Chaffee County, Colorado

Zoning, building permits and septic rules in Salida, Colorado

The City of Salida, Colorado adopts its own zoning and Land Use Code1. Building permits inside city limits go to the city first for zoning and fire-safety review, then to the Chaffee County Building Department, which administers them2. Septic permits fall under Chaffee County's onsite wastewater rules, though we could not confirm how that applies inside the city3.

Does Salida, Colorado have zoning, and what does it mean for RVs, tiny homes and lots?

Yes. The City of Salida regulates land use through its own Land Use Code, which sets zoning districts and a table of allowed uses1. The districts are R1, R2, R3, MMP, MN, MC, MD, MH, IN, AG, OS and CF4. Which district a lot sits in decides most of what you can do on it.

RVs. Salida defines long-term RV occupancy as a recreational vehicle occupied by one family for no more than six months7. The use table allows it with a minor site plan in R1, R2, R3, MN, MH, IN and AG, outright in MMP, and not at all in MC, MD, OS and CF7. Sleeping in a vehicle on a public street, alley, parking lot or sidewalk in Salida is unlawful9.

Tiny homes. A tiny house is permitted in R2, MMP, MN and AG, permitted with conditions in R3, and not permitted in R1; it must sit on a permanent foundation and meet the 2021 International Residential Code8.

Manufactured homes. HUD-code homes are not permitted in R1, R2, MN, MC, MD or MH, and are allowed with review in R3 and AG10.

We could not confirm Salida's minimum lot sizes, setbacks or height limits; ask Community Development2.

Do you need a building permit in Salida, and who issues it?

Yes. Salida requires building permits for construction inside the city5. The one common exemption is a one-story detached accessory structure, such as a tool shed or playhouse, of 200 square feet or less that is not habitable; electrical, mechanical or plumbing work in it still needs permits5.

The process runs through two offices. Building permit applications are submitted to the City of Salida, which reviews them for zoning compliance and fire safety2. The city then forwards them to the Chaffee County Building Department, because Salida contracts with the county to administer all building permits within the municipality2. The county's rules for unincorporated land, such as its Land Use Code, do not govern lots inside Salida11.

Inside the city, residential construction follows Salida's Residential Code, which is built on the 2021 International Residential Code with local amendments6. One amendment adds damp-proofing and foundation-drain inspections before backfill12.

How do septic permits work in Salida?

Septic is a separate track from building permits. Colorado law requires a permit from the local public health agency before anyone installs or alters an onsite wastewater treatment system on a building not served by a sewage treatment works13. Chaffee County has adopted onsite wastewater (OWTS) regulations through its Board of Health3, and its Building Department handles OWTS permits14.

A lot inside Salida that connects to municipal sewer would not need a septic system; the county notes that municipal or central sewer can be used instead of an OWTS3. We could not confirm Salida's own sewer connection rules, so ask Salida Community Development before you count on a hookup2.

If you do need a system, the county requires the OWTS permit to be approved before a building permit can be issued, and requires an engineer-designed system for conditions such as a floodplain location, groundwater or bedrock in the profile hole, or a lot smaller than one acre15. Soil matters too: the Chaffee County rating for conventional drain fields is low at 0.5% of soils16, so expect a site evaluation and often an engineered system.

Can you live in an RV or tiny home on your land in Salida?

Sometimes, depending on the zoning district. For RVs, Salida's long-term occupancy category caps stays at six months and needs a minor site plan in most residential districts7. Parking and sleeping in a vehicle on public ground is prohibited9. We could not find the city's rules for camping on private land, so call Community Development before you park an RV on a lot2.

For tiny homes, the permanent-foundation route works in R2, MMP, MN and AG, and with conditions in R38. Colorado also treats tiny homes approved by the Division of Housing as suitable for long-term living, but they still have to satisfy local zoning17.

Outside city limits the answer changes. Unincorporated Chaffee County does not allow RVs as permanent habitation and caps vacant-property camping at 90 cumulative days a year without a landowner camping permit18. See the Chaffee County page for land outside Salida.

Building a home in Salida: the steps, in order

  1. Confirm your lot's zoning district and that a house is an allowed use in it, by contacting Salida Community Development12.
  2. Settle water and sewer: ask the city about municipal service, or, if you need a septic system, get the county OWTS permit approved first15.
  3. If the lot is in a floodplain, the county requires foundation plans stamped by a Colorado-licensed architect or engineer and an elevation certificate19. That county rule is written for unincorporated land, so ask Salida whether it applies to your address.
  4. Submit your building permit application to the City of Salida for zoning and fire-safety review2.
  5. The city forwards it to the Chaffee County Building Department for review and administration; inspections follow, including damp-proofing and foundation-drain checks before backfill212.
  6. A driveway onto a state highway needs a state access permit20.

What stays with Chaffee County, and what to check before you buy in Salida?

Several things sit outside the city's zoning office. Septic permits come from Chaffee County's rules rather than from a city office3. New wells need a permit from the Colorado Division of Water Resources21. Building permits are administered by the county building department on the city's behalf2.

Before buying, check the lot's district in the Land Use Code, the water and sewer service, and floodplain status. Short-term rental rules are another gap: we could not confirm Salida's general rules, so ask Community Development2.

Costs and context are countywide. Chaffee County's effective property tax rate is 0.3%22, and the median property tax bill is $1,664 a year23. Land outside the city follows different rules, with its own Land Use Code11; see the Chaffee County page.

Watch-outs

  • Salida's building permits are administered by Chaffee County, not issued by a city building department, so permit status questions go to the county2.
  • The county's septic, RV, driveway and floodplain rules are written for unincorporated Chaffee County and may not apply at a Salida address; confirm with the city11.
  • We could not confirm Salida's setbacks, minimum lot sizes, height limits, accessory dwelling rules or permit fees; ask Community Development2.

Unanswered questions are usually a sign that Salida publishes no rule on the point, not that none exists. Chaffee County’s page lists the county offices to call.
