Do you need a building permit in Morgan County, Colorado?

Yes. In unincorporated Morgan County, placing or using a roofed structure of 120 square feet or larger requires a building permit, subject to listed exceptions.15 The county FAQ lists homes, garages, barns, equipment buildings, grain bins and communication towers among covered buildings.1 The application also covers remodels, additions, manufactured homes, and window, door or siding work, and the permit must be issued before moving dirt or beginning construction.5

Morgan County adopted the 2009 International Building Code, International Residential Code, International Energy Conservation Code and International Mechanical Code in 2010.16 After the permit is issued, the owner or contractor must request the inspections marked on the permit card, and work should be approved before it is concealed.17 Residential applications also require proof of adequate water, public-road access and utility services, plus plans and drainage information.15 We could not confirm an owner-builder exemption from county permits; ask Planning and Zoning.18

Who issues building permits and zoning approval in Morgan County?

The Morgan County Planning and Zoning Department administers building, structure and land-use permits for the unincorporated county.18 Its building page explains when inspections must be requested.19

A land use application is required for all development, and starting work before filing one results in double fees.20 Applicants first schedule a pre-application meeting, which determines the application required, deadlines and fees; incomplete applications are not accepted.21 The building-permit application fee is non-refundable and may change, so get the current amount from the department.22

Inside an incorporated city, the city handles its own zoning where it has adopted it. Brush administers its own land use districts4; we could not confirm who issues building permits there, so ask the city. Septic permits for unsewered buildings still come from the Northeast Colorado Health Department, inside or outside city limits.3

Does Morgan County, Colorado have zoning?

Yes. Morgan County has zoning districts and district-specific development standards, and the Planning and Zoning Department administers them in the unincorporated portion of the county.2 The districts include A, A/B, ER, RR, RCR, MDR, HDR, C, LI, HI, MH, PD and Jackson Lake Village, and the official zoning map sets their boundaries.23

Minimum lot size depends on the district: 35 acres in the A district, 2 acres in ER, and 9,500 square feet in RR.12 Setbacks run 25 to 30 feet in front, 10 to 25 feet on the sides and 15 to 20 feet in the rear, depending on district.24 Single-family height is 35 feet in several districts, though some differ.25 Maximum lot coverage by structures ranges from 25% to 55% where a figure is set.26 Planned Development districts follow their approved development plans.12

Divisions of land under 35 acres must go through the county subdivision process, with proof of water by a public-system tap or a well construction permit.27 We could not confirm a minimum dwelling size or an accessory-dwelling rule; ask Planning and Zoning about the specific proposal.18

How do septic permits work in Morgan County?

The Northeast Colorado Health Department (NCHD) handles on-site wastewater treatment systems in Morgan County.28 A permit is required for any new system or repair of an existing one serving a building not connected to city sewer.29 NCHD inspects permitted systems for compliance, and a lender may request an inspection when property is sold.30 NCHD lists revised OWTS regulations effective 6/15/2026, so ask the office which version applies to your application.30

Contact the NCHD Morgan County office in Fort Morgan for the application.31 A county building-permit application must prove water quality, quantity and reliability and show sewer documentation such as a septic permit, an NCHD will-serve letter or proof of another public system.32 Only 45.5% of county soils are rated not limited for a conventional septic drain field, so make the site evaluation and system design part of due diligence.33 We could not confirm whether alternative off-grid sanitation is allowed; ask NCHD.31

Can you live in an RV or tiny home in Morgan County?

We could not confirm one countywide answer for living in an RV on private land in Morgan County. In the Jackson Lake Village district, one recreational vehicle or one single-wide mobile home is allowed per lot, while multiple units require conditional-use treatment.9 Ask Planning and Zoning about temporary camping and occupancy on the parcel before moving an RV onto the land.18

Colorado permits state-regulated tiny homes intended for long-term living, but plans must receive Division of Housing approval before construction and the unit must satisfy local zoning.10 We could not confirm a county rule that uses the term tiny home. A manufactured home requires a building permit and additional manufactured-home information, and placement may also require conditional-use approval.34 A manufactured home must be installed and receive a certificate of occupancy within 24 months of the placement permit, after an inspection, and cannot be occupied without one.35

Building a home in Morgan County: what are the steps?

  1. Confirm the approving jurisdiction and identify the parcel's zoning district, because the published district standards govern lot size, setbacks, height and coverage.7
  2. Schedule the required pre-application meeting with Morgan County Planning and Zoning to determine the land-use application, deadlines and fees.21
  3. Document a reliable water supply, sewer service and utility services; a private well needs a Colorado permit subject to statutory exceptions and basin-specific rules, while an unsewered home needs NCHD septic approval.143629
  4. Prove adequate access to a public road, and get a driveway permit from CDOT or Morgan County Road and Bridge for a new driveway.3738
  5. If the site is in the 100-year floodplain, obtain a floodplain development permit.13
  6. Obtain the county building permit before moving dirt or beginning construction, then request required inspections as work proceeds.517

What should you check before buying land in Morgan County?

Start with the parcel's zoning district, legal creation and recorded access rather than treating acreage as proof that a home is allowed. Morgan County sets lot sizes by district and sends divisions under 35 acres through subdivision, while a residential building application requires proof of adequate access to a public road.122737

Verify water and wastewater feasibility early: a building application requires proof of water quality, quantity and reliability plus acceptable sewer documentation.32 Check the floodplain map too: a floodplain development permit is required for any manmade change within the 100-year floodplain in unincorporated Morgan County, and a structure that is substantially damaged or improved must be brought into compliance.13 The county's effective property-tax rate is about 0.5%, and the median annual property-tax bill is about $1,574.3940 Morgan County receives about 14.9 inches of precipitation annually, so verify a dependable legal water source before buying.41

Watch-outs

  • Starting work before filing a land use application results in double fees.20
  • A manufactured home cannot be occupied until the county issues its certificate of occupancy, which must happen within 24 months of the placement permit.35
  • An RV rule confirmed for Jackson Lake Village should not be treated as a countywide private-land rule; ask Planning and Zoning about the parcel.918
  • A new driveway needs a permit from Morgan County Road and Bridge or CDOT, depending on which road provides access.38
  • The county adopted the 2009 building codes in 2010; confirm with the Planning and Zoning Department which edition applies to your permit.1619
