Do you need a building permit in Brazoria County, Texas?

Unincorporated Brazoria County requires a building permit for a fully enclosed structure of at least 200 square feet in Zone X and for a fully enclosed structure of any size in a flood zone1. Mobile homes, relocated homes, barns, garages, storage buildings and greenhouses have separate building-permit categories and fees1. New houses, duplexes and qualifying additions must substantially conform to the county’s adopted residential code; covered new houses and duplexes need at least three inspections as applicable23. The county rules here apply to unincorporated land; municipal building permits come from Angleton12, Manvel13, Clute14, Richwood15, West Columbia16, Brookside Village17, and Oyster Creek18. Brazoria County Environmental Health handles septic review and inspections countywide, but Lake Jackson prohibits septic systems5719.

Who is the Brazoria County building department, and how do you reach them?

Start with the Brazoria County Floodplain/Building Permit Office for an unincorporated parcel1. The office is at 451 North Velasco Street, Suite 210, Angleton, TX 77515, and its phone number is 979-864-129520. For residential construction in a municipality's extraterritorial jurisdiction, contact that city about its building codes; Brazoria County Environmental Health still administers septic permits countywide15. Tell the county building office the flood zone, size and type of structure so staff can identify the building-permit category and fee; the fee doubles when construction begins before the building permit is obtained1. Before covered residential construction begins, the builder must notify the Floodplain Administrator, arrange the required inspections with an authorized inspector and submit the final compliance notice within 10 days after final inspection3. We could not confirm a general county certificate-of-occupancy rule, an agricultural exemption or a blanket owner-builder exemption from building requirements, so ask the Floodplain/Building Permit Office about those points.

Does Brazoria County have zoning?

Brazoria County has no zoning ordinance in its unincorporated areas4. At the county zoning level, that means no minimum dwelling size, minimum lot size, setbacks, lot-coverage limit or building-height limit, and no use restriction on accessory dwellings, RVs, tiny homes, manufactured homes or temporary camping8. Brazoria County still regulates subdivision and tract reconfiguration within its jurisdiction9. Municipal zoning applies inside Lake Jackson21, Angleton22, Manvel23, Village of Iowa Colony24, Clute25, Freeport26, Richwood27, Brookside Village28, and Oyster Creek29. Alvin has no zoning ordinance, but development regulations and subdivision laws still apply; West Columbia also has no zoning, yet city ordinances regulate some uses, including mobile homes and RVs3031. County Environmental Health remains the septic authority; Lake Jackson’s septic prohibition still applies519.

How do septic permits work in Brazoria County?

The Brazoria County Environmental Health Department reviews on-site sewage facility (OSSF) documents, issues septic permits and performs inspections countywide57. Submit a signed site evaluation and soils investigation, a notarized county application, and a scaled design prepared by a registered engineer or sanitarian, with a technical report and manufacturers' specifications; spray irrigation also requires an affidavit and maintenance agreement32. Allow at least five business days for review; the authority must approve or deny the application and planning materials within 30 days of receipt and explain a denial in writing3233. The septic permit expires 12 months after approval32. The county’s published information guide lists fees of $210 for single-family systems and $410 for others, including plan review and final inspection34. The property owner must ensure the OSSF passes all Environmental Health inspections before covering or using it; additional inspections cost $100 per job-site trip7. Texas's septic-permit exemption for a tract of at least 10 acres also requires a licensed site evaluation, compliance with state standards, only a single-family dwelling, all OSSF parts at least 100 feet from property lines, on-property effluent disposal and no nuisance or groundwater pollution; ask Environmental Health whether stricter local requirements apply6.

Can you live in an RV or tiny home on your land in Brazoria County?

Brazoria County's lack of zoning means the county does not impose an RV, tiny-home or temporary-camping land-use restriction on unincorporated property8. A fully enclosed tiny home needs a building permit when it is at least 200 square feet in Zone X or any size in a flood zone; mobile homes and relocated homes have separate permit categories1. A site-built tiny house may also fall within the county's residential-code and inspection order when it is a new single-family house23. If public sewer is unavailable and the project generates wastewater, Brazoria County requires an OSSF; soil type and water tables restrict conventional systems, and permit, design, review and inspection rules still apply35. Texas allows approved, certified composting toilets as OSSF treatment systems, but that approval alone does not authorize an installation; ask Environmental Health how the proposed toilet and remaining wastewater fit the septic permit36. We could not confirm a general utility-connection mandate; ask the building and septic offices about the proposed connections.

Building a home in Brazoria County: the steps, in order

  1. Confirm that the parcel is unincorporated and whether a proposed lot split, combination or reconfiguration needs county subdivision review9.
  2. Submit the site evaluation, soils investigation, notarized application, scaled design and supporting technical documents to Environmental Health for the septic permit32.
  3. Ask the Groundwater Conservation District about the permit pathway before drilling a regulated private well10.
  4. Meet with county development staff when drainage, fill or related engineering review applies; obtain a Letter of No Objection before applying for the Fill & Grade permit to begin dirt work37.
  5. Give the Floodplain/Building Permit Office the flood zone, structure type and enclosed floor area; apply for the building permit before construction when the project meets the county thresholds1.
  6. Arrange the applicable foundation, framing-and-systems, and final building inspections for a covered new house or duplex3. Do not cover or use the OSSF until it passes the county's septic inspections7.
  7. Obtain the separate county right-of-way permit before starting work in a county right-of-way; each work site needs its own application, and a city or other agency's permit does not substitute38. For state-highway access, submit the driveway application to TxDOT and wait for the executed driveway permit before construction39.

What to check before you buy land in Brazoria County

Check septic feasibility first: only about 6 percent of Brazoria County’s soils are rated “not limited” for a conventional drain field; a site evaluation is needed to establish what system a parcel can support40. An owner may install an OSSF for an owner-occupied single-family home only if the local authority allows it, the owner also owns the property, no part is developed for sale or lease, and every permit, construction and maintenance requirement is met11. If the parcel needs a well, regulated wells require a Brazoria County Groundwater Conservation District permit, and the ordinary permit process is listed as 60 days; a temporary-permit route may allow drilling while final approval awaits a public hearing10. Ask whether drainage, fill or dirt work requires county review, because applicable submittals may need civil drainage plans, approvals and a Letter of No Objection before a Fill & Grade permit37. Verify the legal tract because Brazoria County regulates subdivision and tract reconfiguration9. Typical property tax is about 1.7 percent of value, with a median annual bill near $4,8314142.

Watch-outs

  • Covered new houses, duplexes and major additions must meet the county's residential-code order and inspection requirements; do not treat the building permit as floodplain paperwork alone23.
  • Lake Jackson prohibits septic systems even though Brazoria County Environmental Health administers the countywide OSSF program195.
  • The owner-builder allowance is for an owner-installed OSSF under strict conditions; it is not a blanket exemption from building permits or inspections11.
