Do you need a building permit in Saguache County, Colorado?

Yes. Unincorporated Saguache County requires a building permit for every built or prebuilt structure regardless of size, including storage containers and greenhouses; a temporary structure is included after more than two weeks on the property1. The listed exceptions are fences, roof replacement, roof-mounted residential solar, and a residential solar stand1. Saguache County has not adopted a building code, but Colorado electrical, gas, and plumbing permits remain required and final approvals must be submitted to the Land Use office18. The published county fee is $0.25 per square foot plus a $100 administration fee19. A structure used strictly for agriculture may qualify for an exemption, but an accessory structure on a vacant parcel generally must wait until a permitted residence is completed20.

Who is the Saguache County building department, and how do you reach them?

The Saguache County Land Use Department is the first stop for building and septic permits, addressing, and administration of the Land Development Code in unincorporated Saguache County21. Reach the department at 719-655-2321 or visit 505 3rd Street, Saguache, Colorado; mail goes to P.O. Box 326, Saguache, CO 8114921. Inside the Town of Center and the Town of Saguache, the town issues its own building permits, so the county's rules here apply only to unincorporated land56. Septic permits stay with the county Land Use Office for rural residential property either way3. Building setbacks in unincorporated areas are 10 feet from property lines and 25 feet from the edge of a public-road or other easement22. A physical-address application also requires an access permit from the agency controlling the approach: County Road & Bridge, CDOT, the Forest Service, or BLM23. For a county-road approach, call Saguache County Road & Bridge at 719-655-255424.

Does Saguache County have zoning?

Unincorporated Saguache County has no countywide zoning2. Unlike the counties around it in Colorado, Saguache County has no county zoning25. The county's own pages do not describe a countywide rule on dwelling size, lot coverage, building height, tiny-home occupancy or camping, so ask Land Use about any specific use before you buy2. The county identifies one zoned district plus subdivisions with covenants, an HOA, and a POA, so confirm the parcel's location and private restrictions with the Land Use Department726. The Town of Center has its own zoning code, and the Town of Moffat has adopted its own zoning ordinances, so land inside those towns follows town rules89. Septic rules still create a practical parcel-size threshold: a parcel must be at least one acre for an OWTS permit and general residential buildability, and an applicant with a smaller parcel may seek an appeal or variance after formal denial4.

How do septic permits work in Saguache County?

Central water and sewer exist only in some incorporated areas, so rural residential property in Saguache County needs its own onsite wastewater treatment system (OWTS)27. The Saguache County Land Use Office issues the permit, and a county-approved system is required to live and stay on the property3. A parcel must be at least one acre to receive an OWTS permit; a smaller parcel receives a formal denial before the owner may apply for an appeal or variance4. Submit the septic application with the soil test and engineered design; the permit lasts one year from receipt, with fees of $400 for a new installation and $250 for a repair or modification10. An owner may install the approved system after permit approval by following the design documents13. Schedule the final inspection with at least 48 hours' notice, before the system is covered or used28. The county's application instructions say staff or the engineer of record inspect within three business days after notice29. Saguache County does not allow a composting or incinerating toilet in place of septic unless an approved OWTS is installed first30. Only 5.8% of county soils are rated without severe limitations for a conventional drain field, so make soil testing and system design a purchase contingency31.

Can you live in an RV or tiny home on your land in Saguache County?

Unincorporated Saguache County has no countywide zoning, but the one zoned district and private covenants can still limit camping or tiny-home occupancy on a particular parcel27. That does not make an RV a permanent residence: the county allows a temporary RV permit only after the onsite wastewater system has been installed and approved and while a construction permit is active12. The county FAQ says the RV permit can last for the construction permit's three-year life, but Article XIII limits RV occupancy during construction to 60 total days, so obtain a written duration from the Land Use Department before planning a stay1211. The Land Development Code says an RV or vehicle used as a permanent residence must follow mobile-home rules32. Colorado-approved tiny homes used for long-term living still require state plan approval, applicable-code compliance, local permits, and certification for the installation site33.

Building a home in Saguache County: the steps, in order

  1. Ask the Land Use Department to confirm that the parcel meets the one-acre OWTS threshold, or discuss the denial and appeal or variance process for a smaller parcel4. Confirm the one zoned district, private covenants, and setbacks722.
  1. Verify legal access and obtain the access permit required for addressing from County Road & Bridge, CDOT, the Forest Service, or BLM, as applicable23.
  1. Apply to the Colorado Division of Water Resources for the appropriate well permit and verify any augmentation requirement14.
  1. Submit the soil test, engineered design, and septic application to Land Use before installation10. If installing the system yourself, wait for permit approval and follow the approved design documents13.
  1. Submit a complete construction-permit application and the required fee before construction begins; incomplete applications are not processed34. Arrange the separate state-required electrical, gas, and plumbing permits18.
  1. Have the septic system inspected before it is covered or used (48 hours' notice to Land Use), then submit final trade-permit approvals to Land Use2818.
  1. Ask Land Use to state the construction permit's expiration date in writing: Article XIII says two years with one six-month extension, while the FAQ says three years followed by six-month extensions3435.

What to check before you buy land in Saguache County

Verify water before closing: Colorado generally requires a well permit, and priority or location can also create an augmentation requirement14. Manufactured-home placement requires a well permit, water-court decree, or another water-service agreement15. Saguache County averages 15.8 inches of precipitation a year and has experienced severe drought in 27.8% of years, making the proposed water supply central to due diligence3637. Only 5.8% of county soils are rated without severe limitations for a conventional septic drain field, so obtain the soil evaluation and realistic system cost before treating a parcel as buildable31. Federal land covers 74.3% of the county, while the county warns that access is not guaranteed; verify recorded easements and the agency controlling the approach3823. Confirm whether the road is publicly maintained with Road & Bridge. If you plan to split the parcel, a division creating parcels of at least 35 acres each, none intended for multiple owners, falls outside the Land Development Code's definition of subdivision; ask Land Use before dividing in any other way39. The effective property-tax rate is about 0.3%, the median annual property-tax bill is about $679, and typical annual home insurance is about $1,380161740. Floodplain development rules for a particular parcel could not be confirmed; ask Land Use before designing within mapped flood-prone land.

Watch-outs

  • Saguache County has no countywide zoning, but one zoned district, private covenants, setbacks, and building-permit requirements can still control a parcel27221.
  • Saguache County sources agree that an RV cannot be a permanent residence but conflict between a 60-day occupancy cap and a three-year temporary-permit term; get the allowed duration in writing from Land Use1112.
  • The absence of countywide zoning does not remove the one-acre minimum for an OWTS permit and general residential buildability; smaller parcels require formal denial before an appeal or variance request24.
