Zoning, building permits and septic rules in Breckenridge, Texas

Breckenridge, Texas has its own zoning chapter and its own permit department: the City of Breckenridge issues building permits and inspects work inside city limits.12 Septic permits are a separate track under Texas's on-site sewage rules, and we could not confirm who administers them inside the city, so ask before you buy.3 Outside the city, Stephens County has no zoning.4

Does Breckenridge, Texas have zoning?

Yes. The City of Breckenridge adopted a new Chapter 22 "Zoning" in its Code of Ordinances in 2026.1 The chapter divides the city into 14 zoning districts plus two overlay and special districts.9 Land with the FP floodplain designation follows the floodplain restrictions first, ahead of the underlying district, where federal and state laws apply.10

In the SF-7.5 single-family district, the minimum lot area is 7,500 square feet.8 The main house may rise 2-1/2 stories, not to exceed 36 feet.11 SF-7.5 land must have, or make provision for, city water and sewer.12 A single-family home there also needs a paved driveway at least 25 feet long from the street or alley right-of-way to the garage door.13

We could not confirm district-by-district rules for living in an RV, a tiny home or a manufactured home on a private lot inside the city, so call the city permit department before relying on any of them.2

Do you need a building permit in Breckenridge, and who issues it?

Inside Breckenridge city limits, building permits come from the City of Breckenridge permit department at 105 North Rose Ave.2 The city's page covers building, electrical and plumbing permits and says applications go to the permit department; all contractors must register with the city every year.2

The city has adopted the 2021 International Residential Code for residential buildings, with state and city amendments.5 A backyard accessory dwelling unit may be built only with a building permit.14 We did not find posted permit fee amounts or a general inspection rule, so ask the department for a fee schedule.2

Can you build an accessory dwelling or guest house in Breckenridge?

Only in limited cases. Breckenridge allows one accessory dwelling unit per residential lot, and it must stay incidental to the main home, not leased or sold.7 Accessory dwelling units are permitted only in the AG and SF-7.5 districts, and the unit must sit behind and separate from the main dwelling.14 A caretaker, farm worker, guest or family member of the owner may live in it.7

How do septic permits work in Breckenridge, Texas?

Texas requires a permit and approved plan to build, alter, repair, extend and operate a septic system.6 The permitting authority is either a local agent authorized by the state or the regional TCEQ office where no local agent exists.3 We could not confirm which applies inside Breckenridge city limits, so start with the Stephens County Judge's Office and ask who takes septic applications.15

If a lot is served by city sewer, as SF-7.5 land must be, a septic system may not be needed at all.12 A single-family septic system can be exempt from permitting on a tract of at least 10 acres when it meets the state's conditions, including a site evaluation and 100 feet from the property line.6 Conventional drain fields are a poor bet in Stephens County: USDA rates only about 1.5% of its soils as not limited for them, so expect a site evaluation.16

What stays with Stephens County outside Breckenridge?

Outside city limits the rules change. Unincorporated Stephens County has no county zoning ordinance, so no county rule sets lot size, setbacks or RV use there.4 The county does regulate subdivisions in unincorporated areas, under rules its Commissioners Court lists as approved 7.27.2026.17 See the Stephens County page for land outside the city.

Private wells need state registration only inside a groundwater conservation district; whether one covers an address could not be confirmed from our sources.18 Property taxes run at an effective rate of about 1.7% in Stephens County, with a median bill of $1,779 a year.1920

  4. Build to the 2021 International Residential Code as adopted.5

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
