Zoning, building permits and septic rules in Berkeley Lake, Georgia

Berkeley Lake, Georgia has its own zoning, adopted as Chapter 78 of the city code1. Building permit applications go to Berkeley Lake city hall, not to Gwinnett County2. Septic permits come from Gwinnett Environmental Health2. Living in an RV, camper or travel trailer on a residential lot is prohibited3.

Does Berkeley Lake, GA have zoning?

Yes. Berkeley Lake adopts its own zoning ordinance as Chapter 78 of the city code, with residential districts named R-100 and RMD1. R-100 is the single-family district, and an RMD multifamily district must cover at least 10 acres to be designated7. We reviewed only the residential districts, so ask city hall about commercial districts and the zoning map7.

In R-100 the permitted use is single-family detached dwellings, except mobile homes and modular homes4. Georgia leaves tiny-home siting to local zoning, and we found no tiny-home provision in the city's R-100 rules, so confirm with city hall before planning one8.

Berkeley Lake sits inside Gwinnett County, but Gwinnett's zoning ordinance covers only unincorporated land9. The county's zoning does not set the rules inside Berkeley Lake.

What are the lot size, setback and height rules in Berkeley Lake?

In the R-100 district, a lot that does not adjoin Lake Berkeley needs at least 28,050 sq ft and 200 ft of depth5. Lots on the lake follow frontage and width rules instead of the area minimum5.

R-100 setbacks are 65 ft from the edge of the road at the front, 40 ft at the rear (measured from the full-pool shoreline on lakefront lots), and 12.5 ft at the side6. Corner lots need 25 ft from the bordering road6. Maximum lot coverage is 30 percent, and building coverage is capped at 15 percent, or 20 percent where the table's height limits are met10. Principal buildings on a level lot may be up to 35 ft tall, and up to 45 ft at one end of a sloping lot11.

Accessory structures have their own setbacks in the city's accessory-use section6.

Do you need a building permit in Berkeley Lake, and who issues it?

New construction inside Berkeley Lake starts with a City of Berkeley Lake building permit application, filed at city hall2. The city's checklist asks for 2 sets of plans drawn to scale2. Building permits expire 12 months after issue2, and the city asks applicants to allow a minimum of 5 business days for review2. Questions about building codes go to the city's building inspector2.

An owner who acts as the general contractor submits an owner's affidavit that all federal, state and local codes will be met2. Georgia does not require a license to build your own home, but the owner must still follow local building codes and regulations12.

Gwinnett County's Planning and Development department issues building permits for unincorporated Gwinnett County, not for land inside city limits13. We could not confirm the city's rules on building inspections, certificates of occupancy or fees, so ask city hall for the current fee schedule.

How do septic permits work inside Berkeley Lake?

Berkeley Lake's building permit checklist requires a copy of the septic permit from Gwinnett Environmental Health for any property served by a septic system2. Georgia county boards of health issue septic construction permits, and a permit is valid for no more than 12 months14. In Gwinnett County, GNR Environmental Health requires a Level 3 soil report before it permits new systems, repairs and qualifying additions15.

On lakefront lots, the septic setback is 75 ft from the shoreline at full pool6. Georgia also requires connection to a public or community sewer when one is available within 200 feet of the property line16. For a new sewer tap, the city asks for Gwinnett County Water Resources approval2.

Gwinnett County soils are mixed: about 55.9% of the county's soils are rated not limited for a conventional drain field17. That is a county-wide figure, so expect a site evaluation on any individual lot. Gwinnett Environmental Health handles local procedures18.

Can you live in an RV or tiny home in Berkeley Lake?

No for RVs. Berkeley Lake's code says motorhomes, campers and travel trailers may not be used as living, sleeping or housekeeping quarters on a residential lot3. An RV may be parked on a residential lot for no more than 24 hours while it is being loaded or unloaded3. A stored RV must be under 26 ft long and 9 ft tall, on a paved surface, and set back from lot lines and Lake Berkeley3. That also rules out living in an RV while you build.

Tiny homes: Georgia treats a site-built or modular tiny home as an ordinary dwelling under the building codes, and local zoning decides where it can be sited8. We did not find a tiny-home rule in Berkeley Lake's code, so ask city hall whether a given design fits the single-family district8.

Manufactured homes are not a workaround: R-100 excludes mobile homes and modular homes4.

Building a home in Berkeley Lake: the steps, in order

  1. Confirm the district and setbacks with city hall, and note whether the lot adjoins Lake Berkeley5.
  2. Check flood status: new principal residences are barred in the future-conditions floodplain unless the city's floodplain requirements are met19.
  3. If the lot is within 2,000 feet of the Chattahoochee River, get Atlanta Regional Commission approval before the city issues a permit2.
  4. Get a septic permit from Gwinnett Environmental Health if no sewer serves the lot2, or a Gwinnett County Water Resources tap approval if you connect to water2.
  5. File the city building permit application with 2 sets of plans2.
  6. Allow a minimum of 5 business days for the city's plan review2.
  7. Build to the state minimum codes, which apply whether or not a city enforces them locally20.

What stays with Gwinnett County, and what to check before you buy in Berkeley Lake?

Septic permits and inspections stay with Gwinnett Environmental Health, and water and sewer taps with Gwinnett County Water Resources2. For land outside the city limits, the rules differ: see the Gwinnett County page for unincorporated Gwinnett.

Before buying, check the floodplain rule above19 and the lakefront setbacks6. Short-term rentals are limited: in the RMD district the city requires an annual permit from the city clerk, for owner-occupiers only, with listings capped at 180 days a year21. We could not confirm the rule for the single-family district21.

Gwinnett County's effective property tax rate is about 1%22, and the median bill is $3,381 a year23.

Watch-outs

  • We could not confirm Berkeley Lake's building code adoption, inspection process, fees or driveway permit rules, so ask the city's building inspector before you budget2.
  • The city's building permit checklist we found is an older revision of the form, so confirm current requirements with city hall2.
  • Do not rely on Gwinnett County's zoning or building permit rules for a Berkeley Lake lot, because the county's ordinance covers only unincorporated land9.
  • An RV cannot be used as living quarters on a Berkeley Lake residential lot, even temporarily during construction3.
