Do you need a building permit in Morgan County, Georgia?

Yes. Unincorporated Morgan County requires a building permit before a building is located, erected, moved, enlarged or structurally altered, and applicable electrical, plumbing, gas and mechanical permits must also be approved before work starts.201 Starting without a building permit can bring a $500 fine plus three times the permit fee.21

Morgan County lists the 2018 building, residential, fire, fuel-gas, mechanical and plumbing codes and the 2020 electrical code, all with Georgia amendments.22 Permitted construction is inspected, and a final certificate of occupancy—or a certificate of completion for remodels, additions and non-habitable structures—is required before occupancy.2324 Inside Madison, the city issues building permits for construction, alteration or removal costing more than $500.4 Septic approval stays with Morgan County Environmental Health.7

Who issues building permits in Morgan County, Georgia?

Morgan County Planning & Development handles building permits, inspections, planning, zoning and code enforcement.18 The office is at 150 E Washington Street, Suite 200, Madison, GA 30650, and its phone number is (706)342-4373.18 General questions can go to planningoffice@morgancountyga.gov.18

Building-permit applications and inspection requests go through the online portal.2 Applicants can receive portal messages by email, follow approval and inspection status, and pay fees by credit card.221 The county publishes separate fee schedules for residential, agricultural, trade, land-development and zoning work, and says fees can change.21 Give Planning & Development the parcel identification and proposed use, then ask for the current zoning, applicable permits, fee schedule and submittal checklist.9

Inside Madison, the city issues building permits; contact Madison Planning and Development.42 Septic permits stay with Morgan County Environmental Health through the Northeast Health District.67

Does Morgan County, Georgia have zoning?

Unincorporated Morgan County has zoning and land-use regulations; Madison administers its own zoning inside city limits.835 Septic approval inside Madison remains with Morgan County Environmental Health.7

Minimum lot size, setbacks, building height, lot coverage and landscaped open space depend on the county zoning district.25262728 Accessory dwellings are permitted or conditional by district, with additional specific-use conditions; tiny homes cannot be accessory dwellings.2914 Ask Planning & Development to confirm the district and accessory-dwelling conditions for the parcel.18

Subdivisions and major developments must comply with county zoning and development regulations; Family Divisions also require approved plans, access-road approval and a subdivision plat, with a ten-year restriction on transfers to non-immediate family.30 In Agricultural and Agricultural Residential districts, an existing farm operation may seek conditional-use approval to split off a primary-residence parcel using the specified residential district dimensions.31

How do septic permits work in Morgan County?

Morgan County septic permits and inspections are handled through Northeast Health District Environmental Health.6 Morgan County Environmental Health is at 2005 South Main Street, Suite 200, Madison, Georgia 30650, and can be reached at 706-752-1266 option 3.32

A construction permit from the County Health Department is required before developing a lot or structure that will use an onsite sewage system, and repairs, replacements and additions must also be permitted and inspected.33 An Environmental Health Specialist performs required inspections for septic tank and repair permits under Georgia's onsite-sewage rules.10 Final written approval is required before backfilling or using the system.33 About 81.2% of county soils are rated “not limited” by USDA for a conventional drain field, but that countywide rating does not replace a parcel’s required site evaluation.34

Can you live in an RV or tiny home in Morgan County, Georgia?

Unincorporated Morgan County prohibits an RV as a permanent residence in any zoning district.11 Guest housing is allowed where single-family dwellings are permitted, on property with an occupied permanent dwelling: the RV must belong to a non-county resident and be registered outside the county.12 Guest occupancy is capped at 30 days per calendar year, with no more than one RV at a time; stays longer than nine consecutive days require a Recreational Vehicle Temporary Guest permit.12 Guest RVs cannot connect directly to septic or sewer and must use holding tanks.12

On leased land, a yearly Seasonal Hunting Accommodation permit requires the hunting lease and a map showing the RV location; the RV must leave at season’s end.13 Hunting RVs cannot add septic or sewer connections or electrical poles, but pre-existing connections and poles are excepted; regularly pumped portable toilets are also allowed.13

Unincorporated Morgan County prohibits tiny homes as accessory dwellings.14 A site-built or modular tiny home proposed as another dwelling type must meet applicable Georgia codes and receive local siting approval; ask Planning & Development to classify the proposal before ordering a unit.1518

Building a home in Morgan County: what are the steps?

  1. Ask Morgan County Planning & Development to confirm jurisdiction, zoning, permitted use, lot size, setbacks and lot-coverage limits.828
  2. Check flood status; Morgan County requires a FEMA Letter of Map Amendment before structures may be built on property inside a floodplain.35
  3. Contact Morgan County Environmental Health for the site evaluation and required septic construction permit or sewer direction.633
  4. Obtain county Roads and Bridges approval for the driveway location or culvert size, or GDOT approval on a state highway.36
  5. Submit building and applicable trade permit applications online and wait for approval before starting work.12
  6. Request required inspections and obtain the applicable certificate of occupancy or completion before use.2324

What should you check before buying land in Morgan County?

Start with jurisdiction, zoning, access, water, wastewater and flood status, because each can change where and what you can build.37361935 For a private well, Georgia requires advance contact with the local health department for site review; ask Morgan County Environmental Health whether a local construction permit applies.19 County Roads and Bridges must approve a county-road driveway location or culvert size, while GDOT approval applies on a state highway.36

Morgan County's land is 96.2% gentle by the slope measure and 63.1% wooded, but verify topography and clearing needs on the parcel.3839 The effective property-tax rate is about 0.7%, with a median annual bill of $2,399.4041 Qualifying agricultural property may receive conservation-use assessment, but tax treatment does not waive zoning or building rules.42

Watch-outs

  • Morgan County zoning varies by district, and the existing-farm-operation exemption is a conditional-use path for a primary-residence parcel rather than a blanket exemption from land rules.4331
  • Morgan County requires a FEMA Letter of Map Amendment before building structures on property inside a floodplain, and also to remove an existing structure from a floodplain; ask Planning & Development how the requirement applies to the parcel.3518
  • Morgan County's owner-builder route requires applicant ownership and intended personal occupancy, and it does not waive permits, inspections or applicable codes.16
  • Unincorporated Morgan County prohibits tiny homes as accessory dwellings, although the available rule does not answer every other form of tiny-home occupancy.14
  • Morgan County does not allow an RV as a permanent residence; guest stays are capped and need a temporary guest permit past nine consecutive days.1112
  • We could not confirm a single minimum size for every dwelling or a local private-well permit rule; ask Planning & Development and Morgan County Environmental Health about the specific parcel.1832
