application) · substantial improvement threshold: >= 50 percent of appraised building value (alterations, improvements, or repairs at or above this threshold must conform to requirements for new buildings) · permit license period: 1 year (the permit is construed as a license to proceed with work for one year)

“Provisions of this regulation shall apply to all new construction or development, proposed subdivisions and to the construction, alteration, repair, use, location, or maintenance of every building or structure or any appurtenances connected to or attached to such buildings or structures, within all unincorporated areas within the jurisdiction of Aransas County, Texas.”

    • Not adopted — International Residential Code and International Fire Code adoption for unincorporated Aransas County as of the January 27, 2020 Commissioners' Court workshop
“Katherine: Yes sir, because we have nothing now . But my recommendation would be to first look at the fire code”
    • Not adopted — County residential building-code adoption and enforcement in unincorporated Aransas County, as described in the official February 12, 2024 Commissioners Court minutes.
“We don't have building codes in the county so in the city they have those requirements and regulations that they can fall back on whereas people basically living in just about anything in the county they are al lowed to do that.”
  • InspectionsLimited

Floodplain-regulated development in unincorporated Aransas County.

    • The floodplain order contains an inspection section and permits the Floodplain Administrator or authorized representative to enter buildings, structures, or premises to perform duties imposed by the regulations.
    • This does not establish a general residential building-inspection program outside floodplain-regulated development.
“The Floodplain Administrator, or his duly authorized representative, may enter any building, structure or premise to perform any duties imposed upon him by these regulations.”
  • Certificate of occupancyLimited

Occupancy of development regulated by the Aransas County floodplain order.

    • The order requires a Development Permit stating that the use conforms before occupancy.
    • This is not evidence of a separately named general certificate-of-occupancy program.
“It shall be unlawful to use, occupy any building, development, or premises or part thereof hereafter created, erected, changed, converted, altered, or enlarged in its use or structure until a Development Permit has been issued by the Floodplain Administrator stating that the use of the development conforms to the requirements of this Order.”
  • County-wide zoningAbsent

General county zoning authority in Aransas County.

    • The county plan states that municipalities have zoning authority while counties do not have the same authority.
    • The plan notes a limited statutory exception for specific recreation areas under Texas Local Government Code Title 7, Subtitle B.
“One challenge that the county faces in addressing flood risk is the inability to implement higher building standards and zoning regulations within its jurisdiction. [...] However, counties do not have that same authority.”
  • Local zoningVaries (with conditions)

Aggregate local zoning across Aransas County; incorporated municipalities may administer zoning within their jurisdictions, while the county generally does not.

    • This is an aggregate county claim and does not attribute municipal ordinances to the county.
    • The official plan identifies the City of Aransas Pass, Town of Fulton, and City of Rockport as incorporated communities in the county.
“In Texas, municipalities are given zoning authority to regulate land uses within its jurisdictions. However, counties do not have that same authority.”
