Do you need a building permit in Eureka, Texas?

Yes. Eureka's city code makes it unlawful to erect, construct or locate any building, structure, home, residence or commercial building inside the city without first getting a permit from the city's building official1. Applications must include accurate, scaled plot plans showing the lot, existing and proposed structures, proposed building lines and the intended uses9.

The city's code adopts the 1982 edition of the Standard Building Code for construction inside city limits10. Ask the building official which codes are enforced today before you hire a designer.

When the building is finished, a certificate of occupancy from the building official is required before anyone uses or occupies a new or structurally altered building11. It is applied for with the building-permit application and issued within 10 days after conforming completion11.

Fees are listed in Appendix A of the city code, which has building, electrical, plumbing and moving-structure entries12. We could not confirm the dollar amounts, so ask the city secretary for the current schedule.

Who issues building permits in Eureka, and how do you reach them?

The City of Eureka issues building permits itself, not Navarro County. The city's building permits page tells applicants to give the city a call or send an email to obtain a permit for residential and commercial uses13. City hall is at 400 SE County Road 2190, Eureka, TX 75109, and the office card above lists its phone number13.

Navarro County Planning & Development handles development permits and addressing for unincorporated Navarro County, not for land inside Eureka4. A reader sent to the county counter for a city lot has the wrong office. The county's own building rules for new houses cover unincorporated areas only14.

Does Eureka have zoning, and what does it mean for homes and lot rules?

Yes. Eureka has its own zoning regulations, and compliance is required inside city limits15. The entire city is zoned Single-Family Residential District, including any property annexed later2. Specific-use permits can authorize uses the district does not otherwise allow, and their locations are shown on the zoning map on file with the city secretary2.

In the Single-Family Residential District, principal structures need at least 1,000 square feet of floor space5 and may stand no taller than 35 feet6. Manufactured and mobile homes are allowed in that district when they comply with the manufactured-home or mobile-home regulations the city has adopted7.

We could not confirm whether Eureka allows living in an RV, a tiny home or an accessory dwelling on a lot. Ask the city secretary before you buy or park anything on the property.

How do septic permits work inside Eureka?

Eureka's city code says it is unlawful to install or operate a private sewage disposal facility, including septic tanks, until the city's building official has approved the plans3. Texas also requires a permit to construct, install, alter, extend or repair an on-site sewage facility16.

We could not confirm how the city's approval fits with Navarro County's septic program inside city limits. Navarro County Planning & Development runs on-site sewage facility permitting and inspection for unincorporated land17, and Texas septic permits are normally administered by a local TCEQ-authorized agent18. Call the city secretary first, then the county planning office, and get both answers in writing before you buy a lot without sewer service.

Soils matter here. Only about 3% of Navarro County's soils rate as not limited for a conventional drain field19. That is a county-wide figure and a strict rating, so expect a site evaluation and possibly an engineered system rather than a simple tank and field.

What are the steps to build a home in Eureka, in order?

  1. Call the City of Eureka and ask what the building official needs to see for a residential permit13.
  2. Confirm the lot fits the Single-Family Residential District, including the 1,000 square foot minimum and the 35 foot height limit56.
  3. Prepare scaled plot plans showing the lot, structures and building lines9.
  4. Get septic plan approval from the building official, and ask the county planning office whether a county septic permit is also needed3.
  5. If you plan a private well, apply for the city's well permit8.
  6. Pull the building permit before work starts1.
  7. Request the certificate of occupancy once the work conforms11.

What stays with Navarro County, and what should you check before you buy?

Navarro County's rules apply outside city limits, so confirm whether a parcel is inside Eureka before relying on either set. County floodplain development permits and 911 addressing apply to unincorporated areas2021. We could not confirm how floodplain development is handled inside Eureka, so ask the city before you build near a creek or low ground.

Taxes are set county-wide: Navarro County's effective property tax rate is 1.3%22, and the median property tax bill is $2,119 a year23. Ask the city secretary whether the lot carries any city sewer or utility connection requirements, because we could not confirm one.

For land outside the city, see the Navarro County page.
