Zoning, building permits and septic rules in Euharlee, Georgia

The City of Euharlee, Georgia has its own zoning ordinance with districts from R-1 to A-11, and building permits are issued at Euharlee City Hall rather than by Bartow County2. An occupied RV is limited to 10 days in any two-month period3. Septic permits come from the Bartow County Environmental Health Department4.

Does Euharlee, GA have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. The City of Euharlee, Georgia has its own zoning ordinance, with districts R-1, R-2, R-3, R-6, RE-1, RE-2, PUD, C-1, C-N, I-1, I-2, A-1, M-1 and O/I1. Rezoning, special use, variance and annexation requests go through the city's Planning & Zoning Department11.

Minimum lots differ by district: R-1 needs 10,000 square feet where sewer is available, R-2 and R-3 need 15,000 square feet, RE-1 and RE-2 need 3 acres, and A-1 needs 5 acres9. Without sewer, an R-1 lot must be at least 26,000 square feet or whatever the health department sets, whichever is greater9. Setbacks in R-1, R-2 and R-3 are 25 feet front, 10 feet side and 25 feet rear; A-1 is 40 feet front, 10 feet side and 25 feet rear12.

Inside Euharlee, an occupied RV is allowed only as a temporary accessory use for no more than 10 days in any two-month period, only with a permanent dwelling on the lot, and only one RV per lot3. Tents may be occupied for no more than 3 days in any two-month period, in the rear yard of a permanent dwelling13. RV living while you build is therefore not an option inside city limits. We could not confirm any city rule on tiny homes, so ask the Planning & Zoning Department before buying; Georgia treats a site-built or modular tiny home as an ordinary dwelling under the building codes, subject to local siting approval7.

Do you need a building permit in Euharlee, and who issues it?

Yes. The City of Euharlee, not Bartow County, handles building permits inside city limits: the permit application is filled out and returned to City Hall with the application fee2. A site plan review by the zoning administrator and the mayor and city council is required before a building permit for any building or expansion of 1,000 square feet or more5. Manufactured houses also need an installation permit5.

Georgia's mandatory state construction codes apply to every building whether or not a local government enforces them14. We could not confirm which codes Euharlee enforces, its inspection process or its permit fee schedule; call City Hall at 770-386-15422. Georgia does not require a license to build your own home, but you must still follow local codes10. A city certificate of occupancy is required before a manufactured house can be occupied15.

How do septic permits work inside Euharlee?

Septic permits for Bartow County come from the Bartow County Environmental Health Department, part of the Northwest Georgia Public Health District, at 5355 Covenant Drive, Cartersville6. Georgia requires a construction permit from the County Health Department before an on-site sewage system is installed4, and a final inspection and written approval before the system is backfilled or used16.

We could not confirm whether the city adds its own septic rules inside Euharlee, so confirm with the county Environmental Health office. State rules require connection to public sewer where it is available within 200 feet of the property line17, and Euharlee's lot-size table sets larger minimums when sewer is not available9. Across Bartow County, only about 32.7% of soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system18.

Can you put a manufactured home or guest house on a lot in Euharlee?

A manufactured house in Euharlee needs an installation permit and a certificate of occupancy, a permanent foundation, masonry skirting, a pitched roof and a covered porch. It must have two fully enclosed parallel sections at least 20 feet wide and at least 1,200 square feet of conditioned living space, and in the A-1 district it is allowed only on at least five acres819. Mobile homes built before June 15, 1976 are not allowed in the city8.

Guest houses are listed as an accessory use in the A-1 district, subject to the ordinance's guest-house section20.

Building a home in Euharlee: the steps, in order

  1. Confirm the parcel's zoning district with the city's Planning & Zoning Department, not the Bartow County planning office11.
  2. Check the district's minimum lot size and setbacks912.
  3. If the parcel is in the floodplain, new residential construction is allowed only if the city's floodplain requirements are met, with the lowest floor at least 3 feet above base flood elevation or 1 foot above the future-conditions flood elevation, whichever is higher21.
  4. Get the septic site evaluation and construction permit from Bartow County Environmental Health6.
  5. For a building of 1,000 square feet or more, complete site plan review before applying for the building permit5.
  6. Apply for the building permit at City Hall2.
  7. If the lot is being split, plat approval and recording are required before sale22.

What stays with Bartow County, and what to check before you buy near Euharlee

The Bartow County Planning and Zoning office deals only with unincorporated Bartow County and tells users to check a parcel's tax district to see whether it lies in Euharlee23. Land outside city limits follows Bartow County's rules, which differ: see the Bartow County page. Septic permits stay with the county environmental health office in either case6.

If the lot fronts a state highway, a driveway there needs a GDOT permit24. Bartow County's effective property tax rate is 0.7% and its median property tax bill is $1,901 a year2526. Land qualifying as bona fide agricultural or timber use can be assessed at 40% of current use value, but that does not exempt it from zoning or building rules27.

Watch-outs

  • Euharlee's city zoning and building permit rules apply only inside city limits; check the parcel's tax district before relying on Bartow County's rules23.
  • We could not confirm Euharlee's permit fees, the building codes it enforces, or any city rule on tiny homes; ask City Hall at 770-386-1542 before you buy2.
  • We could not confirm whether the city adds septic or well rules of its own, so confirm with Bartow County Environmental Health6.
  • RV living is limited to 10 days in any two-month period on a residential lot with a house, so an RV cannot serve as a home while you build3.
