Zoning, building permits and septic rules in Cornelia, Georgia

Cornelia, Georgia has its own zoning code, with residential districts from A-1 to TND, and the city's Building & Zoning office handles building permitting and inspection inside city limits12. Septic permits come from the county health department, which in Habersham County is Environmental Health34. Land outside the city limits falls under Habersham County's rules instead.

Does Cornelia, GA have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Cornelia zones land inside city limits under its own code, and no lot may be developed unless it meets the minimum lot size and width for its district1. The residential districts are A-1, R-1, R-1A, R-1B, R-2 and TND9.

In R-1, the minimum lot for a detached single-family home is 20,000 square feet, with setbacks of 25 feet in front, 10 feet on interior sides and 15 feet at the rear1011. In the A-1 agricultural district, the minimum lot is 87,120 square feet and the front, side and rear setbacks are each 25 feet1213. Both districts cap building coverage at 35 percent of the lot and height at 35 feet1415.

The city's non-residential districts and zoning map are not covered here. Ask the Building & Zoning office which district a specific parcel sits in2.

Can you put a manufactured home, tiny home or accessory apartment in Cornelia?

Manufactured homes are permitted inside Cornelia only in the R-1B and R-2 districts, and are prohibited in A-1, R-1, R-1A and TND7. Where allowed, a manufactured home must be at least 20 feet wide, sit on a permanent foundation and meet the city's other installation standards7.

Accessory apartments depend on the district: an attached accessory apartment is prohibited in A-1, and a detached one is prohibited in R-116. Minimum home sizes also vary by district, from 1,800 square feet in R-1 to 700 square feet in A-156.

Georgia treats a tiny home that is site-built or modular as an ordinary dwelling under the building codes, and the local government decides whether it can be sited17. We did not find a tiny-home rule in Cornelia's code, so confirm with the Building & Zoning office before you buy.

Do you need a building permit in Cornelia, and who issues it?

The City of Cornelia Building & Zoning office lists building and permitting inspection, building permit information, and residential and commercial permit fees among its responsibilities2. Georgia requires construction to meet the state minimum building codes whether or not a local government enforces them18.

We could not confirm the full text of the city's permit rule, so call the Building & Zoning office at 706-894-3075 to confirm what your project needs2. Building your own home does not require a state contractor license, but the owner must still follow local building codes and regulations8.

Inside city limits, the city office is the place to start, not Habersham County's Planning and Development Department, which serves unincorporated land19.

How do septic permits work inside Cornelia?

Septic permits are not a city matter. In Georgia, nobody may begin developing a lot or install an on-site sewage system without first getting a construction permit from the county health department, and in Habersham County that office is Environmental Health34.

The Environmental Health office takes applications, record requests and questions by email at habershameh@dph.ga.gov, and by phone at 706-839-02774. A site inspection comes before the permit, and a final inspection and written approval come before the system is backfilled or used20.

If public or community sewer reaches the property line, connection is required when it is available within 200 feet of the property line or in an abutting public right-of-way21. Whether Cornelia's sewer serves a given lot is a question for the city; we could not confirm it from the city code.

Can you live in an RV on your land in Cornelia?

We could not confirm a rule on living in an RV or camping on private land inside Cornelia. Ask the Building & Zoning office at 706-894-3075 whether an RV can be occupied on a lot in your zoning district before you buy2.

Outside the city limits, Habersham County's rules apply instead, and the county's page for unincorporated land is at Habersham County.

Building a home in Cornelia: the steps, in order

  • Ask the City of Cornelia Building & Zoning office which zoning district the lot is in and whether your house type is allowed there2.
  • Check the district's minimum lot size, setbacks and minimum home size9.
  • Check the parcel against flood hazard maps; where a lot is in a special flood hazard area, the lowest floor must be at least one foot above base flood elevation22.
  • Contact Habersham County Environmental Health about sewer availability or a septic site evaluation4.
  • Apply for building permits through the city Building & Zoning office, then schedule inspections2.
  • If the driveway meets a state highway, a permit is required before work in the state right-of-way23.

What stays with Habersham County, and what to check before you buy in Cornelia?

Cornelia lies in Habersham County, and the county handles septic permits through its health department3. A private well is installed by a licensed water-well contractor, who must notify the county health department before drilling24.

County-level figures apply to the whole county, not just the city: Habersham County's effective property tax rate is 0.6 percent25. Land that qualifies for Georgia's conservation-use assessment is assessed at 40 percent of its current use value, though that benefit does not exempt a property from zoning or building rules26.

Watch-outs

  • We could not confirm Cornelia's general building permit rule, certificate of occupancy requirement or fee schedule from the city code; call the Building & Zoning office at 706-894-3075 before you commit2.
  • The city's non-residential districts and zoning map were not reviewed, so confirm the district of any parcel before buying9.
  • Infill lots within Cornelia's original one-mile circular city limits can carry extra subdivision and build-to-line rules that differ from the standard district setbacks2711.
