Cherokee County, Texas

Zoning, building permits and septic rules in Rusk, Texas

The City of Rusk, Texas has its own zoning (Chapter 153 of its Code of Ordinances)1 and its own building permits through City of Rusk Development Services, which enforces an adopted International Building Code2. Septic permits are a separate question: we could not confirm who issues them inside Rusk, so ask Cherokee County Public Health and City Hall before you buy3. Cherokee County's rules cover only land outside the city.

Does Rusk, Texas have zoning, and what does it mean for lot size and home size?

Yes. Rusk regulates land use inside city limits through Chapter 153 of its Code of Ordinances, with district-specific standards and special-use approvals1. Residential districts published in the city's dimensional table include AG, R-1, R-2, R-3, MF, PD, SF-MH, MPH and OTC MF9.

Two districts matter most for a buyer with some acreage. In Rusk's AG district the minimum lot area is 2 acres, and in R-1 it is 8,000 square feet6. Both districts cap buildings at 2.5 stories10.

New homes in AG and R-1 also face the city's 80/400 Rule: a new residence must be at least 80% of the average living area of single-family homes within 400 feet78. That works against a very small house next to larger ones. Rusk's zoning ordinance also ties a certificate of occupancy to any conditions the City Council sets on a special-use permit11.

Do you need a building permit in Rusk, and who issues it?

Inside Rusk city limits, building permits come from the City of Rusk, not Cherokee County. The city asks applicants to schedule a preliminary meeting with the Building Official to discuss submittal requirements and code information before a permit is issued4. Applications go through the city's online permit portal12.

Rusk Development Services enforces the city's adopted codes, and the city has adopted the International Building Code, 2003 Edition, in its entirety52. The city's own ordinances take precedence where they conflict with the adopted codes2.

We could not confirm which kinds of residential work require a permit, what the permit fees are, or whether owner-builders are exempt. Call Development Services at (903)683-2213 before you start any work5.

How do septic permits work inside Rusk, Texas?

Texas requires a permit and approved plan to construct, install, alter, extend or repair a septic system, formally an on-site sewage facility13. Who issues that permit depends on the address: a local authorized agent can run the program under an order, ordinance or resolution approved by the state environmental agency (TCEQ), and TCEQ is the permitting authority where none exists14.

We could not confirm which agent covers an address inside Rusk city limits. Ask Cherokee County Public Health, and ask Rusk City Hall whether the lot is on city sewer312.

The state's 10-acre exemption needs a single-family home on a tract of at least 10 acres, a site evaluation, and every part of the system at least 100 feet from the property line13. A city lot will rarely meet that test.

Can you live in an RV or tiny home in Rusk?

We could not confirm a complete rule for RV living, temporary camping, tiny homes or accessory dwellings inside Rusk city limits. The city's 2022 zoning amendment sets a minimum floor area for new homes through the 80/400 Rule, which a very small dwelling may not satisfy in AG and R-178.

Because Rusk has zoning, do not assume the open rules of the rural county apply. Ask City of Rusk Development Services which district the parcel is in and whether an RV, tiny home or second dwelling is allowed there5.

Building a home in Rusk: the steps, in order

  1. Find the parcel's zoning district with City of Rusk Development Services, and confirm the 2-acre AG or 8,000-square-foot R-1 minimum lot area56.
  2. Check the 80/400 Rule against the homes within 400 feet8.
  3. Ask whether the lot is on city sewer or needs a septic permit, and who issues it3.
  4. Schedule the preliminary meeting with the Building Official, then apply through the city's permit portal412.
  5. If the driveway meets a state highway, file TxDOT Form 1058 and give 24 hours' notice before work in the right-of-way15.

What stays with Cherokee County, and what to check before you buy in Rusk

Land outside Rusk city limits falls under Cherokee County, which has adopted no county zoning ordinance16. Do not apply county answers to a lot inside the city.

Cherokee County figures are county-level. The effective property tax rate is 1.2% and the median property tax bill is $1,941 per year1718. Only 13.9% of county soils rate as not limited for a conventional septic drain field, so a lot not on city sewer may need a site evaluation or an engineered system19.

Confirm septic authority, utility connection, floodplain status and permit fees with the offices above before you close.

Watch-outs

  • We could not confirm who issues septic permits for addresses inside Rusk city limits; ask Cherokee County Public Health and Rusk City Hall312.
  • The city's codes include a 2003 International Building Code edition, so ask Development Services which editions it applies to your project2.
  • A driveway onto a state highway needs a TxDOT permit (Form 1058) before construction in the right-of-way15.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
