Zoning, building permits and septic rules in Tucker, Georgia

Inside Tucker city limits in DeKalb County, Georgia, a building permit and certificate of occupancy are required and come from the city's community development director1. Tucker adopts its own zoning, so the city's code, not DeKalb County's, sets lot, setback and accessory-dwelling rules2. Do you need a building permit in Tucker, Georgia?

Yes. Tucker's code requires a building permit and a certificate of occupancy from the community development director before any building or structure is occupied17. Plans go in as complete scaled drawings with a survey, setbacks and the zoning classification, and come back to the owner once the director approves them8.

Small detached sheds are the main exception: detached, non-habitable structures under 200 square feet need no building permit, though a site plan is still reviewed by planning5. Anything habitable, or larger, needs the permit.

These are the city's rules. Land outside Tucker's limits, in unincorporated DeKalb County, is handled by the county; see the DeKalb County page.

Who issues building permits in Tucker, and how do you reach them?

The City of Tucker Building & Permitting Division, part of Community Development, handles building and trade permits inside the city5. Applications can be emailed to permits@tuckerga.gov or filed through the city's online permit portal, and the phone number is (678) 597-90405.

The division posts residential permit applications, a residential fee schedule and a Residential Homeowner Affidavit for owners doing their own work5. Georgia law exempts an owner building their own home from the state contractor license, but Tucker still requires the permit61. We could not confirm Tucker's own owner-builder conditions, so ask the division before you sign a contract.

Does Tucker have zoning, and what does it mean for lots, setbacks and accessory homes?

Tucker adopts its own zoning, and every development plan must show the property's zoning classification and any conditions or variances2. Zoning questions, land use petitions and variances go to the Planning and Zoning Division9.

Rules differ by district. In the RNC (residential neighborhood conservation) district, a single-family lot needs at least 6,000 square feet and 60 feet of width10. Setbacks there are 30 feet from thoroughfares, arterials and collectors, 20 feet from local streets, 7.5 feet on interior sides and 20 feet at the rear; lots on the edge of a development get a 20-foot side setback next to outside parcels11. Standards for Tucker's other residential districts were not confirmed, so check the lot's district with Planning and Zoning before buying10.

Accessory dwellings are allowed by right on single-family lots of at least 10,000 square feet, with one per lot, up to 900 square feet heated and 24 feet tall, and the owner must live on the property and hold a homestead exemption4. Historic districts also need a certificate of appropriateness4.

How do septic permits work in Tucker?

Septic permits are not issued by the city. DeKalb Public Health Environmental Health reviews plans, analyzes soil reports, conducts site evaluations and issues permits for septic systems in DeKalb County12. A new system, a new drain line or a repair must be permitted before the contractor starts312.

Much of Tucker is served by public sewer, and Tucker's code requires accessory structures that produce effluent to connect to water and sewer when the primary structure is connected13. For a lot that uses septic, Tucker's accessory-dwelling rule asks for evidence that the septic system is adequate before a permit is issued4. Across DeKalb County, about 51% of soils rate as not limited for a conventional drain field, so some lots will need a site evaluation14. We could not confirm how the health department handles lots inside Tucker specifically; call Environmental Health.

Can you live in an RV or tiny home in Tucker?

We could not confirm a Tucker rule on living in an RV or tiny home on private land, so ask the Planning and Zoning Division at (678) 597-9040 before you plan on it9. Tucker's code does not give a clear answer in the sections we reviewed, and a tiny home built as a regular house would still need the building permit and certificate of occupancy described above1. Georgia treats site-built or modular tiny homes used as dwellings under its standard rules15.

Building a home in Tucker: the steps, in order

  1. Confirm the lot is inside Tucker city limits and find its zoning district with Planning and Zoning9.
  2. Check the district's lot size and setbacks, and any accessory-dwelling limits104.
  3. If you are subdividing, get preliminary plat approval first16.
  4. Submit scaled plans with a survey to the Building & Permitting Division for the building permit85.
  5. If the lot has no public sewer, get the septic permit from DeKalb Public Health before work begins12.
  6. Obtain the certificate of occupancy before moving in7.

What stays with DeKalb County, and what to check before you buy

Septic permits come from DeKalb Public Health rather than the city12. Floodplain questions go to DeKalb County Floodplain Management17. Land outside Tucker's limits follows the county's rules; see the DeKalb County page.

DeKalb County's effective property tax rate is about 0.9%, and the median bill is about $3,046 a year1819. A Georgia driveway or work in a state highway right of way needs a state permit20; we did not confirm Tucker's own driveway permit rules.

Watch-outs

  • Tucker's lot and setback figures here are for the RNC district only; other residential districts were not confirmed, so check the lot's district first10.
  • We could not confirm Tucker's permit fees, inspection rules or RV and tiny-home rules; ask the Building & Permitting Division at (678) 597-90405.
  • A rule from unincorporated DeKalb County does not apply inside Tucker, and Tucker's rules do not apply outside its limits2.
