Does Shady Shores, Texas have zoning?
Yes. The Town of Shady Shores adopts and enforces its own zoning ordinance, which defines districts with uniform uses, heights and regulations1. The districts are R-1350-1, R-1500-3/4, R-1800-1/2 and R-2000-1/2 residential, an H-1200-4400 historical district and a PD planned development district5.
Dimensional rules differ by district. In R-1350-1, the main building must have at least 1,350 square feet of living area, excluding porches, breezeways and attached garages8. The minimum lot is one acre, with 150 feet of width and 125 feet of depth, though older separately owned lots of record may still be built on7. Setbacks there are 40 feet in front, 25 feet in the rear and 25 feet on each side9, and buildings may cover no more than 30 percent of the lot10. Main structures near the lakefront are capped at 35 feet11. We did not confirm the other districts' numbers, so ask the town before relying on them.
Do you need a building permit in Shady Shores, and who issues it?
Yes. The Town of Shady Shores' Development Services Department administers the town's building permit process2. A building permit is required for all accessory buildings before construction starts12, and a satisfactory percolation test is required before a building permit is issued12.
The town's permit page also lists categories for new construction, remodeling and additions, along with on-site sewage facilities, so call the permit office before you start any project2. We could not confirm the town's adopted building code, inspection schedule or owner-builder rules; the Development Services Department can answer those.
How do septic permits work inside Shady Shores?
Inside town limits, each residence and dwelling unit must connect to an aerobic system or a septic tank of at least 500 gallons, unless the lot is served by the Lake Cities Municipal Utility Authority4. The same rule calls for at least 200 feet of lateral lines4.
The town's permit page lists on-site sewage facilities among its permit categories2. We could not confirm whether the town or Denton County issues the septic permit for a lot inside town limits, so call the Development Services Department before you buy. Denton County Environmental Health permitting applies to unincorporated Denton County13.
Can you live in an RV or tiny home in Shady Shores?
Not without approval. No travel trailer, mobile home, manufactured house or similar structure may be moved into the town and used as a dwelling unless the zoning board of adjustments approves a variance3. Manufactured houses and mobile homes are also allowed in an existing mobile home park that complies with the town's mobile home park ordinance6. We did not find a tiny home provision, so ask Development Services how a tiny home would be classified.
What stays with Denton County, and what to check before you buy
The county's Development Permit, culvert permit and Lake Ray Roberts rules apply to unincorporated land, not to land inside Shady Shores14. For land outside town limits, see the Denton County page. Denton County's effective property tax rate is 1.7%15.
Before buying, confirm the lot's zoning district, whether Lake Cities MUA sewer reaches it, and whether the FEMA flood map touches it. The town's code references the FEMA map, but we did not find a town floodplain permit rule.
