Does Demorest, GA have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. Demorest, Georgia zones land inside city limits under Chapter 89 of its city code, with districts that include A-1, R-1, R-2, R-PUD and C-PUD1. Residential rules are set district by district, so find your parcel's district first. The city's zoning ordinance and land use map are posted on its website10.

In R-1, a detached single-family lot needs at least 10,000 square feet, with setbacks of 20 feet front, 10 feet interior side, 15 feet corner side and 10 feet rear1112. In the A-1 agricultural district, a lot needs at least 87,120 square feet (2 acres) and setbacks are 25 feet on every side1314. Minimum heated floor area is 1,500 square feet in R-1 and 1,000 square feet in A-178.

Because Demorest requires every dwelling to meet its district's minimum floor area, a tiny home of 400 square feet or less would fall short of those minimums115. Manufactured homes are prohibited in A-1, R-1 and R-26.

For RVs, Demorest's code allows parking or storage only in side yards, rear yards, carports or enclosed buildings, with up to 24 hours anywhere on residential premises for loading and unloading5. That section regulates parking and storage and does not expressly address living in an RV, so ask city hall before planning to camp on a lot10.

Do you need a building permit in Demorest, and who issues it?

Construction inside Demorest city limits goes through the city, not Habersham County. The city's own FAQ says anyone building within city limits can come to the city hall office to complete the permit application2. Demorest's permit forms page lists an application for a residential building permit, a land disturbing permit and a planning and zoning application16.

The city's code adopts the current State of Georgia editions of the building, residential, electrical, plumbing, mechanical, fuel gas, energy and fire codes4. We could not confirm from the city's published code how inspections, certificates of occupancy or permit fees work inside Demorest, so ask city hall at (706)778-420210.

Georgia does not require a state license to build your own home, but that exemption does not waive local permits, inspections or zoning9.

How do septic permits work inside Demorest?

Septic is not a city-hall permit. In Habersham County, on-site sewage construction permits come from the County Health Department or County Board of Health, which also does the inspections3. Contact Habersham County Environmental Health at 706-839-0277 or habershameh@dph.ga.gov17.

Georgia requires a construction permit before anyone installs an on-site sewage system, and a final inspection and written approval before the system is backfilled or used1819. Georgia also requires connection to a public or community sewer when one is available within 200 feet of the property line or in an abutting right-of-way20. We could not confirm where Demorest's own sewer lines run, so ask city hall whether your lot can connect before you plan a septic field10.

Private wells in Habersham County must be installed by a licensed water well contractor, who notifies the county health department before drilling21.

Building a home in Demorest: the steps, in order

  1. Look up your parcel's zoning district (A-1, R-1, R-2 or another) on the city's land use map, and confirm it allows the home you want110.
  2. Check lot size, setbacks and minimum floor area for that district against your plans22.
  3. Ask city hall whether sewer is available. If not, apply to Habersham County Environmental Health for a septic site evaluation and construction permit1817.
  4. Complete the residential building permit application at city hall2.
  5. If you will clear, grade or lay a driveway, ask city hall about the land disturbing permit16.
  6. Build to the current State of Georgia codes and schedule the city's inspections4.
  7. Get written final approval of any septic system before backfilling or use19.

What stays with Habersham County, and what to check before you buy in Demorest?

Septic permits and well notifications stay with Habersham County Environmental Health, whether or not a lot is inside city limits321. Land outside Demorest's city limits follows Habersham County's own rules, which are on the Habersham County page.

Before you buy, check the district and any watershed limits: Demorest's code caps impervious surface at 25 percent in the small water supply watershed23, and dwellings within the original one-mile limits face extra compatibility rules on infill lots24. Maximum building height in A-1, R-1 and R-2 is 35 feet25.

Habersham County's typical home value is about $323,321 and its effective property tax rate is 0.6 percent2627.

Watch-outs

  • We could not confirm Demorest's inspection process, certificate of occupancy rules or permit fee schedule from its published code, so ask city hall at (706)778-4202 before you budget10.
  • Demorest's code regulates RV parking and storage but does not expressly address living in an RV, so get a written answer from city hall first5.
  • Manufactured homes are prohibited in the A-1, R-1 and R-2 districts, and we have not checked the city's other districts6.
  • The state owner-builder exemption covers contractor licensing only; city permits, inspections and zoning still apply9.
