Barrow County, Georgia

Zoning, building permits and septic rules in Winder, Georgia

Winder, Georgia requires a building permit for new construction, additions and remodels, issued by the city's Planning and Development Department1. Winder also writes its own zoning, with AG and residential districts2. Septic permits for lots without public sewer are a Barrow County Board of Health matter, not a city one3. Outside city limits, Barrow County's rules apply instead.

Does Winder, Georgia have zoning, and what does it mean for lot size and home size?

Yes. The City of Winder administers its own Comprehensive Zoning Ordinance, with AG and residential districts2. Rules change by district, so find the parcel's district first.

In the R-1 district, lots need at least 25,000 sq ft and homes at least 2,000 sq ft of heated space126. In R-1A the minimums are 15,000 sq ft and 1,800 sq ft137. In R-1B they drop to 10,000 sq ft and 1,400 sq ft149. In the AG agricultural district, lots need at least 2 acres and a home at least 1,800 sq ft158.

R-1 setbacks are 35 feet in front and rear and 12 feet on the sides16. AG setbacks are 50 feet on the sides and rear17. Buildings in AG may cover up to 30% of the lot18.

A detached accessory dwelling needs a lot of at least 10,000 sq ft, and the owner must live on the property19. Winder's ordinance sections we reviewed have no tiny-home provision, and Georgia treats a site-built tiny home as an ordinary dwelling that local government must approve for siting20. Any tiny home would still have to meet the district minimum home size above.

Do you need a building permit in Winder, and who issues it?

Yes. The City of Winder's Planning and Development Department says building permits are required for all new construction, as well as additions, remodels, and mechanical system replacements1. Plan review comes before the permit is issued1.

The city, not Barrow County, issues building permits inside Winder city limits1. Winder has adopted the state minimum standard codes in Sec. 5-2 of its code, including the building, residential, plumbing, mechanical, fuel gas, energy and fire codes and the National Electrical Code21.

Before you start, call the department at1 to confirm whether your project needs a permit. We could not confirm the city's current building permit fee schedule, inspection steps or certificate of occupancy process, so ask the department for them. Barrow County's published fees apply to unincorporated land, not to Winder lots.

How do septic permits work inside Winder?

Georgia law puts onsite septic permits with the County Board of Health, which must find the site suitable before issuing a construction permit3. The permit is valid for no more than 12 months3. Barrow County Environmental Health is the local office to call22.

A Winder lot on public sewer does not need an Environmental Health approval letter for a residential building application23. Georgia also requires connection to public sewer when a system is available within 200 feet of the property line or in an abutting public right-of-way24.

We could not confirm whether the City of Winder adds any septic rules of its own, so ask Barrow County Environmental Health before you buy a lot that is not on sewer. Barrow County soils are a point in the county's favor: about 69% of the county's soils rate "not limited" for a conventional drain field25, but that is a county figure and a site evaluation still decides any single lot.

Can you live in an RV on your land in Winder?

No. Winder's zoning ordinance bars using a travel or recreational vehicle for living or sleeping when it is parked or stored on a lot in any district5. In residential districts, an RV also may not be parked on a lot that has no permanent dwelling5.

The only RV living the ordinance contemplates is in an RV park, which needs at least 5 acres and limits stays to 14 consecutive days within a 60-day period5. Living in an RV on a Winder lot while you build is therefore not an option.

Outside city limits the answer comes from Barrow County, not Winder; see the Barrow County page.

Building a home in Winder: the steps, in order

  1. Find the parcel's zoning district and check lot size, home size and setbacks against the Winder ordinance2.
  2. If the lot is not on public sewer, contact Barrow County Environmental Health for site evaluation and the septic construction permit223.
  3. Call the City of Winder Planning and Development Department to confirm what permits your project needs1.
  4. Apply for the building permit, which goes through plan review before issuance1.
  5. If you are building your own home, Georgia does not require you to hold a contractor license, but you must still comply with local codes and regulations10. Ask the city about any owner-builder paperwork.
  6. Keep the septic final inspection ahead of backfill, since the Board of Health must approve in writing before the system is backfilled or used26.
  7. If a driveway will join a state highway, apply to the Georgia DOT district office for a driveway permit27.

What stays with Barrow County, and what to check before you buy in Winder

Barrow County, not the city, handles septic permits and well notification for properties in Winder311. For land outside city limits, Barrow County's own building permit and zoning rules apply instead; read the Barrow County page.

Before buying, check three things. First, flood: inside Winder's special flood hazard areas, a new home's lowest floor must sit at least one foot above base flood elevation28. Second, driveways: residential driveways in Winder must be between 10 and 20 feet wide and paved unless an alternate is approved, though agricultural districts are exempt from paving29. Third, taxes: Barrow County's effective property tax rate is about 0.8%30. Property tax is a county-level figure.

Watch-outs

  • We could not confirm the City of Winder's building permit fees, inspection steps or certificate of occupancy process; ask the Planning and Development Department at 770-867-35101.
  • We could not confirm whether Winder has septic, short-term rental or subdivision rules beyond its zoning ordinance; ask Barrow County Environmental Health about septic22.
  • Winder's R-1 district requires homes of at least 2,000 sq ft heated, which is larger than the minimums in the city's other residential districts6.
  • Barrow County's building permit and fee pages describe unincorporated land; Winder lots follow the city's own process1.
