Georgia has 143 counties that require a residential building permit in unincorporated areas, 13 that require one only in some cases and 3 that require none.123 Another 26 counties have no county-wide zoning, and cities set their own rules inside city limits.45 State construction codes apply everywhere, but each local government decides which to enforce.6 Septic permits come from the County Board of Health under Georgia DPH rules.7

Which Georgia counties don't require a building permit?
Georgia has 3 counties that do not require a residential building permit in unincorporated areas: Wheeler County, Bacon County and Wilcox County.3 Another 13 counties require one only in some cases, such as floodplain or certain structures, and 143 require one.21 Counties with limited requirements are not in the no-permit group, so check the specific project with the county.2
These counts describe unincorporated land; cities set their own rules inside city limits.5
The owner-builder exemption removes the state contractor-license requirement when you build your own home, but it does not waive local building codes, permits, inspections or zoning.15 See the owner-builder county list and the list of counties without a residential building permit.
Who enforces building codes and inspections in Georgia?
Georgia's mandatory construction codes, including the International Residential Code, apply to any structure built in the state whether or not the local government enforces them.10 Local governments are not required to adopt those codes, but they must adopt administrative procedures to enforce them, and each may choose which mandatory codes to enforce.6 A county that enforces a code must use the latest edition with state amendments.17 So a county with no permit requirement is not a county with no codes.
County governments can employ inspectors, require permits and set permit charges, and the state sources give no uniform statewide permit fee.186 Only a local governing authority can issue a certificate of occupancy, and the state sources do not require one for every building.19
Farm buildings that meet the state's statutory definition are exempt from the state minimum building codes, but that does not exempt them from zoning or septic rules.20 Georgia DCA's construction codes office answers code questions, and the county building office handles permits.21
Which Georgia counties have no zoning?
Georgia has 26 counties without county-wide zoning and 129 with zoning; 4 counties' zoning answers are unconfirmed.4822 The highest-scoring counties without county-wide zoning are Glascock County, Wheeler County, Bacon County, Telfair County, Echols County, Jenkins County, Treutlen County and Wilkinson County.4 Only 3 counties combine no building-permit requirement with no county-wide zoning: Wheeler, Bacon and Wilcox.9 Compare the no-zoning list and the no-permit, no-zoning list.
Georgia law lets counties zone unincorporated land but does not require them to.5 No state source sets a statewide minimum lot size, home size or setback; those come from the local zoning ordinance where one exists.23
Splitting a parcel is separate: properly adopted county subdivision ordinances apply to anyone creating a subdivision, and a plat may need planning-commission approval.2425 Farming practices are shielded from county regulation, but zoning is not.26
Who issues septic permits in Georgia?
Georgia DPH sets onsite sewage rules, and the County Board of Health issues septic construction permits and inspections; county rules may supplement but not contradict DPH rules.7 Of Georgia's counties, 85 are listed with a county septic office and 74 with a multi-county health district.27 For local services, inspections and records, DPH sends buyers to their County Environmental Health Office.28
The board must find the site suitable before issuing a permit, and the permit lasts no more than 12 months.11 The Board of Health must also inspect and give written approval before the system is backfilled or used.29 Repairs, replacements and additions need permits too.11 Ask the county environmental health office for the site-evaluation application and local fees before fixing a house location; we could not confirm a statewide fee.
Privies, DPH-approved alternative systems and certified composting toilets are recognized off-grid options, but county permits and inspections still apply where the system is an onsite sewage system.30
Can you live in an RV or tiny home on your land in Georgia?
Georgia has RV answers for 79 counties: 16 allowed, 16 temporary-only, 33 limited and 14 prohibited; the other 80 are unanswered, not allowed.12 The highest-scoring allowed counties include Bacon County, Telfair County and Jenkins County, where septic, floodplain and health rules still apply.12 No official statewide rule on temporary camping on private land was located. See the RV-living list.
For tiny homes, 51 counties have answers: 18 allowed, 26 limited and 7 prohibited; 108 are unanswered.13 Bacon County, Jenkins County and Wilcox County are among the allowed.13 A site-built or modular tiny home must meet the building codes and get local siting approval, and the optional tiny-house appendix of the 2020 residential code applies only if the local ordinance adopts it.14 That rule does not cover tiny homes on wheels.14 See the tiny-home list and the counties with no minimum home size.
A manufactured home needs HUD-standard construction, a licensed installer who pulls the state installation permit, and local zoning and siting approval.31
Where are the best Georgia counties for a bolthole?
Glascock County leads the Bolthole Index at 84/100 but requires residential building permits; Wheeler County scores 82/100 and does not.32 Bacon County and Telfair County each score 79/100, with no building-permit requirement in Bacon and limited requirements in Telfair.32 Echols County, Jenkins County, Treutlen County and Wilkinson County each score 78/100; Jenkins has limited requirements and the others require permits.32 All eight lack county-wide zoning, and each has a county or health-district septic office.32
The median county farmland value is $4,133 per acre, a farmland benchmark rather than a vacant lot price.33 The median county effective property-tax rate is 0.9% and the median bill is $1,356 a year.34 Conservation-use assessment can lower the tax base for qualifying farm or timber land, but it requires a 10-year commitment and is not a zoning or building exemption.35
What should you check about water, wells and access in Georgia?
Georgia has 22 counties inside special groundwater-management regimes, and domestic and small-farm wells are exempt from withdrawal permits.36 That exemption does not settle well construction: all wells must comply with the Water Well Standards Act, drillers must contact the county health department in advance for site review, and some county health departments require a well-construction permit.16 EPD keeps lists of licensed well drillers and certified pump installers.37
If a public or community sewer lies within 200 feet of the property line, Georgia's sewer-connection rule applies.38 A residential driveway in a state-highway right-of-way needs a GDOT permit from the District Area Office.39 Floodplain ordinances are run by participating communities, so ask the local floodplain administrator before siting the house, driveway or septic system.40
Watch-outs
- County counts concern unincorporated land; confirm city limits with the county or city planning office before relying on a county zoning answer.5
- Permit and zoning counts are a current comparison, and local rules change; ask the local office for the requirements in force when you apply.623
- No residential building permit does not waive septic permits, the state's mandatory construction codes or local floodplain rules.111040
- We could not confirm a statewide minimum lot size, minimum home size, setback schedule or building-permit fee; ask the parcel's county or city building and planning office.236
- The farm-building code exemption and conservation-use tax assessment do not exempt a farm from zoning, subdivision or septic rules.2035
