Do you need a building permit in Shelby County, Texas?

Unincorporated Shelby County, Texas does not require a county building permit for an ordinary single-family home1. That answer is limited to the county program: statewide energy rules still apply, including Chapter 11 of the 2015 International Residential Code as the minimum state-mandated energy code for single-family homes13. Inside the City of Center, all construction must conform to city-adopted standards, and plumbing, electrical, building or temporary electrical permits may be required depending on the project7. For a Center remodel or addition covering less than 50% of an existing structure, only the remodeled portion must meet present codes7. Because the county does not appear to issue a residential building permit, there is no county owner-builder exemption to apply for.1 The one owner-builder rule we could confirm covers septic: a homeowner may install the OSSF on their own single-family home only if the permitting authority allows it and they have the knowledge, skills and equipment.10

Who is the Shelby County building department, and who do you call?

Shelby County lists no building, zoning or codes department for unincorporated construction12. For a parcel outside city limits, the Shelby County Commissioners Court is the practical county-government contact for road and jurisdiction questions14. The office is at 200 San Augustine St, Center, TX 75935, and can be reached at 936-598-6136 or commissioners@co.shelby.tx.us14. County Road Use and Boring Permits apply to oil-field, logging, poultry and utility work, and the county directs applicants to email the permit to the Commissioners Court for approval15. For septic questions, contact the TCEQ On-Site Sewage Facility Program at 512-239-3799 or ossf@tceq.texas.gov; Shelby County is assigned to TCEQ Region 10 in Beaumont164.

Does Shelby County have zoning?

Unincorporated Shelby County has no county zoning ordinance, and Texas law does not give Shelby County general zoning authority23. As a result, county zoning does not set minimum dwelling size, minimum lot size, setbacks, lot coverage, building height, or placement rules for accessory dwellings on unincorporated land3. The answer changes inside incorporated municipalities: the City of Center's zoning ordinance and zoning map apply to property within the city, and its Planning and Zoning Commission administers them86. A parcel near the Center boundary therefore needs a city-limits check before design work begins82. Private deed restrictions are not answered by the county zoning record, so buyers should review the deed and title documents for the specific tract.

How do septic permits work in Shelby County?

Shelby County septic permitting is assigned to the TCEQ Region 10 office in Beaumont4. Texas generally requires a permit before an OSSF is constructed, installed, altered, extended or repaired9. A narrow exemption can apply to one single-family dwelling on a tract of at least 10 acres when the system meets state standards, every part is at least 100 feet from the property line, effluent stays on the property, and the other listed health and site conditions are met9. Only 3.7% of Shelby County soils are rated without severe limitations for a conventional septic drain field, so a site evaluation should happen before the house and driveway locations are fixed17. Secondary-treatment or drip-irrigation systems require inspection by a valid maintenance company once every 4 months unless homeowner maintenance is allowed18.

An installed system is inspected by the permitting authority or its designated representative once an authorization to construct has been issued.19 A home not on public sewer may use an on-site system that meets the state's planning, construction and maintenance rules.20 We could not confirm which office is Shelby County's current local permitting authority beyond TCEQ Region 10, so confirm with TCEQ before you buy.

Can you live in an RV or tiny home on land in Shelby County?

On unincorporated land, Shelby County zoning does not restrict RV occupancy, tiny-home occupancy, manufactured-home occupancy, accessory dwellings or temporary camping3. Shelby County also has no county zoning minimum for dwelling size, lot size or setbacks in unincorporated areas3. This county-level answer does not carry into an incorporated city: the City of Center applies its own zoning ordinance and adopted construction standards within the city87. Wastewater remains a separate issue because Texas generally requires an OSSF permit unless the tract and proposed system satisfy every condition of an exemption9. Off-grid sanitation means an on-site septic system that meets the state OSSF rules, with a permit unless every exemption condition is met.20 County utility-connection rules could not be confirmed; ask TCEQ's OSSF program about the proposed wastewater setup before occupying the property.16

Building a home in Shelby County: the steps in order

  1. Confirm that the parcel is outside an incorporated city; the City of Center has separate zoning and adopted building rules87.
  1. Call the Shelby County Commissioners Court at 936-598-6136 about county-road access and any jurisdiction question tied to the tract14.
  1. Contact the TCEQ OSSF program and arrange the septic site evaluation and permit path before fixing the house location1649.
  1. If construction traffic falls within oil-field, logging, poultry or utility work on county roads, submit the county Road Use and Boring Permit for approval15.
  1. If a new or modified driveway enters a state highway, submit TxDOT Form 1058 and wait for an executed permit before beginning work in the right of way11.
  1. Design the home to the applicable statewide energy-code requirements even though Shelby County does not issue the residential building permit131.

What should you check before buying land in Shelby County?

Start with wastewater: only 3.7% of Shelby County soils are rated without severe limitations for a conventional drain field, while 99% of the county is at a slope of 15% or less1721. The county is 69.2% wooded and receives about 54.2 inches of precipitation annually, so clearing, drainage and access deserve parcel-level inspection2223. Texas sets no state site permit for drilling a water well, but a local ordinance or groundwater conservation district may require a permit or registration, so ask before drilling.12 Confirm whether access is from a county road or state highway because the permit path differs1511. Shelby County's general floodplain-development permit requirement could not be confirmed; ask the Commissioners Court about the parcel and review current flood mapping before committing14. Farmland value averages about $3,584 per acre, the typical home value is about $226,492, and the median property-tax bill is about $1,143 per year242526. The nearest city of 100,000 or more is about 53 miles from the county center27.

Watch-outs

  • A Shelby County street address does not prove a parcel is outside city limits; Center has its own zoning and adopted construction rules87.
  • A septic permit is generally required, and Shelby County's soil ratings make an early site evaluation especially valuable917.
  • Shelby County's general floodplain-development permit procedure could not be confirmed; ask the Commissioners Court about the specific parcel14.
