#31 of 55 in West Virginia

Do you need a building permit in Tucker County, West Virginia?

Yes—a Tucker County development permit is required before new construction, a substantial improvement, or the placement or relocation of a structure, including a manufactured home.1 Unlike most counties around it in West Virginia, Tucker County requires a county building permit14. Outside Davis, Hambleton, Hendricks, Parsons and Thomas, including the Canaan Valley zoning area, apply to the Tucker County Planner; inside those towns, apply through the town.2 Parsons, for example, runs its own building permits inside city limits, with a $45 application fee for work costing $1,000 or more and $20 below that (Parsons).15 Septic and well permits stay with the Tucker County Health Department, town or not.45 The development permit does not prove a building code applies everywhere: West Virginia does not require every local jurisdiction to adopt the State Building Code.16 Development in or near a Special Flood Hazard Area carries added floodplain requirements, and land partly or fully in the regulatory floodplain may need County Commission site-plan approval.1718 The published application fee is $25, although the county instructions also say the fee is based on current market value; ask the Planner to confirm the amount.7 Buildings used primarily for agriculture are exempt from the State Building Code, State Fire Code and county or municipal building codes, and the county waives permit fees for buildings using agricultural exempt status, but neither rule is stated to remove the county development permit.1986

Who is the Tucker County building department and how do you reach it?

Tucker County directs county development-permit applications to the Tucker County Planner at 213 First Street, Suite 201, Parsons, WV 26287, phone 681-399-9085.20 The application package may require septic and well permits, a public-utility availability letter, floodplain documents, a state-road driveway permit, and Canaan Valley zoning approval.11 The Tucker County Health Department Environmental office handles septic permits and well permits countywide at 206 Senior Lane, Parsons, West Virginia 26287, phone 304-478-3572.2145 For a parcel in Canaan Valley, contact the Canaan Valley Board of Zoning Appeals through the Tucker County Commission at 211 First St, Suite 307, Parsons, WV 26287, phone 304.478.2866.22 New construction needing access to a state road, or work modifying an existing driveway, requires a West Virginia Division of Highways driveway-access permit before the building-permit application is submitted.23

Does Tucker County have zoning?

County zoning applies in the Canaan Valley zoning area rather than throughout Tucker County, and the official materials do not establish one countywide zoning ordinance.932 Davis, Hambleton, Hendricks, Parsons and Thomas handle development permitting inside their boundaries; we could not confirm which towns also have their own zoning ordinance, so ask the town.2 Septic and well permits remain with the Tucker County Health Department countywide.45 The county publishes the Canaan Valley Zoning Ordinance and a 1988 zoning map identified as Appendix 1 to Ordinance 92543, but we could not confirm district names or dimensional standards.24 Within the mapped Canaan Valley watershed, permitted-by-right uses go to the Zoning Inspector and special exceptions go to the Board of Zoning Appeals.25 Ask the County Planner or the applicable town for a parcel-specific answer on minimum home size, lot size, setbacks, lot coverage and height limits before designing the project.

How do septic permits work in Tucker County?

The Tucker County Health Department handles septic permits and well permits throughout Tucker County, including inside incorporated towns.45 A septic permit copy is required for a new home, bedroom addition or business.26 Additions without bedrooms or bathrooms, chicken houses and nonresidential barns or outbuildings may skip installing a system, but a septic permit for the structure is still required before the building-permit application.10 Where a subdivision will use individual onsite systems, subdivision approval comes before the sewage permits.26 Only 0.9% of Tucker County soils are rated without severe limitations for a conventional septic drain field, so settle feasibility and cost before fixing the house site.27 Well permits come from the Health Department before drilling, modifying or abandoning a well, and a copy is required for a new home's application.513 A well that existed before July 1, 1985 can waive the requirement, but a well permit must still be obtained before applying.13 When public water or sewer will serve the project, get an availability letter from the district or provider; we found no countywide mandatory-connection rule.28

Can you live in an RV or tiny home on your land in Tucker County?

We could not confirm a Tucker County rule that answers long-term RV occupancy, temporary camping, or tiny-home occupancy on private land. Before buying or placing a unit, ask the Tucker County Planner for a written answer tied to the parcel and proposed utilities. Tucker County allows manufactured-home placement through its permit process, but that does not establish unrestricted occupancy.29 Inside the mapped Canaan Valley zoning area, the ordinance controls land and structure uses, with the Zoning Inspector deciding permitted-by-right uses and the Board of Zoning Appeals deciding special exceptions.25 A residential setup without public sewer also needs Health Department review for on-site sewage; we could not confirm whether alternative off-grid sanitation is allowed.4 Development in or near a Special Flood Hazard Area must satisfy additional floodplain requirements.17

How do you build a home in Tucker County, step by step?

  1. Ask the Tucker County Planner whether the parcel is inside an incorporated town, inside the Canaan Valley zoning area, or in or near a Special Flood Hazard Area.217
  1. Obtain septic and well permits from the Tucker County Health Department, or obtain a provider availability letter if public water or sewer will serve the site.4528
  1. Secure Canaan Valley zoning approval when applicable and a West Virginia Division of Highways driveway-access permit for new or modified access to a state road.1123
  1. Submit the development-permit application and supporting documents to the Tucker County Planner before construction or placement begins; apply through the town for a project inside a listed municipality.2
  1. If construction disturbs one acre or more, obtain the applicable West Virginia construction-stormwater coverage before disturbance.30
  1. Start work within six months unless the Planner grants a written extension, and request any extension before the one-year expiration.31

What should you check before buying land in Tucker County?

Resolve the development-permit path, Canaan Valley zoning status, floodplain status, legal road access, and septic feasibility before closing. Tucker County soils are especially challenging for conventional drain fields: only 0.9% are rated without severe limitations.27 The terrain also matters, because 43.2% of county land is at a slope of 15% or less and 87.3% is wooded.3233 Federal land covers 23% of the county, so verify boundaries and access rather than assuming adjoining public land provides a legal route.34 Annual precipitation averages 54.4 inches, while severe drought occurs in 2.7% of years.3536 The effective property-tax rate is about 0.4%, and the median annual property-tax bill is $511.3738 The nearest city of 100,000 or more is about 93 miles from the county center.39

Watch-outs

  • A Tucker County development permit is required even outside the mapped floodplain; incorporated-town applications go through the town, while the County Planner handles development outside municipalities.17
  • The published application shows a $25 fee, while the county instructions also say the permit fee is based on current market value, so confirm the current charge with the Tucker County Planner.7
  • The State Fire Marshal's inspection division excludes one- and two-family dwellings; residential construction inspections and certificate-of-occupancy requirements could not be confirmed, so ask the Tucker County Planner and any applicable municipality before work begins.40
